30.11.2007 DOT Has endorsed the Prorata Pension notification and instructed all the CCA-DOT Cell to take necessary action. Option will be called for shortly vide letter no:36-3/2007/ten(T) dated 27.11.2007.
26.3.2008 Sixth Pay Commission has made observtions under the following topics regarding PSUs.1. Existing Pay and Pension structures of PSUs – Annexure 2.1.12. Existing Performance linked Incentives of PSUs – Annexure 2.5.13. Ministry of Communications and IT – Chapter 7.6Sixth Pay Commission has observed that Government should discontinue the ITS Service. All the existing ITS officers should either be absorbed in BSNL/MTNL or else sent to the surplus cell.

14.04.2008 TEAM All India Conference held in New Delhi between 9th and 11th April 2008 was a great success more than 800 participants attended the conference along with 70 delegates from Mumbai. 25.04.2008 Shri. Vrijesh Upadhyay, General Secretary, MTNL Mazdoor Sangh, New Delhi had extended his hands to support and participate in the struggle alongwith our association in the common cause of the MTNL absorbed Officers and employees. 17.05.2008 TEAM wrote letter to MTNL CMD Shri.R.S.P. Sinha on 12.5.2008 requesting him to postpone the last date for exercising option for the pro-rata pension till such time clarifications required to take an informed decision in respect of the pro-rata pension is not made available. There are gray areas like who will be the paying authority in either case ? Whether interest on Leave encashment is applicable ? Whether commutation benefits are available for pro-rata optee ? whether the compound interest will be applied on the Gratuity arrears ? Whether the benefits of DA merger will be made applicable as per the 6th pay Commission report ? Whether RPF agrees to accept the pension contribution wef 01.10.2000 ? and The fate of all those who already retired ? These are of essence for taking informed decisions. More over it is reliably learnt that the Govt of India is actively considering appointing DOT as pension paying authority for DOT absorbed officers in MTNL/BSNL. 22.05.2008 It is reliably understood that DOT has emanated a cabinet note with the approval of Hon’ble Minister for communications regarding payment of combined service pension by Govt.”.
12.06.2008 “GS along with Com Bhardwaj, AGS and Com Ramgopal, Circle Secry Delhi mets CMD on 5.6.08 and discussed the issues relating to Payment of combined service pension by Government.
21.06.2008 Com.A.K. Kaushik, Com.R.A. Rajapure, Com.P.S.Padwal and Com. Haragaball attended the Second Circle conference of Maharashtra Circle AIBSNLEA held at Nashik on 21/06/2008. Shri. K.P. Kumar CGM (WTP) Mumbai was the chief guest.Com.A.K. Kasushik emphasized the need for immediate merger of BSNL and MTNL. Com. Prahlad Rai G.S. AIBSNLEA mentioned that the issues of merger of BSNL and MTNL, and Pension issue should be pursued jointly by Associations of BSNL and MTNL. The Chief guest Shri.K.P.Kumar CGM (WTP) mentioned in his speech that everyone in the recently held meeting of Addl.Secretary DOT were in favour of BSNL and MTNL merger. GS elaborated on all the HR issues and their present status. He indicated that the DA merger will take place in a couple of months. TEAM decided to Pursue The BSNL –MTNL merger and Pension issue.
07.07.2008 TEAM Members met Shri. Subodh Kumar, Addl. Secretary, DOT during his visit to MTNL Mumbai and submitted a memorandum for speedy decision in respect of Pension by Govt and Merger of BSNL and MTNL. Shri. 15.07.2008 Pro-rata Pension issue ” It is understood that responses/comments from three Ministries including Finance Ministry is pending to be received by the GOM for further consideration. Hence TEAM CHQ requested Dir(HR), MTNL on 11.07.08, when they met to discuss various issues to extend the due date of 31.07.08. He has agreed to consider the request. TEAM is giving a letter in this regard. Members may please wait for the extension.”

Yashwant Happe, MPCC met Shri Prithviraj Chavan, Hon’ble Minister of State in the Prime Minister’s Office and Minister of State in the Ministry of Personnel, Public Grievances & Pensions, today at his residence in New Delhi. GS TEAM submitted Memorandum and discussed issues regarding payment of combined service pension for MTNL employees by Govt on par with BSNL and appraised the Minister the need for Merger of BSNL and MTNL. 18.11.2008 Com. A.K.Kaushik, General Secretary, Com.V.P.Bhardwaj, AGS and Com. A.K.Kapoor, VP(CHQ) met with Director(HR) on 18.11.2008 regarding various long pending issues such as Regular Promotion in STS scale in respect of all wings. ie., Engg, Fin, Civil and Electrical etc delay in issue of CAO(Ad-hoc) orders, clarification regarding 1st promotion after 4 or 5 years in case of any regular promotion order issued by DOT after 1.10.2000 to the absorbed executives. Fixation of AAO’s pay on absorption on point to point basis as per BSNL pattern, Withdrawal of looking after orders from Oct, 2004 or Oct, 2005 as the case may be on financial up-gradation from E-4 to E-5 in Delhi unit, Pension issue etc. Director (HR) assured to expedite all the issues on priority.
29.12.2008 Pension File moved by DOT was cleared favourably by Department of Personnel (DOP) and moved to Department of Expenditure (DOE). Clearance of DOE awaited.

16.01.2009 Com. A.K.Kaushik, GS, TEAM met CMD, MTNL today at Delhi and discussed issue of Pay-Scale implementation for executives with 30% fitment and Pension issue in length. After detailed discussion, CMD had assured to consider our submission. CMD was having positive attitude for the implementation of Pay Scale for executives with 30 % fitment. CMD has informed that the pension issue is being vigorously pursued by MTNL Management with the concerned authorities. We have also shared our association feed back and efforts for settlement of Pension issue.
19.01.2009 Good News!!! Pension File was approved by Department of Expenditure (DOE). Now the file will be moved to Group of Cabinet Ministers. We are very much confident that the pension issue will be sorted out shortly in our favour. Cheer up for the occasion.
28.01.2009 Congratulations !!! Group of Secretaries had prepared the Cabinet note for Pension to MTNL Executives at par with BSNL employees. This note will be placed before the Cabinet Secretary who in turn will place it for the approval of Cabinet. We are hopeful that relentless efforts with which the matter is being pursued by TEAM will pay off soon. Our leaders are confident that this dream will materialise latest by 15th Feb, 2009. 26.02.2009 General Secretary of TEAM Com. A.K.Kaushik and GS of MEA Com. V.K. Tomar met Secretary (T) today regarding pension issue. Secretary (T) informed that the pension issue is not expected to be taken up in todays’ cabinet meeting and the same will most probably be taken up in the next cabinet meeting.In view of this, request for postponing the last date for submission of pro-rata pension by 28.02.2009 was made to Dir (HR), MTNL. Office Order extending the date for submission of option form for Pro-rata Pension extending up to 30.6.2009 is forwarded to Dir (HR).File in respect of Revision of Pension for the Retired employees was cleared by Department of Personal & Training (DoPT) and Department of Expenditure (DoE) and forwarded to the Law Ministry for further clearance. Association is taking all efforts and pursuing the cases vigorously.

20.04.2009 Good News to MTNL optees !!! Amendments to CCS(Pension) Rules, 1972 issued by Govt of India on the recommendations of 6th Central Pay Commission shall be applicable to those absorbed retirees who opted for combined pension. Orders to this effect was issued by Corporate Office on 17th April, 2009. Payment of 50 % of arrears, allowances and perks applicable is under consideration of the corporate office.

15.06.2009 GS, MEA & GS, Team along with other representatives of Joint forum met secretary Dot & Jt secretary (T) on 12-06-09 in the forenoon and discussed Pension issue. Secretary (Telecom) informed that pension issue of MTNL is under consideration of committee of secretaries but yet no decision has been taken. He said that he is trying his level best to get this issue settled as early as possible.

