Our long awaited issue of payment of pension to MTNL employees by the Government has been approved by cabinet held today i.e. on 26/12/2013. We express sincere thanks to Bhai Jagtap MLC. Maharashatra State, Chairman United Forum of MTNL Union & Association and Patron of TEAM. Sh. Bhai Jagtap not only played a key role but also acted as a driving force in resolving our long awaited Pension issue.

We also express our sincere thanks to Sh. Kapil Sibal Hon’ble MOC&IT, SH. Milind Deora Hon’ble MOS (C&IT), Sh. Gurudass Kamat, General Secy. AICC & Ex. MOS(C&IT), Dr.(Smt) Kruparani Killi MOS(C&IT),Sh. Prithvi Raj Chauhan Chief Minister of Maharashtra.  19.12.2013 Our case in Hon’ble CAT to set aside ‘Sr. Manager Recruitment Rule 2008’ came up for hearing on 19 Dec. 2013. The proceeding started with submission of  prayer of  qualified candidates . The Hon’ble court has asked other parties to file counter reply  on next date. The next date of hearing has been fixed for 17 January  2014.

Due to vigorous persuasion of our association for immediate payment of retirement benefits to the retirees, the corporate management is releasing today 25 crores i.e.14 crores for Delhi and 11 crores for Mumbai unit for the payment of gratuity to the retired employees. The corporate management is going to release some more amount on 23-12-2013 for the payment of commutation and leave encashment.

Circle Secy. / Area Secy. Of  Delhi and Mumabi circles are requested to inform  the CHQ for latest situation of payment of retirement benefits to the retirees.

The Corporate Management has also released some amount to meet the GPF Advance requirement to the employees.
Association request all working as well as retired executives to get themselves geared up for the ensuing agitation against the callous attitude of MTNL Management towards the executives.

 
 
 18.12.2013  In  continuation to our earlier information about the status of pension issue. We have come to know that the issue of payment of pension to MTNL by Government (as in case of BSNL),is likely to be listed in the cabinet meeting to be held in the next week. We have been informed that the cabinet will clear it with positive note.
 
 
18.12.2013 GSM user base increases to 68 crore in November:The GSM subscriber base in the country rose marginally in November to reach 68.80 crore, with 48.67 lakh new users added during the month, industry bodCOAI sated id today.State-run MTNL added 5,933 new users in the repormonth to take its base to 34.52 lakh. The telecom department has asked Bharat Sanchar Nigam Ltd (BSNL) to drop restrictive clauses that could hinder procurement of network gear from Indian suppliers for the Rs 13,000-crore communications network it is building for the armed forces. 2.) Cabinet asks Telecom Ministry to decide fast on CDMA spectrum price :

Union Cabinet is learnt to have asked the Telecom Ministry to decide on reserve price of CDMA spectrum expeditiously, which has been the bone of contention between the Department of Telecom and telecom regulator Trai. In its meeting held on December 9, the Cabinet directed Telecom Ministry “that the reserve price of spectrum in 800 Mhz (CDMA) band be also finalised expeditiously,” sources told PT . 09.12.2013 Today United Forum members of MTNL Mumbai attended the Conciliation Proceedings on the issue of Payment of Pension by the Government to the employees absorbed in MTNL from DoT. Submission by DoT dated 6.12.2013 to the Concilliation Officer and Asst Labour Commissioner (C)-III Mumbai through Controller of ommunication Accounts mention “The Minutes of Meeting held by Group of Ministers are yet to be received. There is no change in the matter.” DoT’s submission further indicate that the status quoted is based on letter dated 27.11.2013 received from Pension Section. 06.12.2013 CONGRATULATION TO ONE AND ALL FOR MAKING MTNL EXCELLENT……………..Office memorandum has been issued by  Ministry of Heavy Industries  and Public Enterprises Department of Public Enterprises issued on 27th Nov-2013 regarding grading of CPSEs  on the basis of their compliance with the guidelines on the corporate governance for Central Public Sector Enterprises  for the year 2012-13. 05.12.2013 GS wrote a letter to CMD regarding inordinate delay in restoration of services at TY area of MTNL, Delhi unit. He elaborated various procedural delays due to which the services in the said area have not been restored till now and MTNL has suffered a loss of Rs. 12 crores approximately. Message from General Secretary

Comrades,  time  has  come  we  have  to  raise   our  voice  against  the  top management  who  not  at all  interested in providing effective and efficient service to our esteemed customers. This management failed in providing telephone instruments, drop wire, jointing kits, jumper wire which are the basic required items for providing new telephone/broad-band and maintaining the telecom services. The land line network is the only network which provides 80% revenue of the total revenue. We appreciate CMD, BSNL, Who is the real visionary in these two Govt. PSUs i.e. BSNL and MTNL. We are constrained to mention here the approach of MTNL corporate management is totally callous and full of indecisiveness.

