Meeting with ED DelhiCom. Rajeeb Kumar, GS, Com. A. K. S. Chauhan, Auditor CHQ,  Com. K. R. Yadav, Circle President Delhi, Com. P.C. Saraswat, Sr. Vice-President Delhi, Com. S. P. S. Yadav, CS Delhi, Com. Maninder Sareen, Asst Circle Secretary Delhi met ED Sh. S. P Rai  today  21^stDec 2018 and discussed the agenda already scheduled.

Item No 1). Re-arrangement of man-power in field units.

Association brought to the notice of Executive Director the urgent need to re arrange the man power in field units for proper and smooth functioning of the outdoor units. ED assured to re-deploy the executives according to the requirement in field.

Item No 2.) Shortage of Vehicles in areas due to NGT Orders implementation.

Association informed that there is  acute shortage of vehicles in areas which is hampering the day to day maintenance work of field and other units.

ED informed that  hiring of OLA cabs on regular basis is being taken up with Corporate Office and it can be decided in due course of time.

Item No 3.) Shortage of Copper cable, testing eqpts., Line stores and OFC    testing eqpts. 

Association informed that copper cables of different sizes, TSF kits, CLIP phones are not available with filed units and there was non-availability of Cable fault localiser.(APLAB) and OFC power meter.

ED spoke to GM (MM) in this respect and informed that the status of all requirements will be discussed with areas and will be supplied as per requirement.

Item No 4.) Shortage of batteries of different capacities. 

ED informed that the batteries are being procured and the matter is under progress.

Item No 5.) Completion of APAR of Executive well in time.

Association brought to notice that the APARs of executives are not being filled in time and wrong certificates are being issued by the area GMs.

ED assured that the case will be looked into and if any GM or Sr. Executive giving wrong certificate i.r.o APAR then that case would be dealt strictly.

Item No 6.) Harassment of executives by GMs.

Sh Rajeeb Kumar,  GS, informed ED that few GMs are harassing the executives. They are passing derogatory remark to the executives working under them. This can’t be tolerated  by TEAM.. ED assured to look into the matter seriously.  

 GS Kaushik ji along with Bhai Jagtap hon’ble MLC of Maharashtra and patron & Chairman of UFOM of Delhi & Mumbai arranged a press conference and circulated a note to media on current situation of MTNL.

• Whatever move taken by DOT so far is only in respect of pension revision of BSNL pensioners. The pension revision of MTNL pensioners (combined services) is not taken together in the present move because, as per DOT, MTNL pension is not same as BSNL pension. Because, as per DOT, the full liability of BSNL pension is now borne by DOT where as a part of MTNL pension is the liability of MTNL even though DOT pays the full amount of   This is because, as per DOT, some of the pay scales of MTNL is higher than those in BSNL and the equalization is expected to be done during the currency of 3^rd.PRC. To our points of opposition, it is clarified that DOT wants to avoid any complication at this stage by combining MTNL issue which can be tackled conveniently latter once BSNL issue is “through”

• Till so far, DOT has sent a note to DOP&PW soliciting to know whether it is permissible to consider the issue of pension revision delinking it from the issue of pay revision.

• DOT will consider the next step i.e. fitment aspect of pension revision only after approval of policy proposal of delinking pension revision from pay revision. Even though in the course of discussion our proposal applying the fitment factor of 7^th.CPC was figured, it is apparently clear that the concerned officers of DOT is yet to decide their minds in this respect. They prefer to take a call in this respect only after the issue related to delinking is approved.

MTNL Should Merge With BSNL Based on a Special Purpose Vehicle: MTNL Chairman: The government led debt-ridden telecom operator, Mahanagar Telephone Nigam Limited (MTNL), which operates in Delhi and Mumbai circles has urged the government to package a Special Purpose Vehicle (SPV) so that the Rs 20,000 crore debts and assets including 1,100 towers, lands and buildings are deleveraged to correct the financials of the company. MTNL has also talked to the government about a merger with BSNL so that the telco will be able to expand operations across India on the basis of network utilisation. MTNL chairman and MD, Praveen Kumar Purwar told said in a statement, “In today’s below-cost competition, consolidation of BSNL and MTNL as one entity is the need of the hour and the only way to survive. Fragmented operations can only lead to their extinction.” He said that the government would need to work for MTNL’s sustenance and once the telecom operator’s financials are strong enough then a merger will BSNL can be ideated upon……..An interview of CMD in Telecom Talks…

1. It was intimated by DOT ‘s official that a cabinet memo has already been prepared for approval of cabinet and hopefully 4G license may be given to BSNL.
2. It was accepted to delink the pension revision from pay revision and affordability clause and process separately.
3. on pension contribution as positive recommendation is being sent to Dept. of Expenditure.
4. on 3rd PRC for the employees some more issues are to be sorted out between BSNL and DOT. In the present form , union cabinet may not approve it and hence some more time is required for sorting out this.