CEC meeting of Joint forum was held on 25th July in Kidwai Bhawan. Meeting was attended by all office bearers of MEA & TEAM. Meeting was addressed by both General Secretaries of MEA & TEAM along with other office bearers including com S.S.Nanda, Gen Secy Retired Officers Association & Com Virjesh Upadhyay, Gen Secy MTNL MS. GS, MEA elaborately described the whole pension issue and latest development on it. He said that because of persistent pressure from Joint Forum and United forum, meeting of committee of secretaries headed by cabinet secretary on MTNL pension issue has taken place on 23rd July. He also told that MTNL management has made a very strong presentation before the committee, but it is not still so easy to get the issue settled with the continuous opposition from Expenditure dept. He along with all speakers stressed on making the 29th July rally a grand success so that required pressure can be put on Govt. All officers are appealed to reach in this rally in full strength along with their sub ordinate staff. All area Secretaries/ Div Secretaries of both Associations are requested to make proper arrangement to bring all Executives & Non Executives to Jantar Mantar at 12 O’clock on 29th July.

02.09.2009 SOS by MTNL EXECUTIVES FORUMThe convener of Executives Forum at New Delhi is suspended by the management to suppress the agitation programs of the Executives for pension and fitment issues.This shows the adamancy and vindication of the management towards the middle level Executives.In view of this all the Executives are requested to join en-masse in demonstration and rally during lunch hour on 05/09/2009 at Jantar Mantar and memorandum to CMD MTNL Delhi and for demonstration at Prabhadevi Telephone House at Mumbai to protest against such action of management and to protect the convener who is unlawfully implicated and dragged in the case of a minor dispute between some executives and the staff at New Delhi.

07.01.2010 Meeting of joint group of Joint Front representatives and Management representatives was held on 6/1/10. The issue of implementation of new pay package with 30% fitment was discussed. Joint Front maintained its stand of 30% fitment. Management side representatives informed that CMD is going to participate in a meeting in PMO regarding expansion plans of MTNL/BSNL on 6/1/10 and he will also make a presentation regarding MTNL pension issue in front of Prime Minister and there is a review meeting on 7/1/10 in DoT. So the issue of implementation of pay package will further be discussed in next meeting which expected on 11/1/2010.

19.02.2010 General Secretary TEAM Com. A K Kaushik along with Com. Ram Gopal, Circle Secretary, TEAM Delhi Addressed the gatherings at Prabhadevi and City Telephone Exchanges today. All along we maintained that 30 % fitment is our right and we will never compromise even a single penny less than that. No one can snatch away our rightful dues. He informed that the file forwarded to Dot for implementation of the 2nd pay with 30 % fitment will be received back as soon as the Advisor resumes duty on 22nd Feb, 2010. He thanked the houses and told that all this could be materialized only because of your active involvements in the organized movements. We decide and dedicate for the causes and never rest until achieving the goals. He added that we are not leaving any stone unturned and not engage ourselves in propaganda mechanism. He informed the house our struggle for Pension will also be sorted out by March, 2010. 24.02.2010 Joint CEC of TEAM and MEA Mumbai: – Joint CEC of Mumbai was held on 23-02-2010 at 7th Floor, Conference Hall, Telephone House at Prabhadevi Mumbai. Joint CEC was addressed by Com AK Kaushik, Com. Chandra Sekar, Com. J.S. Yadav, Com VK Tomar, Com Sunil Kumar and Com. R.R. Mishra. One after the other appraised the house about the efforts of Joint Forum for getting 30% fitment orders and how MTNL Management agreed to implement 30% fitment and thanked all members for the active support during the struggle. Com. AK Kaushik, GS TEAM apprised about the pension issue in depth and informed that our next priority is to get the pension issue resolved to our satisfaction so that pension will not be a tension after retirement. He informed the house that Mrs. Anita Soni, Dir (Fin), MTNL is putting all out effort in materializing the same.

Joint Forum of MTNL Executive Association represented by the GS TEAM and GS MEA alongwith Office Bearers of both the Association met DOT top Officers -Member Services, DDG (Establishment), DDG (Security) and DDG (TPF) on 19th and 20th April 2010 for getting updates on pay scale revision and pension Issues and the persuance thereof. Joint Forum put forth Associations views to Member Services and DDG(Estab) regarding payment of pension at par with BSNL to the MTNL retirees. We have also drawn the attention of DoT Officers towards issues of revision of Pension on the same lines as is being done by the Govt. for Central Govt. retired Employees. We also persued vigorously the issue of immediate approval of pay revision of Executives with 30% fitment, which has been sent to DoT by MTNL after due approval. It is being told that , this issue is going ahead with positive nod , the file has been cleared by DDG (Security) & presently lying with Finance wing of DOT. We met DDG (TPF) in this regard & requested for early clearance of our case for which he has assured for the same.
23.04.2010 TEAM Mumbai met Hon’ble Minister of State for Communication and IT Shri Gurudas Kamat and submitted a memorandum on Implementation of Revised pay scales for Executives and Pension on par with BSNL. Hon’ble Minister gave a patient hearing and responded favorably to our request for his intervention in DOT for fitment approval and with Ministry of Finance for pension.Subsequent to the meeting, TEAM, Mumbai had meeting with CMD and Dir HR and discussed the following issues:-1. Fitment and pay revision: – CMD informed us that MTNL is pursuing vigorously with DOT at all levels for its approval and its decision is expected early. It is understood and gathered that the proposal is moving in the positive direction so for.2. Pension: – Management has included this item in their presentation made to-day to the Hon’ble Minister and highlighted its importance and urgency. Queries/clarification from Ministry of Finance are being replied by MTNL/DOT.
27.04.2010 Meeting with Secretary( telecom) shri. P.J.Thomas— GS, TEAM & GS,MEA along with AGS, MEA & CS, TEAM met with secretary (Telecom). The pay revision with 30% fitment and pension issue were discussed in length. Secretary (T) assured that DOT approval for pay revision order for executives of MTNL will be issued at the earliest. Secretary has also assured that pension issue at par with BSNL will be persued expeditiously.

04.09.2010 Com. Kaushik, GS TEAM met Dir (HR) on 3.9.2010 and discussed issues. Dir (HR) assured that the issues pertaining to Pension at par with BSNL and Revision of Pension will be taken up seriously with DoT and resolved at the earliest.
24.09.2010 CHQ President Shri N.Chandrasekaran had a meeting with CMD and Dir HR on 24.9.10 at Mumbai after the board meeting and discussed the issue of pension on par with BSNL, extension of date for prorata option and conducting DPCs for regular promotion in all cadres. CMD and Dir HR informed us that the pension issue was highlighted by the Management in the COPU (COMMITTEE ON PUBLIC UNDERTAKINGS)review meeting in which DOT was also present. Management has assured to extend the date for prorata till Dec’2010 and to take further necessary action on conducting DPCs for promotion in all cadres.Comrades, the issue of pension is gaining momentum and TEAM is continuously pursuing the issue through all channels. We will again seek political intervention to resolve the issue once the CWG are over. Our GS will highlight this issue to the new Telecom Secretary when he meet him next week.

MTNL United Forum writes to H’ble Prime Minister on Pension issue and request for:(1) Stop discrimination against MTNL and MTNL’s absorbed employees, executives and retirees.(2) Stop irregular practice of payment of pension and pensionary benefits of the absorbed employees and executives (since retired) from the wage and salary heads of MTNL. Instead DOT should pay the pension and other pensionary dues as it is done in the case of BSNL. DOT can not and should not evade its responsibilities to its employees and officers simply because they have been pushed to the fold MTN in the name of half-baked restructuring.

(3) Complete the absorption process including all sections of officers for honest and full implementation of Govt. policy of restructuring scheme immediately or allow us to get out of this scheme and revert back to DOT set up so that we also can continue to work with the deemed deputation status till end.

28.09.2010 TEAM had already written to MTNL Management with request to extent last date for exercising option for Pro-rata Pension till the issue of payment of pension at par with BSNL is resolved by Govt/DOT. MTNL Management has assured that the option date for the Pro-rata Pension will be further extended up to 31.12.2010. Hence Association has decided none of the executive will exercise option for pro-rata pension. It is the stand of TEAM that no body will give option for pro-rata pension under any situation.
09.10.2010 United forum of MTNL Executives’ Associations and Non-Executives’ unions had taken a decision in the meeting held at CTO, New Delhi on 08-10-2010 to Launch protest action programme to achieve the issues related to Pension payment at par with BSNL, Revision of Pension and immediate completion of absorption of ITS Officers.Protest action programme is as follows:
1. Lunch hour demonstration at Jantar Mantar, New Delhi on 09-11-2010.