We therefore, call upon all the executives, let us stand untidily against this callous and indecisive MTNL corporate management. Friends, as they use to say that they are the “Flying Birds” (due to their fixed term) virtually means having no commitment and sincerity towards the viability of MTNL.

In this scenario we the executives and the members of TEAM have to accept this challenge and ensure that we will not allow these vested corporate management to play with the future of employees/ executives working in MTNL. TEAM also call upon all the retired employees as well as executives to fight against this MTNL corporate management who has utterly failed in making timely payment of GPF, Gratuity, Leave encashment, Commutation pension amount to the retired employees. 

Let us work together, struggle together to save the future of employees as well as MTNL.

25.11.2013 A. K. Kaushik, GS alongwith Rajeeb Kumar, AGS met CMD on 25-11-2013 to discuss the various issues including status of pension , refund of BWA spectrum charges, HR issues and the present situation of maintenance of MTNL services. CMD informed that the cabinet note on pension issue has already been sent to cabinet for consideration. CMD informed that the pension issue may come for discussion in the cabinet in the 2ND week of Dec 2013, i.e. after the completion of electoral process in 5 states including Delhi. According to CMD the case for refund of BWA Spectrum charges to MTNL/BSNL may take some more time due to various reasons and concerns of various nodal ministries. CMD categorically told that the prevailing condition of MTNL will improve to the tune of 50% if issue of pension and BWA spectrum refund gets settled. We also discussed the HR issues viz. Holding of DPCs to fill up all the vacant posts in various cadres in all the disciplines. The issue of child care leave and the immediate release of all pensionary benefits to the retirees and payment of interest over the pending pensionary benefits. We also informed CMD about the uncalled for and in-ordinate delay in payment of GPF to the working as well as retired employees. CMD informed that he will look into the matter. We told CMD very clearly that we shall not remain as silent on-lookers any more and our association will not hesitate to take all course of action i.e. organisational as well as legal in this matter.

25.11.2013 MTNL re-orienting workforce to earn Rs 500 cr additional revenue this fiscal: State-run telecom firm MTNL is remodelling its workforce to make them sales, marketing and customer care driven as part of efforts to generate additional revenue of Rs 500 crore this fiscal.  “We are re-orienting our workforce from operation management driven to sales, marketing and customer care driven. The company has chalked out an agenda so that we generate additional revenue of Rs 500 crore from services and existing resources,” MTNL Chairman and Managing Director A.K. Garg told PTI. 23.11.2013 Yesterday on 22-11-2013 CS TEAM Delhi Com. Ram Gopal along with some executives from Different units of Delhi unit handed over a cheque of Rs. Five Lakh Fifty One Thousands (Rs. 5,51,000/-) only to Smt. Manisha Sharma ( widow of Late Sh. U.D.Sharma). We are in deep pain and have wet eyes while doing so. We know this small amount is nothing in the current scenario but whatever best was possible, has been done. TEAM extends whole hearted gratitude for one and all, who so ever have extended their best possible help for this noble cause. We shall be ever grateful to each of you for your this kindness.

A. K. Kaushik, GS alongwith Rajeeb Kumar, AGS met Dir(HR), GM(HR) and DGM(Pers) on 21-11-2013 to discuss various HR issues. Director (HR) informed us that the issues relating to DPCs for various cadre in various discipline are being actively persued by HR cell. Director(HR) assured that all the vacant posts in various cadre will be regularised. He further informed that individual HR grievances and the clarifications sought by Delhi and Mumbai on various HR matters will be expedited and resolved shortly. Director(HR) has also informed that our representation on CGHS facility to the absorbed DOT employees in MTNL has been favourably recommended to the concerned department and it is in the same line as our association has demanded. In the meeting with GM(HR) and DGM(Pers) we discussed the issue of 1966 posts. He assured that he will get the issue expedited and resolve it soon . We have also given some more inputs to GM(HR). After discussion with GM(HR) we are hopeful that this issue will be resolved in accordance to our expectation. The other issues viz. Seniority case of JAOs, retention of 3 CAOs transferred to Mumbai on promotion, one additional increment in case of promotion to the post of Sr.AO/Sr.SDE and DE/CAO was also discussed in detail. The total response of GM(HR) was positive.
   