It is to inform one and all that massive lunch hour demonstration is scheduled in front of Corporate office on 01.12.2018 to protest stoppage of salary for NOV-2018 for the time being  by Corporate Management.  The  Office-bearers  of TEAM met CMD MTNL on 29.11.2018 to discuss about the instructions issued by MTNL Corporate Office to withhold the payment of salary of the employees for the month of November,2018.

TEAM has expressed deep anguish and frustration at this development and demanded immediate withdrawal of the instructions issued in this respect. CMD has been informed that this will send a wrong message and shock wave among the employees who have been already hard-pressed in maintaining the services in the field  despite severe constrains and odds. This will also send a wrong and frustrating alarm in the market and among the customers who are still loyal to MTNL. Already some news media has flashed  this news.

CMD pleaded his inability stating that there is shortage of fund needed to pay the salary. Despite all efforts, MTNL could not manage to make good the shortfall yet. He explains that DOT is duly aware of this move. DOT was even approached to pay the dues to MTNL which stands around Rupees 180 Crore .But DOT has not paid this. BSNL has due to MTNL about Rupees 400 Crore. BSNL has pleaded its inability to pay this immediately. Thus MTNL is undone. CMD could not assure a firm date by which salary will be released.The worst and most insensitive remark is that disruption in the payment of salary of the employees is not uncommon for loss making  PSUs. He gave example of ITI. CMD has further confirmed information of proposal of VRS to employees is being sent to DOT  for reducing wage bill ; as shared by Dir.HR during discussion with us.

From our side TEAM has told him that the employees are not responsible for revenue loss and financial distress of MTNL Even today MTNL employees working hard to maintain services. Therefore, why should employees only suffer for this ? Corporate Management is spending lavishly on unproductive heads. Fund are being wasted for unviable projects whereas maintenance of network is left high and dry.DOT and MTNL corporate Management are solely responsible for downfall of MTNL.

 CMD Has been unambiguously informed that if salary is not paid on due date, there will be large scale protests in MTNL and for this MTNL and DOT will be held responsible.

 Meeting with Director (HR): The Emergency Meeting regarding Pay Stoppage by MTNL Management, was taken by the TEAM General Secretary Shri Rajeeb Kumar with other Comrades Shri  P.C.Saraswat , Shri  Ramnik Sharma, Shri Ajay Kumar, Shri S.P.S Yadav, Shri  K.R.Yadav and Shri R.K.Chhabra. Dir(HR)was  asked to clarify reasons for stoppage of Pay and certainty about its release.Director (HR) informed that MTNL has not any fund to release the salary at present  and there is a complete uncertainty  for its release .  They all are working to arrange the pay for this Month but the situation of uncertainty like this will continue in future until it is resolved at DOT/Minister Level/Cabinet Level.

TEAM expressed their resentment and informed if the salary of the employees is not released than the Management has to face the agitation of the employees and it is none of the business of the employees   to arrange profit for the company as earning profit or loss depends upon the strategic decisions of the Management/DOT/Government of India. We suggested that there are  large number of Vacant Plots and Real Estate which have not been  properly developed  to create assets and earn revenue through tie up with NBCC . The Land use  conversion at the Management level should not be difficult if pursued properly. We further  asked why management is not curtailing expenses on their luxuries and spending  huge money on non-profitable business as in the case of Convergent Billing Costing  about Rs.500 Crore,3G Mobile project costing Rs.700 Crore . MTNL is not adding to its revenue/income rather customers are still reducing day by day due to lack of strategic vision and intent at the management level.

To this Dir(HR) also informed that MTNL Board is making various  proposals out of which one proposal is for VRS of 20,000 employees to revive the company by reducing wage expenditure.

TEAM has clear cut communicated to Dir. HR that if management fails to release the salary of Nov-2018 in time the we will be compelled to start Protest action programme.

consequent upon the letter issued by CO for not issuing instructions to banks for releasing of salary  for the month of Nov-2018 for the time being; TEAM wrote a letter to CMD MTNL protesting this unjustified step of  management. We have communicated to CMD that employees/executives  are not responsible for the current situation and hence such instructions may be stopped and payment of salary must be  made on time. If management  fails to do so then we will be compelled to start protest actin programme.

MTNLCO/PERS/Deputation/2018/PI File/1988 Dated 01.10.2018 Wherein Delhi and Mumbai units have been asked to give names of 100 Executives and 200 Non Executives from each units , who can be spared and be posted any where in country on deputation. “Please do not be in panic  with the content of this letter. the MTNL /DOT has no power to post us forcibly any where in the country . this is nothing but a fear psychosis per unit and panic among employees of MTNL so that they can runaway/leave the MTNL and can be deprived them from facility of VRS (if any) “.

 Telecom operators propose new e-KYC process as alternative to Aadhaar  :Telecom operators have approached the Department of Telecom (DoT) seeking approval for new e-KYC process as an alternative to Aadhaar-based verification. This follows the Supreme Court order restricting use of Aadhaar information by private companies including telcos and banks. 