2. Rally to Prime minister Office to submit memorandum on 17-11-2010.

3. Non-co operation w.e.f 18-11-2010 till the settlement of the issue.

04.01.2011 CMD called meeting with the representatives of united forum on 05-1-11 at 11 AM on the issue of payment of pension to retirees at par with BSNL.
06.01.2011 Meeting with CMD on 05-01-2010 regarding pension issue—A meeting of UF was held with MTNL management on 05-01-11 in committee room 12th floor Jeevan Bharti building. All the affiliate Associations and unions of UF attended the meeting. From management side, CMD, Dir (Fin), Dir (HR), GM (HR), Jt GM (HR) & GM (A) Delhi unit were present in the meeting. CMD briefed that MTNL management is making all efforts for expediting the pension issue. He told that MTNL management had many discussions with concerned DOT officers and provided all relevant information sought by DOT. He informed that Hon’ble MOS, C&IT, Shri Sachin Pilot had come to MTNL corporate office and assured management that he will make all possible efforts to settle MTNL pension issue and also asked MTNL management to tell Unions/Associations not to resort any protest action which affects the MTNL services. UF expressed its satisfaction on the persuasion of MTNL management and requested to further expedite the case with the involvement of Secretary, DOT. CMD assured that all efforts will be made to get the issue reached to logical end at the earliest.

15.03.2011 BSNL Pension revision order issued today. It is a Historical achievement for BSNL Employees. Immediately about 50,000 BSNL Pensioners retired before 01.01.2007 will be benefited. 17.3.2011 United Forum Delegates met VIP on pension issue on 16.3.2011. We, the convener of United Forum, Unions & Associations, GS TEAM, GS MEA and other office bearers met Hon’ble Shri Oscar Fernanendes, General Secretary, AICC on 16.3.11 in New Delhi and appraised him of the grievances of MTNL absorbed officers and employees in respect of the discrimination made in MTNL Pension issue. Shri. Oscar Fernanendes, was kind enough to give us a Patient hearing of nearly half an hour. He appears to be aware of the problem. He could also recall that the formation of corporation was opposed initially by section of employees out of fear. He also asserted “at that time we pacified you to accept corporation. Therefore now we will help in solving your problem”

Meeting with MOS(C&IT):  –  Delegation of United Forum of MTNL Unions and Associations of Delhi and Mumbai under the leadership of Shri. Bhai Y Jagtap, MLC and Chairman of United Forum met Hon’ble Shri Gurudas Kamat, Minister of State for Communication and IT today, the 11th April, 2011 in North block to discuss MTNL Pension and Revision of Pension issue. Shri. R. Chandrasekar, Secretary, DoT and Shri. Kuldeep Singh, CMD, MTNL were also present in the meeting. Shri. Bhai Jagtap, Chairman and Com. M.K. Bagchi, Convener of United Forum strongly pleaded the issue and urged in favor of pension issues and removing the discrimination made against MTNL Pension issues Vis-a-Vis BSNL.

 

The issue of Pension and Revision of Pension of MTNL at Par with BSNL were thoroughly discussed.  H’ble Shri. Gurudas Kamat, MOS(C&IT) effectively intervened and directed Secretary, DOT to reopen the issue for placing it in the meeting of Committee of Secretaries. H’ble MOS(C&IT) ended that he would personally take this issue to H’ble Ministry of Finance for settlement of the issue.

 

When the issue of Pension revision at Par with BSNL was raised by the delegation, the Hon’ble MOS(C&IT) had immediately intervened and asked Secretary, DOT and CMD MTNL, why the rules pertaining to revision of pension in MTNL were not revised along with BSNL. CMD, MTNL replied that the case is under process.

 

The meeting last for more than one hour and was concluded with vote of thanks.

12.4.2011   Chairman and Com. M.K. Bagchi, Convener of United Forum wrote letter to Secretary, DoT requesting him to take up the MTNL pension issue again with Committee of Secretaries for seeking correction of discrepancies and removal of discrepancies in line with the discussions held on 11.4.2011. The closed file for pension for MTNL employees in line with BSNL was re-opened at the instance of Bhai  Y Jagtap. Now it is desired that we the employees of MTNL should present in mass during May Day celebration and air our Voice during the rally. 29.4.2011  Com.  A.K. Kaushik, GS, TEAM along with Shri. Bhai Jagtab, MLC and Chairman of United Forum attended the Silver Jubilee function of MTNL at CETTM, Powai. During the meeting Problem of Pension and Pension revision and Viability of MTNL were highlighted. Com Kaushik requested all members to stand united to fight for the pension issue.

01.05.2011  MTNL Executive and Non-Executive employees as well as retirees under the banner of various Unions and Associations participated in large number in the May Day celebration meeting organised in Mumbai by Shri Bhai Jagtap, MLC, President, MTNL Workers Union, Mumbai and Chairman of Forum of MTNL Unions and Associations in Delhi. The meeting was attended by Hon’ble Shri. Prithiviraj Chauhan, CM, Maharashtra State and other dignitaries. Bhai Jagtap in his address focussed on MTNL pension issue and drew the attention of Shri Chauhan who earlier as Union Minister backed this issue to progress. Hon’ble Shri Prithiviraj Chauhan, CM in his address asserted that he was fully aware of the case. He asserted that he would further try to ensure that the important issue is finally settled to the fullest satisfaction of MTNL employee.
   
28.05.2011 Com. Chandrashekar CHQ president TEAM along with Com. J.S.Yadav CS Mumbai,  Com. Rajapure from RTOWA Mumbai,  Com. Kishore Kedar and Com. S.M.Sawant of MTNL Workers  Union  Mumbai met Sh. Gurudas KamatH’ble MoS (C) today at Mumbai and reminded about pension for MTNL working employees and revision of pension for retirees at par with BSNL.  Minister told that some policy issues are involved in the subject  and he is following up the case vigorously.
01.06.2011  United Forum’s representatives met Hon’ble Sh. Oscar Fernandes ,MP (RS)& General Secretary (Election )AICC in the evening of 31-05-2011 to discuss about Pension issue of MTNL. At his advice , we again met him in his office at Parliament Annexe building on 01-06-2011. Hon’ble Sh. Fernandes addressed a D.O. to Sh. Kapil Sibbal, Hon’ble Minister (C&IT) on MTNL pension issue and sent a note to Hon’ble Smt. Sonia Gandhi , Congress president enclosing our memorandum.
   
05-07-11  The representatives of United Forum Of MTNL Unions and Associations met Shri Kapil Sibal, Hon’ble MOC in a delegation led by Shri Prakash Javdekar, MP and discussed the issue of MTNL pensions to be paid by D.O.T. as in BSNL. Shri Javdekar forcefully argued the issue in our favour underlying the fact the present discrimination should be removed. Hon’ble MOC  Sh. Kapil Sibal ji appears to be fully aware of the case . He assured to take necessary steps on his side and suggested Shri Javedekar that he should also discuss this matter with Hon’ble Minister of Finance.
   
21-07-11 The full body of United Forum of MTNL Unions and Association , Delhi as well as United Forum, Mumbai met CMD and other Officers of MTNL corporate office on invitation to discuss pension issue. Mumbai unit was linked to discussion on video conferencing . Discussion started with the presentation made by MTNL. Taking a cue from the conclusion of last meeting of MTNL and DOT with MOC&T, discussion was centered around whether it is justified to link the issue of MTNL pension to be paid by DOT as in BSNL to the variance in the pay scales in MTNL and BSNL. It is the united opinion of United Forum, Delhi and United Forum, Mumbai that the linking of pay scales to the pension will only confuse the issue. MTNL management is therefore requested to take up the issue on the basis of assurance of MOC&T made in 2002 only. Please see the text of the assurance given in 2002.