 21.11.2013  GS Sh. A.K.Kaushik along with JGS Sh. V.P.Bhardwaj, CP Delhi Sh. K.R.Yadav and CS Sh. Ram Gopal met with ED Delhi Unit on 20-11-2013 to discuss the following points.1) Delay in reliving AOs promoted as CAO: We raised this issue and expressed the frustration of promoted CAOs who are forced to work as AOs even after their long awaited promotion.ED explained that he is aware of the situation but as on date there are only 2 or 3 cases are pending and even for them he will pursue them with Area GMs. 2) Delay in issuing NOC for Pass port/visa/acquisition of movable & Immovable property etc.: We categorically placed some examples wherein the delay was there for such NOCs ED expressed regret over the delay on quoted cases and promised that such cases will expedited. He explained that the condition has been brought to normality after taking his charge as ED. 3) Provision of Officiating instead of LA: We strongly opposed to LA arrangement and demanded that Officiating must be given instead of LA. ED told that in this case decision was taken by MTNL board so he is helpless. Even then he will reopen the case and if there is any possibility to review the decision he will send his recommendation to corporate office. 4) Posting of executives on sensitive posts: We pointed out that before executing these postings shortage of executives may also be considered in Areas. ED replied that he is also of the same view and considering that the implementation of this policy may be done at Area GM Level. 5) Delay in maintenance of services due to shortage of materials/stored items: We explained about the worsening condition of network due to shortage of materials/stored items. We quoted various  examples of different areas. ED agreed that there was shortage of various material/stored items . But as on now there is no such shortage. Even if any particular material /store item is short then the specific case may be brought to his notice. 6) Late Payment of GPF/Retirement benefits: We expressed our anger over delay in payment of GPF / Retirement benefits to the retirees of MTNL. ED was very much of the view that these cases may be delt with priority and this type of payment should be 1st concern of MTNL but at the same time he showed his inability for resolving the matter. He assured us that as in past he had forcibly requested Corporate office for earliest disposal of such cases, he will raise this issue in future too.
   
21.11.2013 Our case in Hon’ble CAT to set aside ‘Sr. Manager Recruitment Rule 2008’ came up for hearing on 20 November 2013. The proceeding started with hearing on the application of candidates qualified written examination for being third party to the case. After deliberating on the matter permission was granted by Hon’ble Court and they have been asked to file their petition before court.Secondly advocate appeared from DOT side argued for escaping from the matter. She placed the view before court that as PSU has framed the rules and regulation at its own so DOT can not be party to the case. But Hon’ble court did not agree to this argument and the request of advocate from DOT was dismissed.The next date of hearing has been fixed for 19 December 2013.

18.11.2013 GS Sh. A.K.Kaushik along with AGS Sh. Rajeeb Kumar met with GM(HR) on 16-11-2013 for knowing the progress of various pending HR issues. Main point of the discussion were:1)Seniority cases of SDEs (1966 post) promoted in 1998: GM (HR) told that the concerned file has been received from Legal section and for further work he will take initiative shortly.2) Seniority case of JAOS: GM (HR ) replied that the case is already in active consideration and hopefully will be settled soon.Regarding rest of the pending cases he requested GS to meet once again as he was in hurry to move to some scheduled meeting.

Open session on the occasion of 4th AIC of AIBSNLEA was held at Nashik on 11-11-2013. The function was organised in a very beautiful venue ‘ SAPKAL KNOWELDGE HUB’ near to Trimbkeshwar temple. The important guest gathered to grace the occasion were Sh. R.A.Upadhya CMD BSNL, Dir. Fin. Sh. Pillai , Dir. CFA Sh. N.K.Gupta and General secretaries of various Associations/ Unions  of BSNL and MTNL.

GS Sh. A.K.Kaushik along with a delegation of 9 office bearers of TEAM Mumbai and TEAM Delhi attended the function.

CMD BSNL while addressing the session underlined and appreciated the role of Unions and Associations of BSNL and MTNL for a major break through of getting resolved  the long pending financial issues of MTNL and BSNL by GOM. He stressed upon the need for revival of our basic network i.e. Land Line and Broad Band connections.

GS Sh. A.K.kaushik addressed the session and appreciated role of unions and associations of BSNL in the major break through in resolving the pension issue of MTNL employees at par with BSNL. He further expressed heartiest gratitude to CMD, BSNL in his key role for getting the pension issue resolved and requested him to take initiatives for possibilities of merger of BSNL & MTNL. Today during his visit to K.L.Bhawan on the occasion of Vigilance awareness week ,CMD MTNL, Sh. A.K.Garg addressed an official gathering. Where in he talked about many aspect and benefit of this type of activities. Further more he assured that the Financial matters mainly of 1) Pension of MTNL employees at par with BSNL 2) Return of Broad Band Spectrum fee, are expected to be resolved by the end of this month. He stressed upon the fact the these type of helps are single time . Whereas for survival of the company we have to stand on our own by improving the quality of services being provided to our esteemed subscribers and in turn increasing the operative profit of our company . He requested one and all to stand united and to work sincerely with full devotion for our company.

   
24-10-2013  Com. A.K.Kaushik, GS, TEAM along with Com. N.L.Thangaraj, President, CS, CP, Com. R.R. Mishra, Jt GS, Com K R More, CHQ VP, Shri. R.S.Nair, AGS and Com K.R. Reddy, ACS met Shri. Piyush Agrawal, ED, Mumbai on 23.10.2013. The following were discussed. (1) Implementation of Financial upgradation from E-2 to E-3 on completion of 4 years as per CO order dt 19-3-2010 without any tinkering. ED agreed to revise the upgradation orders from 5 years to 4 years, if the minimum of new E-3 scale (not pre revised) is crossed on completion of 4 years. For this purpose, Past cases ordered after 1-1-07 to be revised, a special report will be called before 30th November 2013. For new cases, DPC process shall be initiated immediately. Due to TEAM’s efforts, E-2 to E-3 promotion as per corporate office orders are getting implemented as against the wishes of people who are opposed to it. 1) BSNL, MTNL must invest in R&D, says security agency : The National Security Council Secretariat wants to make it mandatory for BSNL and MTNL to invest in R&D to cut dependence on imports and also develop a vibrant telecom products ecosystem in the country. The NSCS is India’s apex security agency that looks into the country’s political , economic, energy and strategic security concerns. “Telecom research efforts in India are sub-optimal and it could be considered whether expenditure on R&D could be made mandatory and eligible for tax benefits, which would be particularly relevant for public sector entities like BSNL and MTNL,” says the NSCS in a confidential note seen by ET. GS along with CHQ office bearers Com. Rajeeb Kumar Com. P.C.Saraswat and Sh. V.P.Bhardwaj met with CMD on 23-09-2013 and discussed following issues in detail.

1) Status of Pension case : It was briefed by CMD that the things are moving in right direction and the case would be resolved shortly.

2) Extension of CGHS facility to MTNL absorbees : We informed CMD that our association has sent several memorandum to DOT for the purpose and now some quarries have been asked by DOT from MTNL which are to be answered . CMD advised us to have meeting with Dir.(HR) for inducing our views in the said letter to be sent to DOT.

3) Pending HR issues: CMD agreed that due to continuous persuasion of Pension and other related issues for GOM , he could not give proper time for pending HR issues. He assured that all the cases will be resolved on priority now.

4) Retention of 3 CAOs posted in Mumbai on promotion: CMD advised us to have meeting with Dir.(Fin) and assured that whenever his intervention is needed for the purpose , he will intervene.

5) Late Payment of GPF and retirement benefit: CMD expressed his deep concern over the issue but at the same time he told that even with positive intention they are not able to pay the amount in time because of shortage of fund. He told that MTNL is pursuing for the reversal of BWA spectrum fee at earliest so as to meet out the expenditures.

6) Retention of LTC facility: We expressed our gratitude for retention of LTC facilty to ITS officers . We demanded that the same facility may kindly be re-extended to all employees/executives of MTNL

All the pending issues were discussed in length with GM(HR) . He listened carefully and assured us that he will take extra effort in getting these issues resolved shortly. He also assured that he will try his level best to increase the motivation level of Executives.

It is being reliably learnt from our reliable sources that GoM meeting held today in the evening has approved the Cabinet Note for making Pension Payment to DoT employees absorbed in MTNL by the Government as in the case of BSNL. It is also decided that Cabinet will approve the pension issue within 15 days and within next 30 days the notification will be issued in this regard for the modalities.

GoM also decided to refund the BWA license fee to MTNL within a month.

GoM also decided to implement Short Term/Long Term revival plan for MTNL within next 45 days and 6 months Respectively.

Today, Dir HR Shri. Sunil Kumar visited Mumbai to obtain the consent letters, agreeing to pay scale parity with BSNL from next pay revision due from 01-01-2017, as per the directives of GoM. Separate letters from TEAM CHQ and TEAM Mumbai were handed over to Dir HR. GS, who is on tour to Mumbai and HQ President signed the consent letter of TEAM CHQ and CS and CP signed on behalf of TEAM, Mumbai.Before handing over the consent letter in the format prepared by the GoM, we raised our apprehensions on the clause which starts with ‘”…… In case MTNL decides to pay pensionery benefits on the basis of pay scales in MTNL………”. Shri. Bhai Jagtap, MLC, President of MTNL Workers Union and Chairman of United Forum of MTNL Unions and Associations, Delhi led the discussion on this apprehension. It was pointed out that MTNL management has chosen to give letter of appeal only to TEAM, MEA and Majority Unions of Delhi and Mumbai, even while asking the letters of consent from all the Unions and Associations. Dir HR admitted the lapse and after discussion, it was agreed that the MTNL management will issue the individual letters of appeal to all the Associations and Unions by Tomorrow, i.e., 27-08-2013 and this will be coordinated by Com. A.K. Kaushik, GS, TEAM. Moreover, Dir (HR) informed that any modification or deviation in the wordings in Consent letter or conditional acceptance may lead to non acceptance by GoM. He also informed that MTNL management will honour the decision of GoM on its liability for the differential part of pension due to higher pay scales of MTNL, vis-a-vis BSNL. Thereafter, Dir HR was requested to brief the members of the United Forum of Unions and Associations of Mumbai. He agreed and clarified the queries raised by the members of all the constituents of United Forum.