The representatives of United Forum of MTNL Unions and Associations met Hon’ble Shri Pranab Mukerjee , FM today in a delegation led by Shri Prakash Javadekar, MP(RS) to discuss about MTNL pension issue. Shri Prakash Javadekar most effectively and arguably put forth the case and handed over the D.O. letter personally to FM on this issue.

Hon’ble Finance Minister gave a patient hearing and he was quite receptive . He collected from us other related documents as the text of the presentation that MTNL made to Hon,ble MOC&IT. Hon’ble FM assured to examine this issue and let Shri Javadekar to know the outcome within a few following days.

28.09.2011   Com. J.S.Yadav, CS, TEAM, Mumbai along with Com. Rajapure from RTOWA Mumbai and Com. Kishore Kedar, GS, MTNL Workers  Union,  Mumbai met Hon’ble MoS (MOCIT)  Shri. Millind Deora and presented a Memorandum explaining our demand for Pension from Govt. Shri. Millind Deora gave a patient hearing and assured that he will discuss the issue tomorrow with Hon’ble Minister of Communication & IT Shri. Kapil Sibal. He also assured that he will take all efforts in resolving our Pension issue.

Meeting with Addl. Secy(T) and Jt. Secy(T), DoT :GS. President AIBSNLEA, AGSs of SNEA(I) and  CS TEAM (MTNL) met Addl. Secy(T) & Jt. Secy(T) and expressed  our serious concern against  phased repatriation of  deputationists from MTNL/BSNL and discussed the contingency Plan submitted by United Forum wherein we explained  thatMTNL/BSNL are having sufficient absorbed Group-‘A’ level executives i.e. DGMs/GMs/CGMs to man the services and their growth.

We opposed back door entry of ITS Officers in MTNL/BSNL and  requested that DoT should implement its repatriation order in true sense and should not allow back door entry to ITS in BSNL under different Pension Rule since many Group-‘A’ officers have already taken absorption in MTNL/BSNL with certain Pension Rule.  MTNL/BSNL Managements should entrust the responsibility to their own executives rather than depending on those who don’t want to shoulder the responsibility by taking absorption. We pleaded that MTNL/BSNLManagements should immediately be directed first to fill up the vacant HAG/SAG/JAG equivalent posts by conducting immediate DPCs since eligible executives are available. AST/JST appreciated our concern and assured to apprise Secy(T). However, they mentioned that we should regularly meet CMD/Director(HR), BSNL for immediate holding of DPCs

02-12-11 A delegation of United Forum of MTNL Unions and Associations under the leadership of Shri Bhai Jagtap, M.L.C./Maharastra State and  himself an eminent trade unionist, met Shri Kapil Sibal, Hon’ble Minister (C&IT) on 2.12.2011 at his residential office to discuss about MTNL pension issue. A brief note in form of a letter given to Hon’ble Minister (C & IT) particularly underlining the points why pay scales disparity between MTNL and BSNL should not be a matter of consideration in this case. After some discussions, Hon’blr MO(C&IT) has kindly agreed to get these points examined to take a view on MTNL pension issue.

United Forum of MTNL Unions & Associations, Delhi met C M D, MTNL in an introductory meeting along with its associates today .The meeting lasted for half an hour resulting into a lively and purposeful discussions. We welcomed him to MTNL and greeted him. Apart from the exchange of usual pleasantries, we brought to his notice two important issues,e.g., MTNL pension on the line of BSNL and Revision of MTNL pension.

He was attentive and receptive. He requested us to provide him a note on MTNL pension. We have promised to provide at the earliest. As regards, Revision of MTNL pension, CMD noted our observation and suggestions about the present development arisen out of DOT’s letter in response to MTNL’s proposal for Revision of MTNL pension.

CMD,on his part, raised with deep concern the issue of deteriorating financial condition of MTNL. He invited suggestions to immediate improve of revenue.

Various General Secretaries of Unions and Associations offered their considered opinions in this regard.Meeting ended with thanks to CMD.

28-12-11    LATEST POSITION ABOUT PROSPECT OF REV. OF MTNL PENSION After our last meeting with CMD/MTNL, the DOT’s letter on this issue was discussed by CMD along with Director (F) and Director (HR). It is now decided that MTNL will write to  DOT   [ Jt. Secy (T)] for providing administrative/financial approval of DOT. We spoke to Director (HR). He assured to send  communication to DOT within next two days.

b) The case was discussed in Parliamentary committee on 11-01-2012. MTNL management and Secy. DOT attended the meeting and  he was asked by Chairman of parliamentary committee to present the case with all facts and figures in next meeting of committee. It is reliably learnt that the honorable chairman of  committee was very positive to get resolve the issue.

26.4.2012  Worker’s Union at Mumbai is staging One day Dharna in front of Telephone House at Prabhadevi on 27.4.2012 demanding Pension at Par with BSNL. Team extends its moral support and request all members to extend moral support for the cause. Com. Bhai Jagtap, President of Workers’ Union and Com. Kaushik, G.S. TEAM will address the gathering during Closing Hour demonstration. All Members of TEAM Mumbai are requested to participate during closing hour.
   
27.4.2012 GS, TEAM along with CS, TEAM Mumbai and other office bearers of TEAM Mumbai visited the Dharna Site organised by Workers Front to give moral Support. Bhai Jagtap also visited and assured all members that he will take all possible steps to get Pension by Govt to all employees of MTNL. He also pointed that effort of MTNL management in infusing the Pension Trust for working as well as retired employees of MTNL is very dangerous. He assured that he will make all efforts to counter the move of MTNL Management and DoT. He call upon all Unions and Association of MTNL Delhi and Mumbai to join this movement.

E.M.Rajpure, Joint GS, MTNL Workers Union met Shri. Gurudas Kamatji, MP & Ex MoS(C&IT) on 29.4.2012 at Mumbai. The issue of Pension of MTNL Employees was discussed. Shri. Gurudas Kamatji assured us to take up the issue of Pension Payment to MTNL employees by Govt of India & Pension Revision to retired employees with Shri. Kapil Sibbal, H’ble MOC&IT. A.K.Kaushik General Secretary ,Com.V.P.Bhardwaj AGS along with Bhai Jagtap MLC (Maharashtra) and President, MTNL workers Union Mumbai&Chairman of United Forum of Associations & Unions met CMD  MTNL on 04-05-2012 regarding Pension Issue. Bhai Jagtap discussed with CMD regarding long pending issue of pension in detail and briefed various aspect of pension issue. He requested him to take up the case with DOT and Sh, Kapil Sibal, Hon’ble Minister of Communication & IT. He also assured to meet Hon’ble Minister along with Sh. Prithivi Raj Chouan Hon’ble CM of Maharashtra and Sh. Gurudas Kamat in coming days over this issue. He also handed over a note on MTNL Pension issue to CMD, MTNL and requested to resolve the issue on priority.
08-05-12 Com. J.S.Yadav, CS, TEAM Mumbai along with Com. G.N.Haragaball, Circle President,  Com. C.U.Gade, FS, TEAM, Com. Ravindra Kumar, ACS,  Com R.K.Gupta and others met CMD at CETTM and discussed issues pertaining to Pension issue, HR and other Operational issues. CS objected to formation of Pension Trust and made it clear that Trust is totally illegal and not viable. During the meeting CS, TEAM Mumbai also high lighted various operational issues and Shortage of Material. ED, Mumbai requested CS, TEAM Mumbai to visit his office on 10.5.2012 for discussion on these matters. United Forum of Unions and Associations of MTNL (UFOM) was invited by CMD MTNL on 02-07-2012 at corporate office  to discuss the various issues raised . The representatives of all unions and association participated in the meetings. The issues of pension payment for MTNL employees by Govt. of India as in case of BSNL, Pension revision of MTNL retirees ,retired prior to 01-01-2007 and immediate neutralization of 78.2 % DA w.e.f.01-01-2007 were discussed in length. During course of discussion the MTNL management was not coming forward to bring any new solution to resolve these issues . Therefore UFOM rejected the submission of MTNL management.

United Forum has reiterated its stand on all the issues and informed the MTNL management that our protest action programme will continue till the settlement of our all issues. The meeting ended without any result.

It is once again requested to all you to work hard, for resolving all  burning issues raised by UFOM and make the Protest Action Programme a grand success.

Today united Forum of Unions and Associations of MTNL Mumbai has observed Day Long Mass Dharna  in front of Telephone House, Prabhadevi. The Dharna was continued from 10 am to 5.30 pm. Thousands of employees and executives of UFOM participated. Leaders from all the participant Unions and Association addressed the gathering. The members were briefed about the issues and the Protest Action Programme and requested all members to turn out in mass during subsequent stages of the agitation. Pension From Govt is the ultimate aim of this agitation and if we fail to achieve this now, we will never be able to make it up. All Members from UFOM, Mumbai reiterated that Pension is our legitimate right and will continue Our struggle till we achieve the same.

More that 8000 emoloyees and officers participated in the Rally. All speakers stressed that there will not be any compromise on any of the issues and there is no question of accepting BSNL Pay scale. Leaders pointed out the BSNL pay scale is better that DoT and AAI Scale is different than that of BSNL. When there is no question for provision of Pension from Govt for employees of these PSUs, Why this pay parity issue is raised for MTNL alone ?  We totally disagree with the logic and will work for the Govt Pension with MTNL Pay scale. There will not be any compromise on this and we will fight for our legitimate right of pension from the Govt on this Pay Scale. While speaking to the Gathering Shri. Bhai Jagtap assured of his full support for the cause and will be with us until all issues are settled. 23-08-12  A meeting of all constituents of UFOM was held at CTO dormitory New Delhi on 22-08-2012 to access the situation of our movement for pension from Govt. of India issue. All general secretaries of different Associations/Unions stood firmly for resolving this issue at earliest. 10-09-12 Special CEC Meeting of TEAM Mumbai was held at 1330 hrs at 8th Floor, Conference Hall, Bandra Telephone Exchange, Mumbai. Com.J.S.Yadav, CS, TEAM, Mumbai and Com. G.N. Haragaball, President, TEAM Mumbai also addressed the house and discussed various arrangement for the ensuing 3rd CHQ Conference. Com. A.K.Kaushik, GS, TEAM addressed the members and briefed in details all points relating to developments in the Pension front, promotional issues, Viability of MTNL and other issues. He also clarified Governments stand on the pension issue and pension fund and clearly spelled out that the Pension Fund is not a viable options. He cautioned about the forces that were acting against pension issues and told that TEAM has resolved to get pension from Government in line with BSNL pension scheme. He requested members to remain united and explained unity is the need of the hour. He further requested that all UFOM affiliated members are to be briefed and kept in readiness.

GS along with AGS Shri.VP Bharadwaj met Dir(Fin), Dir(HR) and CMD on 18.9.2012. Among other issues related to our cadres, the issue of MTNL Pension to be paid by DOT (GOI) has also been discussed. The impression derived by us during the discussions is that MTNL and DoT are still working on formation of Trust which is not at all acceptable to us. Therefore another course of trade union action in near future can’t be ruled out.

10.10.2012 Open Session held at Yaswant Natya Mandir on 10.10.12 was a grant success. More than 1000 members attended the Open Session. Shri. Rajendra Gawilt, Labour Minister, MH is honored as Chief Guest. Shri. Mahadev Shelar, GS, MPCC attend the conference on behalf of Hon’ble Chief Minister and read out message from Shri. Prithviraj Chavan, CM, MH Since could not attend the Open Session due to his official engagements.  Both Shri. Rajendra Gawit and Shri. Mahadev Shelar endorsed the view of TEAM and said what is happening is not at all correct and assured us that the Maharashtra Govt will stand with us and help us resolving the pension issue in discussion with Centre. Shri. Bhai Jagtab while delivering his speech assured that he and his counterparts in Maharastra Government will take all possible steps to get the issue of Pension from Government to MTNL employees. Shri. Prahlad Rai, GS, AIBSNLEA condemned discriminatory attitude of Govt and assured that BSNL executives are with us in resolving the pension issue and extended active support at all times of need. E.M.Rajpure, Joint GS, MTNL Workers Union, Mumbaimet Shir. Prithviraj Chavan, Hon’ble Chief Minister, Maharashtra at his office at Shayadri, Malabar Hill at 5 pm today and presented memorandum requesting him to use his good offices for resolving our pension issue. He was very much positive in discussion and requested Shri. Bhai Jagtab to accompany him at Delhi during his ensuing visit on 30th of this month. 19.10.2012 Our struggle for  Pension from Government is not finding a way out. DoT is not coming out with any concrete solution for our demand of Pension from Government. 29.10.12 Due to prolonged persuasion of TEAM, MTNL Corporate office issued Order for cancellation/ withdrawal of Pro-rata Pension option exercised by Executives whose applications were not implemented. 05-11-12  Pension and Family Pension for the month of Oct, 2012 to erstwhile DoT employees retired from MTNL was not yet paid. Neither any reason for the non payment was given nor any specific date by which the same will be released is conveyed. RTOWA, Mumbai wrote a letter protesting against this irresponsible and inhuman attitude of DoT and MTNL towards erstwhile DoT employees retired from MTNL. Click here for copy of the letter.

A massive demonstration of Executives and Employees of BSNL/MTNL was held today during lunch hour at BSNL Headquarter in Delhi and at Prabha Devi Exchange Building in Mumbai. The Demonstration was supported by huge number of Executives and Employees. The members were enlightened by various GS of different organisation regarding latest position of court case.

RTOWA Mumbai staged one day Dharna in Mumbai as a protest against non payment of pension  for the month of Oct, 2012 till 8th oct, 2012 and delayed payment of pension due to September, 2012 on 4.10.2012. 24-11-12  Meeting with Dr. Mrs. Kruparani Killi, Hon MOSC&IT on ITS issue. Com M.K.Bagchi Chairman Jt Forum and Com V A N Namboodiri Convenor, Jt Forum and other JF leaders met Dr. Mrs. Kruparani Killi, Hon MOSC & IT at her residence on 24.11.2012 and held discussions on relieving of ITS from BSNL & MTNL. Among MOS’s, she is holding the charge of both PSUs. JF leaders explained in detail the issue and impact of non resolution of this issue on the viability of BSNL & MTNL. We explained that the Managements proposal to continue with the non-optee ITS on deputation for another 10 years is no way going to help the revival of BSNL or MTNL and in that case BSNL & MTNL will collapse within few years. So like the non-optees, other employees of BSNL & MTNL also should be taken back to Govt service for their job and pension security. Hon MOSC&IT had a patient hearing for about 20 minutes and assured that the issue will be further discussed with Hon MOC&IT, Shri. Kapil Sibbal. JF leaders submitted a memorandum also.

Decisions of the meeting held on 04th December, 2012 by JFBMUA: A meeting of the Joint Forum of BSNL & MTNL Unions/Associations was held on 4th December, 2012 at Kidwai Bhawan. Com. M.K. Bagchi, Chairman, presided. 

The meeting discussed about the present situation of the ITS repatriation issue. Detailed discussion took place. During the period the MoS for Communications and many MPs were met by the JF at CHQ and other places and memorandum given. The need for enlarging the Joint Forum and bringing all the Unions/Associations was pointed out by many comrades. After discussions the following decisions were taken:

(a) Pension of MTNL retirees to be paid by government instead of MTNL as in the case of BSNL retirees.

(b) Immediate issue of Presidential Directive from DoT for 78..2% IDA fixation for BSNL employees.

10-12-12  Representatives of United Forum of MTNL Unions and Associations met ED Mumbai on 10-12-12 and  lodged strong protest on MTNL’s roadmap recommending creation of a Trust under Rule 37-A.  We demand direct payment of pension by Govt. like BSNL. Let us be prepared for revival of agitation, if Trust is actually created.