After all the issues raised were clarified, Com. A.K. Kaushik appealed to all the Unions and Associations to sign and hand over the Consent letter as per the appeal of MTNL management. Accordingly, the consent letters by all the constituents were signed and handed over to Dir HR. Shri. Shirish Parkar, MLA and President of Sanchar Union of Non Executives was also present at the time of signing the consent letters. We were successful in giving the message of unity of the United Forum to the MTNL management in loud and clear manner.

Subsequently, a brief meeting of United Forum was held, wherein Com. A.K. Kaushik thanked all the constituents of United Forum of Mumbai for their contribution in the struggle for Pension at par with BSNL. He also deliberated other pending issues before the United Forum. The GS informed Dir(HR) and Jt.GM(HR) that he is in Mumbai presently. The Management has requested the GS to be remained in Mumbai along with the President so that the said issue could be discussed and agreement can be signed with Asociation on 26.8.2013 as they are coming to Mumbai on 26.8.2013 for this purpose.

Dear Friends we are in Deep pain while we are informing you sudden demise of our young ,sincere, dedicated and devoted comrade Sh. Umesh Dutt Sharma. He worked with full devotion at many offices in MTNL and till recent time he worked as SDE (MM) in corporate office. He was Only 48 years old . Since last few months he was suffering from liver disease. He could not even fulfill his family responsibilities. Each of us with his family members prayed to almighty for his long life But God did not listened any prayer and he left us alone………….

We pray to God that his soul may rest in peace and his family must have courage to face the challenges of life ahead.

We are always with you and you will be in our hearts. But we will miss your lovely laughing face a lot . With wet eyes and sorrow hearts ……..

When we realize that there is problem, we try to sort out it by the best available solution for that immediately. We try to convince the management/Govt. as per existing laws, relevant papers and through our meetings with them and finally if no one agrees to this logical then we choose the way of struggle with our best TEAM of executives. FELICITATION OF SHRI BHAI JAGTAP,MLC/MAHARASTRA STATE AND EMINENT TRADE UNIONIST FOR HIS VALUABLE CONTRIBUTIONS TO THE RECENT BREAK THROUGH IN MTNL PENSION ISSUE BY T E A M

Shri Bhai Jagtap is an MLC/ Maharastra State and an eminent trade union leader in his own right. He is well known in MTNL, Delhi and Mumbai as a Patron of Team and Chairman of United Forum of MTNL Unions and Associations, Delhi and Mumbai. Bhai Jagtap took keen interest in the matter of MTNL pension issue and played very active leading role in this struggle of MTNL employees and executives. He struck a first significant success in pension issue by way of settling the issue of revision of pension in MTNL on the pattern of BSNL. He steadfastly took up this issue with Shri V Kamath, the then Hon’ble Minister of State (C & IT) in the presence of the then Secretary/DOT and CMD/MTNL and paves the way clear for subsequent issue of the necessary orders.

The struggle of MTNL employees to realize their demand of pension payable by DOT as in BSNL gets considerable impetus when Bhai Jagtap took up this matter and led from the front. Bhai Jagtap contributed significantly to achieve the present break through that came in the form of the reported decision of the Group of Ministers(GoM) under the chairmanship of Shri P.Chidambaram, Hon’ble Minister(F) that MTNL’s pension will be paid by DOT. So as to reciprocate, and to convey gratitude, and our modest way of thankful acknowledgement, TEAM organized a meeting to felicitate Bhai Jagtap. The meeting was held on 07/08/2013 in New Delhi.

Bhai Jagtap was offered flower bouquet, garlanded in a traditional manner. A memento of small but beautiful metal statue of Lord Ganapati was offered to him on behalf of T E A M. Speakers after speakers spoke profusely in the praise of this dynamic trade union leader underlining his contributions in the trade union movements in MTNL and outside. Among the speakers, the prominent were S/ Shri Mange Ram, President United Forum, Delhi, M.K.Bagchi, Convener, United Forum Delhi, A.K.Kaushik, General Secretary, TEAM, V P Bhardwaj, Joint GS/ TEAM, Ram Gopal, Circle Secretary/TEAM, Delhi Circle and S.S.Nanda, General Secretary, RTOWA, Delhi etc.

Shri Bhai Jagtap, in his address, thanked TEAM in particular and MTNL employees in general to honour him in such way. He asserted that he came forward to help because he found the demand of pension as justified and long pending. He feels happy that he could connect himself with the MTNL employees and join their successful struggle. 3) DoT’s swap offer: MTNL/BSNL’s debt for their broadband spectrum. The Department of Telecom has offered to take over the debt of Mahanagar Telephone Nigam Ltd and Bharat Sanchar Nigam Ltd in return for their surrendering broadband spectrum.

While MTNL has a debt of around Rs 8,400 crore, BSNL has taken loans of Rs 2,500 crore.

On the Right path………..MTNL Pension Issue as discussed and decided in the meeting of Group of Ministers (GOM) on 01-08-2013 {On the basis of available reports}

The MTNL Pension issue is reportedly discussed in the meeting of GOM held on 01/08/2013. under the chairmanship of Sh. P.Chidambaram Hon’ble minister (Finance). The decisions taken in the meeting are reportedly as follows:

“a) The Pay scale parity between MTNL employees and BSNL employees will be made in the next wage commission expected to be in session in 2017 subject to the condition that MTNL employees agree to such provision.

b) During the intervening period i.e. till pay scale parity done in 2017 ,the pension of the absorbed employees in MTNL will be paid by DOT and the expenditure will be borne both by DOT and MTNL on the basis of (X+I) formula.”

‘X= Pension liability of MTNL employees as if their pay scale is equal to BSNL employees. This will be borne by DOT.

I= Pension liability accrued on the basis of present difference of pay between MTNL and BSNL employees. It will be borne by MTNL.’

30.07.2013 TEAM meets Maharashtra CM for Pension Issue: On 30-07-2013, a delegation consisting Com. N.L.Thangaraj, President TEAM HQ, Com. J.S.Yadav, CS, TEAM, Mumbai, Com. G.N.Haragaball, Circle President, TEAM, Mumbai, Com. R.A. Rajapure, Advisor TEAM & President RTOWA, Com. R.S. Kulkarni ACS, Com. Kishor Kedar of MTNL Workers’ Union, Com. Rajpur of MTNL Workers’ Union met Shri. Prithviraj Chavan, Honourable Chief Minister of Maharashtra in his chambers at Vidhan Bhavan. A Memorandum urging pension as in BSNL was submitted to him. The CM assured that he is well aware of the issue as on an earlier occasion, he was instrumental in getting the issue reopened after it was dropped. We requested him to forward our Memorandum to Shri Narayanaswami, MoS in PMO and also a member of GoM for MTNL and BSNL Revival. He assured to do the needful. 30.07.2013 The services being provided in MTNL Delhi are being worsen day by day due to lack of availability of funds for maintaining services and acute shortage of store items. 25.07.2013 Meeting with Shri V. Narayanasamy at PMOHon’ble Minister of State (PMO & personal, public grievance and pension) who is also an important member of GOM constituted for the revival of MTNL/BSNL . We submitted to him a memorandum on MTNL pension issue. We have communicated to him that for the survival of MTNL it is immediately required that DOT/Govt. of India has to immediately take over the responsibility of payment of pension to the retired DOT employees absorbed in MTNL and it must be on the same pattern as in BSNL. The deputation to Hon’ble MOS was led by Sh.S.K.Kharventhan (Ex. MP) and member of National Backward commission along with representatives of United Forum (Sh. M.K.Bagchi, Sh. A.K.Kaushik, Sh. Mange Ram Sharma & Sh. Rajeeb kumar). Hon’ble Minister accepted the memorandum and given us a patience hearing. He assured to take up the issue in GOM. TEAM Meeting with New Director (Finance) Shri. Pravin K Purwar on 03-07-2013 on his visit to MumbaiCHQ President Com. N.L. Thangaraj, Jt. GS Com. R.R. Mishra, CS Com. J.S. Yadav, CP Com Haraghbal, Com.K.R.More CHQ VP, Com.N. Balasubramanian AGS, and Com. Jagtap, ACS met Director (Finance) Shri. Pravin K Purwar on 03-07-2013, when he was in Mumbai. A bouquet was presented to him welcoming him on his first visit to Mumbai. He recollected the TEAM meeting in Delhi in the first week of June. The issues discussed were:

1. GoM Meeting for revival plan on 12-06-2013:

DF informed that from MTNL side, two critical issues of Pension and Refund of BWA Licence Fee were highlighted in GoM meeting.

2. Delay in release GPF Payments:

Though GPF money is managed by the GPF trust, there is a delay of more than 1 ½ months in release of payments. Dir (F) agreed with our sentiments and promised to look into the matter.