 NOTICE It is for your information  that CEC meeting of TEAM Delhi is scheduled to held on 14-12-2012 at 14 hrs in room no.756 Kidwai Bhawan. The agenda of discussion is the notice given by Joint Forum Of BSNL and MTNL Unions & Associations. Main points of discussion are as follows:

1) Regarding preparation for Dharna on 17-12-2012 & 18-12-2012 at BSNL HQ , as per the protest action programme given by Joint Forum of BSNl and MTNL Unions and Associations for non settlement of issues of

a) Completion of Absorption process by absorbing ITS

b) Payment of Pension of MTNL’s employees at  par with BSNL.

GS, FS and GS, SNEA(I) alongwith Sh. M.K. Bagchi, Chairman, Com. V.A.N. Nambodiri, Convener Jt. Forum of BSNL & MTNL Unions/Associations met Director(Estt.), DoT and discussed for an early clearance of BSNL’s proposal for the payment of 78.2% IDA fitment to BSNL employees and Govt. pension case of MTNL pensioners. Director(Estt.) after some discussions on 78.2% IDA fitment case assured to clear it today itself. Accordingly, she cleared the case and sent to Jt. Secy(Admn.) for further clearance. It is understood that the case will be sent to internal finance of DOT and thereafter to the competent authority for the approval to issue presidential directive.  Director(Estt.) mentioned that regarding pension fund in MTNL the matter is under consideration of DOT.

We also met concern DOT officers and enquired about the ITS absorption issue. It is understood that third meeting of Committee of Secretaries headed by the Cabinet Secretary and comprising of Secy(T), Secy(Personnel), Secy(Expenditure), Secy(Pension and Pensioners Welfare) and Secy(Legal Affairs) was held in the last week to clear the cabinet note on ITS absorption issue and the minutes of the meeting are expected to be issued today from Cabinet Secretary and thereafter the Committee recommendations will sent to Cabinet for consideration & the reply Affidavit will be submitted to Hon’ble High Court Delhi. DOT is going to pray that Group-‘A’ officers presently working on deemed deputation in BSNL/MTNL may be permitted to continue to work in these organisations on a temporary and diminishing basis of a maximum period of 10 years in which they would be able to build their own cadre of officers through the process of recruitment and promotions.

We feel that as per Govt. decision allowing 10 years deputation of ITS in BSNL/MTNL will continue uncertainty which will adversely affected the viability of both the PSUs. We strongly oppose such decision of Govt.

31-12- 12 RESOLUTION 2013 – LET US FIGHT UNITEDLY AGAINST MIGHTY DOT AND GOVT. TO SECURE OUR PENSION FROM GOVT. OF INDIA AND WILL NOT ALLOW GOVT. TO LOOT MTNL AND MAKE MTNL SICK AND ENDANGER OUR JOB AND FUTURE IN MTNL.
01.01.13 Com. R.A. Rajapure, Convener, United Forum of Non-Executives and Executives of MTNL, Mumbai along with Com. Ravindra Kumar, AGS, TEAM and Shri. R.C. Chauhan today met Shri. Raj Babar, Hon’ble Member of Parliament and presented memorandum explaining the Pension issue and requested him to use his good offices for early settlement of Pension from DoT/Government in line with BSNL retirees. After brief discussion he also consented to our demand and assured us that he will take up the matter through parliament members. He requested us to meet him with detailed notes on the issue after 20th Jan, 2013.

08.01.13 Leaders of the Joint Forum of BSNL and MTNL unions and Associations met the Additional Secretary, DoT and discussed issues connected with the viability of BSNL and MTNL, as well as important issues connected with the employees of BSNL and MTNL. It included immediate payment of Rs.1500 crore compensation to BSNL from USO fund, exemption of BSNL and MTNL from the one time payment for the additional 2G spectrum, enhancement of minimum pension from Rs.3500 to Rs.3880, settlement of pension anomaly, payment of Govt. pension to MTNL employees, etc.

(d) Payment of Pension to MTNL employees from Govt. fund as the case of BSNL: We requested that MTNL employees should also be paid pension under Rule-37A from Govt. fund as being paid to BSNL employees. AST mentioned that Govt. has taken a decision to form a Pension Trust in MTNL shortly. Jt. Forum opposed against formation of Trust as such it will not be viable. Today a meeting of  leaders of Joint Forum of unions and associations of MTNL &BSNL was held with CLC at New Delhi. The issue of pension for MTNL employees and executives at par with BSNL was discussed exclusively. MTNL could not come with full preparation  and hence seeked some more time for the discussion.

United Forum of Unions and Associations of MTNL, Mumbai submitted rejoinder to the submission of MTNL, CO and DoT during the  Conciliation Proceedings held on 22.11.2012 requesting the Conciliation officer to direct MTNL/DoT to maintain status quo during the pendency of RLC proceedings. UFOM also mentioned clearly that if MTNL/DoT continues to go ahead with the formation of trust during conciliation proceedings, the United Forum will resort to trade union action as deemed fit for which the sole responsibility shall lie with MTNL/DoT. Click here for the copy of the rejoinder.

 

During the meeting of the UFOM held on 29.1.2013, UFOM Mumbai had decided to hold Gate meeting in front of Prabhadevi Telephone house on 5th Feb, 2013 during Lunch hour opposing the move of MTNL/DoT to form the Pension Trust in utter violation and disregards to the Conciliation proceedings. Further course of action will be decided in consultation with United Forum of Delhi. The Gate meeting in front of Prabhadevi as above should force MTNL/DoT to change its decision. All members of affiliated Unions and Associations of United Forum are requested to stand together and show our solidarity to the struggle for getting Pension from Govt./DoT and send the message that MTNL has no authority to sabotage our right for pension from Government.

05-0213  United Forum of Unions and Associations of MTNL, Mumbai held Gate meeting in front of Telephone House at Dadar, Mumbai opposing move of DoT to form Pension Trust for payment of pension to MTNL retirees. More than 2500 members attended the Gate meeting. Speakers condemned the move of DoT in moving towards formation of Single Trust for all MTNL retirees and decried the cowardice move of MTNL authorities as against all assurances and commitments given in and out of parliaments. Shri. Shirish Parkar, MLA & veteran Leader of Karmachari Union While addressing the gathering assured his full support for the cause and said that nothing short of Government pension is acceptable. United Forum declared that the further agitational programmes will be communicated in consultation with our counterparts at Delhi who are expected to meet shortly.

CEC of TEAM Delhi held on 13-02-2013 in room no. of 756 of Kidwai Bhawan ND. The members from every corner of Delhi participated in the meeting and discussed the agenda as already notified. During the Discussion the matter of Pension at par with BSNL was discussed in depth. Hon’ble Sh. M.K.Bagchi also addressed the house and briefed about latest development in this issue. Sh. Ram Gopal CS and Sh. V.P.Bhardwaj JGS Addressed the house and briefed them about latest meetings with ED and GM(HR). Sh. A.K.Kaushik General Secy. Addressed the house and explained each merits and consequences of this issue. He asked members to be ready for final battle against this injustice of DOT and advised to hold Div. Level body meeting for explaining our commitments for resolving this problem.  Meeting was ended with vote of thanks from Circle president.

21-02-13  UFOM Mumbai members attended the Conciliation proceedings held by CL(C ) on 21.2.2013. MTNL management attended the meeting. No DoT representative was present in the meeting. UFOM Members expressed their anger on the move of MTNL/DoT in going ahead with formation of pension trust and Rejoinder filed on 21.1.2013 is having all factors justifying pension directly by Government and struck to the demand. 23-02-13  TEAM Delhi has organized Divisional level meeting at Okhla on 21-02-2013 and at Rajouri Garden on 22-02-2013 . The each meeting was  attended by huge number of executives. The CHQ leadership and circle Team are making their whole hearted efforts for enlightening  all executives on  pending issues. The matter of trust formation , its viability , the financial position of MTNL and the  maintenance of network of MTNL  are the main points of agenda. Sh. A.K.Kaushik GS is participating in all most all meetings in spite of his illness just to make understand  the seriousness of the pension issue to each of us.
02-03-13 UFOM Mumbai wrote letter to CMD, MTNL and Secretary, DoT to express Protest against the move of DoT/MTNL to form Pension Fund in the form of a single Trust for payment of pensionary benefits including Pension/Family Pension to all categories of MTNL absorbees by bringing suitable amendment in Rule 37-A. It also expressed clearly, if DoT/MTNL continues to go ahead with the formation of pension trust during conciliation proceedings, the United Forum of Unions and Associations in MTNL Mumbai will resort to trade union action as deemed fit for which the sole responsibility will lie solely on DoT/MTNL. 10-04-2013 GS Sh. A.K.kaushik along with JGS Sh. V.P.Bhardwaj , AGS Sh. Rajib Kumar , Advisor Sh. R.A.Rjapure , Circle Secy. Mumbai Sh. J.S.Yadav and  Circle President Mumbai Sh. G.N.Haragaball met Dir.(Fin.) on 09-04-2013 to discuss the progress of pension issue.

Dir.(Fin.) informed that we are working very seriously to resolve this issue and CMD himself is taking keen interest. She further told that we are accepting a meeting with Hon’ble MOC to give presentation over the issue. Although there are many other factors which are beyond our control but we aspects that this issue should be resolved on priority and favorably so that there should not be any problem to retirees .

10-04-13  GS Sh. A.K.kaushik along with JGS Sh. V.P.Bhardwaj , AGS Sh. Rajib Kumar , Advisor Sh. R.A.Rjapure, Circle Secy. Mumbai Sh. J.S.Yadav and  Circle President Mumbai Sh. G.N.Haragaball met CMD on 09-04-2013.  We strongly  opposed the move of formation of pension trust and   asked  for the current status of  amendments  as suggested by United Forum on the issue. We further informed him that if the case is not being solved to the best satisfaction of the executives then we will be forced to go on the path of protest action programme. CMDinformed us that the we have sent the suggestions as proposed by United Forum and DOT is examining them..
12-04-13  United Forum Convener Com. M.K.Bagchi and GS, TEAM Com. A.K.Kaushik met Member(Services), DoT on MTNL Pension issue. United Forum of MTNL Unions & Associations met Member (Services), DoT today, 12.4.2013, at short notice at 4.30 pm. We discussed the MTNL Pension issue and appraised him of our serious concern regarding stable and secured pension and viability of MTNL and security of service of employee working in MTNL. Member (Services) gave us a patient and sympathetic hearing. He assured that he stoutly stands in favour of 100% security of pension, family pension and other pensionary benefits including revision of pension for MTNL employees and also security of service of MTNL employees and ofcourse the viability of MTNL.
18-04-13 It appears that Govt/DoT had realized the Proposed Pension Trust under Rule 37-A of CCS(Pension) Amendment Rule, 2012 for payment of pension and other pensionary benefits including family pension to MTNL absorbed retirees is not financially viable and may not survive till the last retiree. 30.4.2013  Shri A.K.Kaushik, GS, TEAM, S/Shri. J.S.Yadav, R.A. Rajapure  along with  Ravindra Kumarand R.S.Nair, met Shri. Bhai Jagtap. MLC MH State & renowned Trade Union Leader in Mumbai on 30th April 2013 at 10.30 pm & appraised him of present status & latest move by DoT/MTNL on MTNL Pension issue. He was also requested to use his political contacts/position to resolve the issue. After detailed discussion, he assured that he will take up the matter with MoC&IT with the help of Shri. Milind Ji Deora, MoS(C&IT), Shri. Pritviraj Ji Chavan, Hon’ble CM, MH who dealt with the pension while holding the charge of MoS(PMO)/Dept.of P&PW and Shri. V. Narayanaswamy Ji, MoS(PMO) . Shri. Bhai Jagtap also assured that if need be he will camp in Delhi so as to resolve the issue in favour of MTNL employees.

Bhai Jagtap, MLC and Chairman, United Forum of MTNL Associations n Unions,  Delhi forcefully pleaded MTNL Pension issue before the Hon’ble Chief Minister of Maharashtra,  Shri.Prithviraj Ji Chavanji to take up with Shri.  Milind Deoraji and Shri. Narayanaswamy Ji. Shri. A.K.Kaushik, GS, Shri. Thangaraj, President, TEAM, Shri. J.S.Yadav, Circle Secretary, Mumbai, Shri. G.N. Haragaball, Circle President, Mumbai,  Com. Rajapure, President, RTOWA Mumbai and Advisor, TEAM, Shri. Ravindra Kumar, AGS, TEAM, Shri. GS Sh. A.K.KAushik along with AGS Sh. Rajeeb kumar met with Director Finance MTNL on 18-05-2013 and discussed the following points:

1) Regarding the progress of Pension Case at par with BSNL: Dir. Fin. told that the case is in positive direction. All the suggestions as given by Untied Forum  for amendment in constitution of Pension Trust have been incorporated in the note sent DOT .

2) Posting of Promoted AOs to Mumbai: We expressed our deep concern over the issue and demanded that an early disposal of the issue.She assured us that the she is well aware of the problem and is doing her best for earliest disposal of the issue.

GS along with JGS Sh. V.P.Bhardwaj and OS Sh. A.K.Kapoor met with Dir. (Fin.) .He informed us regarding the discussion held in the meeting of GOM. It was highlighted in the meeting that for survival of MTNL mainly two points are to be focused immediately 1) Return of BWA license fee to MTNL 2) Off load the pension liability from MTNL and this responsibility is to be taken over by DOT as being done in case of BSNL. The contribution may be taken from MTNL as per provision of FR 116 only. Dir. (Fin.) further informed us that  this issue will be discussed in detail in next meeting of GOM.

We are also expecting a call from CMD to discuss and review the pension issue shortly.

20.06.2013  Leaders of United Forum Of Unions and Associations of MTNL wrote a letter to CMD regarding pending  problems of 1) MTNL pension issue for the DOT recruited employees absorbed in MTNL. 2) Inadequate and un satisfactory medical facilities in MTNL 3) Implementation of fitment formula to benefit merger of 50% DA effectively amounting to 78.2% as on 01-01-2007. 4) Payment of arrears of pension revision w.e.f. 01-01-2007 to the eligible pensioners who retired prior to 01-01-2007. Please click here for copy of  letter.

08.01.2013  Leaders of the Joint Forum of BSNL and MTNL unions and Associations met the Additional Secretary, DoT and discussed issues connected with the viability of BSNL and MTNL, as well as important issues connected with the employees of BSNL and MTNL. It included immediate payment of Rs.1500 crore compensation to BSNL from USO fund, exemption of BSNL and MTNL from the one time payment for the additional 2G spectrum, enhancement of minimum pension from Rs.3500 to Rs.3880, settlement of pension anomaly, payment of Govt. pension to MTNL employees, etc.

1. . GoM Meeting for revival plan on 12-06-2013:: DF informed that from MTNL side, two critical issues of Pension and Refund of BWA Licence Fee were highlighted in GoM meeting.

25.07.2013    On 25-07-2013 we gave a deputation to Shri. V.Narayanasamy, Hon’ble Minister of State (PMO & personal, public grievance and pension) who is also an important member of GOM constituted for the revival of MTNL/BSNL . We submitted to him a memorandum on MTNL pension issue. We have communicated to him that for the survival of MTNL it is immediately required that DOT/Govt. of India has to immediately take over the responsibility of payment of pension  to the retired DOT employees absorbed in MTNL and it must be on the same pattern as in BSNL. The deputation to Hon’ble MOS was led by Sh.S.K.Kharventhan (Ex. MP) and member of National Backward commission along with representatives of United Forum  (Sh. M.K.Bagchi, Sh. A.K.Kaushik, Sh. Mange Ram Sharma & Sh. Rajeeb kumar). Hon’ble Minister accepted the memorandum and given us a patience hearing. 30.07.2013  TEAM meets Maharashtra CM for Pension Issue:  On 30-07-2013, a delegation consisting Com. N.L.Thangaraj, President TEAM HQ, Com. J.S.Yadav, CS, TEAM, Mumbai, Com. G.N.Haragaball, Circle President, TEAM, Mumbai, Com. R.A. Rajapure, Advisor TEAM & President RTOWA, Com. R.S. Kulkarni ACS, Com. Kishor Kedar of MTNL Workers’ Union, Com. Rajpur of MTNL Workers’ Union met Shri. Prithviraj Chavan, Honourable Chief Minister of Maharashtra in his chambers at Vidhan Bhavan. A Memorandum urging pension as in BSNL was submitted to him. The CM assured that he is well aware of the issue as on an earlier occasion,  he was instrumental in getting the issue reopened after it was dropped. We requested him to forward our Memorandum to Shri Narayanaswami, MoS in PMO and also a member of GoM for MTNL and BSNL Revival. He assured to do the needful. The MTNL Pension issue is reportedly discussed in the meeting of GOM held on 01/08/2013. under the chairmanship of Sh. P.Chidambaram  Hon’ble minister (Finance). The decisions taken in the meeting are reportedly as follows:

“a) The Pay scale parity between MTNL employees and BSNL employees will be made in the next wage commission expected to be in session in 2017 subject to the condition that MTNL employees agree to such provision.

b) During the intervening period i.e. till pay scale parity done in 2017 ,the pension of the absorbed employees in MTNL will be paid by DOT and the expenditure will be borne both by DOT and MTNL on the basis of (X+I) formula.”