3. Non Release of Medical Floater Money:

Dir (F) promised to look into the matter.

4. Funds for Operational Work:

Due to shortage of basic stores like drop wire, PVC wire and non availability of funds for other maintenance work, both provision of new lines and attending faults are affected having direct impact on operational income. For this Dir (Fin) mentioned that management is aware of the same and efforts are being made for making the stores available for all types of operations.

JGS SH. V.P.Bhardwaj along with AGS Sh. Rajeeb kumar and OS Sh. A.K.Kapoor met with Joint GM (HR) on 11-07-2013 to discuss the following points:1) Delay in finalization of gradation list of JAOs:- We expressed our concern that since 2005 the gradation list of JAOs have not been updated resulting non holding of regular DPC for their promotion. We also expressed our view point regarding the criteria of fixation of seniority in the light of available rules and RR on which bases the concerned exams were conducted.JGM (HR) replied that he has received the relevant documents and on the basis these documents concerned section is examining the case. He assured that the issue will be resolved on priority.

2) DPC for DGM (Finance):-We pointed out that the screening and vigilance report from both the units have been received so the DPC must be conducted on priority. We also pointed that the eligible executives have already completed the requisite service of 4 years for regular promotion hence the orders must be for regular post instead of Ad-hoc for Finance as well as for Telecom..

JGM(HR) replied that the date of DPC for DGM(F) is scheduled for 17-07-2013.

3) Re-fixation of Seniority of 1966 post case for the SDEs promoted in 1998: We raised the issue and expressed our deep concern over the unwanted delay in the matter. We again reminded him that the affected executives are due for their next promotion and hence delay in re-fixing the seniority will hamper their chance.

JGM replied that the case has received back from legal section and now has been submitted for consideration.

4) Non Settlement of Floater amount by TPA :- We pointed that there are some cases where TPA is not making the payment of Floater Amount even after the sanctioned have been received from competent authority. we even handed over the specific case of Sh. S.K.Vashishtha AO of WS unit who is suffering from cancer.

He admitted that there are some cases pending related to floater amount and they are expediting the process to resolve these cases.

5) Child care leave:- We expressed our concern over the undue delay in settlement of the case.

He replied that the decision will be taken as soon as information from both the units received.

   
12.07.2013 Area level meeting of K.L.Bhawan held on 11.07-2013 during lunch hour at 6th floor canteen. GS along with JGS Sh. V.P.Bharadwaj met with GM.(HR) on 06-07-2013 to discuss the following pending issues:-1) Retention of AOs Promoted and transferred to Mumbai at Delhi:- We expressed our deep concern over the deliberated delay in issuing of modified orders for retention of AOs at Delhi who have been promoted and posted in Mumbai .GM(HR) assured that the orders in this regard may be issued probably on Monday.

2) DPC for DGM (Telecom/Finance):- We pointed out that Screening report of both the units have already been received therefore the DPC for these posts may be conducted without further delay.

GM (HR) replied that DPC for DGM (Telecom) is scheduled on 9thJuly2013 whereas the date for DGM (Finance) shall be decided and communicated at earliest.

3) Finalization of gradation list for JAOs : We pointed out that the examination held in 2004 & 2005 was conducted on RR of DOT therefore the seniority of JAOs must be on the basis of marks obtained in Part-2 Examination instead oif marks obtained in training.

GM (HR) listened the issue and argument patiently and requested to deliver the relevant documents in this regard to DGM (HR).

GS along with JGS Sh. V.P.Bharadwaj , AGS Sh. Rajib Kumar , GS Sh. S.P.S Yadav , OS Sh. A.K.Kapoor and CS Sh. Ram Gopal met with Dir.(HR) on 06-07-2013 to discuss the following pending issues:-1) Delay in holding of DPC for DGM (Telecom/Finance) :- We expressed our serious concern regarding delay in holding of DPC for regular/ad-hoc DGM (Telecom/Finance). We pointed out that in month of April 2013 screening report from both the units (Delhi & Mumbai) for DGM (Telecom/Finance) have been received but DPC could not be held till date.Dir. (HR) replied that DPC for DGM( Telecom) has been scheduled for 9th july2013 and for post of DGM (Finance) DPC shall be conducted shortly.

2)LA order for Different post by Delhi Unit: It is viewed seriously that LA order issued for different posts by Delhi Unit does not consist name from WS Unit/ Corporate Office. With this exercise of Delhi unit senior executives working in corporate office/WS unit are being left for LA / Officiating promotion, which creates frustration amongst executives.

Dir.( HR) assured to examine the issue at earliest.