‘X= Pension liability of MTNL employees as if their pay scale is equal to BSNL employees. This will be borne by DOT.

I= Pension liability accrued on the basis of present difference of pay between MTNL and BSNL employees. It will be borne by MTNL.’

RECENT BREAK THROUGH IN MTNL PENSION ISSUE BY

 

T E A M

Shri Bhai Jagtap is an MLC/ Maharastra State and an eminent trade union leader in his own right. He is well known in MTNL, Delhi and Mumbai as a Patron of Team and Chairman of United Forum of MTNL Unions and Associations, Delhi and Mumbai. Bhai Jagtap took keen interest in the matter of MTNL pension issue and played very active leading role in this struggle of MTNL employees and executives. He struck a first significant success in pension issue by way of settling the issue of revision of pension in MTNL on the pattern of BSNL. He steadfastly took up this issue with Shri V Kamath, the then Hon’ble Minister of State (C & IT) in the presence of the then Secretary/DOT and CMD/MTNL and paves the way clear for subsequent issue of the necessary orders.

The struggle of MTNL employees to realize their demand of pension payable by DOT as in BSNL gets considerable impetus when Bhai Jagtap took up this matter and led from the front. Bhai Jagtap contributed significantly to achieve the present break through that came in the form of the reported decision of the Group  of Ministers(GoM) under the chairmanship of Shri P.Chidambaram,  Hon’ble Minister(F) that MTNL’s pension will be paid by DOT. So as to reciprocate, and to convey gratitude, and our modest way of thankful acknowledgement, TEAM organized a meeting to felicitate Bhai Jagtap. The meeting was held on 07/08/2013 in New Delhi.

Bhai Jagtap was offered flower bouquet, garlanded in a traditional manner. A memento of small but beautiful metal statue of Lord Ganapati was offered to him on behalf of T E A M. Speakers after speakers spoke profusely in the praise of this dynamic trade union leader underlining his contributions in the trade union movements in MTNL and outside. Among the speakers, the prominent were S/ Shri Mange Ram, President United Forum, Delhi, M.K.Bagchi, Convener, United Forum Delhi, A.K.Kaushik, General Secretary, TEAM, V P Bhardwaj, Joint GS/ TEAM, Ram Gopal, Circle Secretary/TEAM, Delhi Circle and S.S.Nanda, General Secretary, RTOWA, Delhi etc.

Shri Bhai Jagtap, in his address, thanked TEAM in particular and MTNL employees in general to honour him in such way. He asserted that he came forward to help because he found the demand of pension as justified and long pending. He feels happy that he could connect himself with the MTNL employees and join their successful struggle. Bhai Jagtap is very candid in his observation about certain prevalent maladies in MTNL trade union arena. He called upon all to launch relentless fight against such maladies. He reiterates his assurance to continue to help MTNL and its employees.

21-08-13 Com. A.K.Kaushik, GS, TEAM spoke to CMD, MTNL and enquired about the Minutes of GoM meeting held recently on 1st August, 2013. CMD, MTNL Confirmed receipt of GoM minutes and told that Corporate Management will call for discussion on the issue shortly.
22-08-13 In continuation to yesterdays’ discussion of GS with CMD, MTNL, MTNL Corporate Office contacted our GS on Telephone for discussion on GoM Minutes relating to payment of Pension by Govt. of India/DoT to absorbed DoT employees in MTNL  and signing of agreement thereof. The GS informed Dir(HR) and Jt.GM(HR) that he is in Mumbai presently. The Management has requested the GS to be remained in Mumbai along with the  President so that the said issue could be discussed and agreement can be signed with Asociation on 26.8.2013 as they are coming to Mumbai on 26.8.2013 for this purpose.

Today, Dir HR Shri. Sunil Kumar visited Mumbai to obtain the consent letters,  agreeing to pay scale parity with BSNL from next pay revision due from 01-01-2017,  as per the directives of GoM. Separate letters from TEAM CHQ and TEAM Mumbai were handed over to Dir HR. GS, who is on tour to Mumbai and HQ President signed the consent letter of TEAM CHQ and CS and CP signed on behalf  of TEAM, Mumbai.

Before handing over the consent letter in the format prepared by the GoM, we raised our apprehensions on the clause which starts with ‘”…… In case MTNL decides to pay pensionery benefits on the basis of pay scales in MTNL………”. Shri. Bhai Jagtap, MLC, President of MTNL Workers Union and Chairman of United Forum of MTNL Unions and Associations, Delhi led the discussion on this apprehension.

It was pointed out that MTNL management has chosen to give letter of appeal only to TEAM, MEA and Majority Unions of Delhi and Mumbai, even while asking the letters of consent from all the Unions and Associations. Dir HR admitted the lapse and after discussion, it was agreed that the MTNL management will issue the individual letters of appeal to all the Associations and Unions by Tomorrow, i.e., 27-08-2013 and this will be coordinated by Com. A.K. Kaushik, GS, TEAM. Moreover, Dir (HR) informed that any modification or deviation in the wordings in Consent letter or conditional acceptance may lead to non acceptance by GoM. He also informed that MTNL management will honour the decision of GoM on its liability for the differential part of pension due to higher pay scales of MTNL, vis-a-vis BSNL.  Thereafter, Dir HR was requested to brief the members of the United Forum of Unions and Associations of Mumbai. He agreed and clarified the queries raised by the members of  all the constituents of United Forum. 

After all the issues raised were clarified, Com. A.K. Kaushik appealed to all the Unions and Associations to sign and hand over the Consent letter as per the appeal of MTNL management. Accordingly, the consent letters by all the constituents were signed and handed over to Dir HR. Shri. Shirish Parkar, MLA and President of Sanchar Union of Non Executives  was also present at the time of signing the consent letters. We were successful in giving the message of unity of the United Forum to the MTNL management in loud and clear manner. 

Subsequently, a brief meeting of United Forum was held, wherein Com. A.K. Kaushik thanked all the constituents of United Forum of Mumbai for their contribution in the struggle for Pension at par with BSNL. 28-08-2013 Govt to bring parity between pay scales of MTNL, BSNL: The Government has decided to bring parity between the pay scales of employees at Mahanagar Telephone Nigam Ltd with their counterparts in Bharat Sanchar Nigam Ltd. It is for your kind information that CEC  meeting of Delhi Circle is scheduled to be held on 30-08-2013 at 14.00 hrs sharp in room no.756 of Kidwai Bhawan ND. The agenda of discussions is as follows:

1) Elaborate discussion on pension issue at par with BSNL.

2)Organisational matters.

3) Any other point with permission of chair.

It is being reliably learnt from our reliable sources that GoM meeting held today in the evening has approved the Cabinet Note for making Pension Payment to DoT employees absorbed in MTNL by the Government as in the case of BSNL. It is also decided that Cabinet will approve the pension issue within 15 days and within next 30 days the notification will be issued in this regard for the modalities.

GoM also decided to refund the BWA license fee to MTNL within a month.

GoM also decided to implement Short Term/Long Term revival plan for MTNL within next 45 days and 6 months Respectively.