3)Dealy in finalization of gradation list of JAOs:- We raised our concern that since 2005 gradation list of JAOs has not been finalized resulting in delay in holding of regular DPC for eligible executives of finance. We also raised our view point that while finalizing gradation list marks obtained in Part-2 examination should be considered instead of marks obtained in training center as the exam was conducted on DOT RR basis.

Dir.(HR) replied that he has already received our communication in this regard and he also suggested to discuss this matter with GM(HR) also.

4) Retention of AOs Promoted and transferred to Mumbai at Delhi:- We pointed out that 20 posts of AOs are available at Delhi after regular promotion of CAOs and requested to issue modified order at earliest.

Dir.(HR) assured that the matter has already been decided and orders are expected within few days.

5) The case of re fixation of seniority of SDEs promoted in 1998 (1966 posts) :- The matter was raised before him for over delay in this matter. It was pointed out that association has sent several reminders on this matter and had verbal discussion in the meeting many times but still nothing concrete have been done.

Dir.(HR) replied that he has joined the office recently and will look into this matter so as to decide it on priority.

6) Ad-hoc promotion to DEs/CAOs (E-5) against left out vacancies:- We pointed out that regular DPCs for DEs / CAOs have been completed against 50 % only. Balance 50 % post must be filled on Ad-hoc basis as being done in BSNL since long back.

Dir.(HR) assured to look into the matter.

20.06.2013 Leaders of United Forum Of Unions and Associations of MTNL wrote a letter to CMD regarding pending problems of 1) MTNL pension issue for the DOT recruited employees absorbed in MTNL. 2) Inadequate and un satisfactory medical facilities in MTNL 3) Implementation of fitment formula to benefit merger of 50% DA effectively amounting to 78.2% as on 01-01-2007. 4) Payment of arrears of pension revision w.e.f. 01-01-2007 to the eligible pensioners who retired prior to 01-01-2007. 19.06.2013 GS along with JGS Sh. V.P.Bhardwaj and OS Sh. A.K.Kapoor met with Dir. (Fin.) .He informed us regarding the discussion held in the meeting of GOM. It was highlighted in the meeting that for survival of MTNL mainly two points are to be focused immediately 1) Return of BWA license fee to MTNL 2) Off load the pension liability from MTNL and this responsibility is to be taken over by DOT as being done in case of BSNL. The contribution may be taken from MTNL as per provision of FR 116 only. Dir. (Fin.) further informed us that this issue will be discussed in detail in next meeting of GOM.We are also expecting a call from CMD to discuss and review the pension issue shortly.
   
19.06.2013 GS along with JGS Sh. V.P.Bhardwaj met with GM (HR) and discussed for the issue of order for regular CAO and the cases of recently promoted AOs posted to Mumbai unit.For both the cases it was informed by GM (HR) that orders are likely to be issued tomorrow.

As per decision of CWC, TEAM has formulated a comprehensive promotion policy for executives. After a lengthy discussion on the subject and the suggestion received from many executives we have prepared this policy for better career growth of each executive of all streams working in MTNL. Let us hope management will have a positive note of this CPP.GS has submitted this policy to CMD for kind consideration.

09.06.2013 GS Sh. A.K.Kaushik along with Jt. GS Sh. R.R.Mishra,Jt. GS Sh. V.P.Bharadwaj ,CS Mumbai Sh. J.S.Yadav,CP Mumbai Sh. G. N. Harakbal met CMD MTNL on 07-06-2013 and discussed the issues related to HR and material shortage in the field. We have requested to CMD to immediately fill up all the vacancies in SDEs/AOs , DEs/CAOs/Ex. Engg. and DGM. CMD assured to take all necessary steps to complete the DPC for every cadre. He also assured that orders for DGM promotion will be issued shortly. For shortage of materials CMD assured that this issue will be revised shortly and management will provide all necessary resources to field officers for the maintenance of network. CMD requested that field officers should make all out efforts to provide fault free services to our esteemed subscribers.Thereafter we met Dir.(Finance). Both CMD as well as Dir. (Finance) informed us about presentation made by them to be presented before DOT about the revival plan of MTNL. Secretary Telecom had appreciated the presentation of MTNL management for the revival of MTNL. Secy. (T) had responded positively. CMD and Dir. (F) assured us that management will make all out efforts with the help of Govt. of India for the revival of MTNL. CMD and Dir. (F) made appeal to all the employees forgiving their best so as to take out the MTNL from the present crises.

R.A.Rajapure participated in Dharna organized by Joint Forum of BSNL Unions and Associations at BSNL Corporate office on 05-06-2013 to implement the demand of neutralization of IDA 78.2% in the basic pay of the employees of BSNL w.e.f. 01-01-2007. GS TEAM addressed the meeting and assured full active co-operation of TEAM to the BSNL employees & executives in their genuine and justified struggle.