“We are proposing minor modifications to the DoT guidelines…allowing consumer application form (CAF) to be embedded with photograph and scanned images thereby digitise the end to end process for on boarding  of new subscribers by making it completely paperless,” the Apex Advisory Council for Telecom in India (ACT) said in a letter to the DoT.  Submit Aadhaar De-Linking Plan Within 15 Days, Telecom Firms Told : Telecom companies have been given 15 days by the Unique Identification Authority of India to give a plan to stop using Aadhaar number for customer authentication. This comes days after the Supreme Court, in a landmark verdict, struck down attempts to make it mandatory for mobile phone connections and several other services.

Service providers like Bharti Airtel, Reliance Jio, Vodafone Idea and others were sent the circular that said, “…all TSPs (telecom service providers) are called upon to immediately take actions in order to comply with the judgement dated 26.09.2018. In this regard, TSPs are hereby directed to submit by 15th October, 2018 an action plan/exit plan to the authority for closure of use of Aadhaar based authentication systems…”……A News from NDTV…

 Government Gives Nod to New Telecom Policy, Eyes Broadband for All: The Union Cabinet on Wednesday approved a new telecom policy – National Digital Communications Policy 2018 – designed to provide “broadband to all,” Union Communications Minister Manoj Sinha announced.

The policy, aimed at providing universal availability of 50Mbps and attracting investments worth $100 billion (about Rs. 7.26 lakh crores), was approved by the Telecom Commission in July after the government came out with a draft policy in May.

Sinha, addressing the media after the cabinet meeting, said that among other targets the policy aims to “provide broadband to all and create 40 lakh jobs.” It also aims at providing a “ubiquitous, resilient, secure and affordable” digital communication services. Further, the policy aims at providing 1Gbps connectivity to all “Gram Panchayats” by 2020 and 10Gbps by 2022. A news from NDTV…..

BSNL सबसे पहले करेगा 5G सेवाओं की शुरुआत, जापानी कंपनियों के साथ किया करार:नई दिल्ली (टेक डेस्क)। भारत संचार निगम लिमिटेड (BSNL) अन्य टेलिकॉम कंपनियों से पहले देश में 5G सेवा लॉन्च कर सकती है। बीएसएनएल ने इसके लिए जापान की दो कंपनियों सॉफ्टबैंक और एनटीटी कम्युनिकेशंस के साथ करार किया है। इस मौके पर बीएसएनएस के प्रबंध निदेशन अनुपम श्रीवास्त्व ने कहा, ‘हमने भारत में 5G सेवाओं की शुरुआत और इंटरनेट ऑफ थिंग्स (IoT) के संबंध में सॉफ्टबैंक और एनटीटी कम्युनिकेशंस के साथ करार किया है। इस समझौते के तहत हम समाधान स्मार्ट शहरों के लिए तलाशेंगे।’

 Government starts selection process for BSNL CMD post :Thegovernment has started selection process for the post of Chairman and Managing Director of state-owned telecom firm BSNL, as present CMD Anupam Shrivastava will superannuate in June next year. 

“PESB has invited names of qualified candidates for the post of CMD, BSNL by 1500 hours on October 22, 2018,” the Department of Telecom said in a note to heads of state-run firms under it.

 We have discussed the various issues related with revival of MTNL i.e proper focus is to be given on maintenance of existing Telecom services in Delhi & Mumbai viz. GSM, BB, FTTH, and Landline services. We also requested him for 5G licenses to MTNL for Delhi and Mumbai instead of 4G. The issue of extending the 5% IDA neutralization for the retirees & to remove the affordability clause for both MTNL & BSNL so as to implement the 3^rd PRC w.ef 1-1-2017 with 15% fitment smoothly was also discussed. We also discussed the issue of one time option for the Pro-rata opttes.

              We have also requested the Member (Services) to make the issue of Pension revision smooth in future by evolving the formula to implement the pension revision for MTNL & BSNL retirees in accordance to the formula of 7^th CPC i.e in future the pension revision is to be delinked from affordability of PRC & the pension revision of MTNL & BSNL retirees in accordance to central pay commission revision formula for the retirees of Central Govt. because the retirees of MTNL & BSNL are also being governed  under CCS Pension Rule 1972.

            The Member (Services) heard us patiently and asked us to submit a written brief about all our issues including One Time Option to the Pro-rata Pensioners. Member (services) has also assured to look into all these issues sympathetically and asked us to meet after three weeks to review the status of all these issues.

 Telecom department chalks out plan to reduce rows with telcos  : The telecom department is drawing up proposals aimed at reducing disputes with operators that have led to as much as Rs 80,000 crore getting stuck in litigation, delaying mergers and acquisitions and deterring overseas investors, said people with knowledge of the matter. The suggestions include unifying levies, settling some cases and being lenient on minor infringements.

 Government approves BSNL’s proposal for 4G services : The Department of Telecommunications (DoT) has approved the state-owned Bharat Sanchar Nigam Limited (BSNL) plan that seeks airwaves in the 2100 Mhz band to launch fourth-generation (4G) services pan-India. 

In 2017, BSNL has submitted a detailed project report and in a bid to acquire spectrum worth about Rs 13,885 crore, and sought Rs 6,652 crore as equity infusion from the government while it initially wanted to meet the remaining cost through revenue it would generate over a period of 10 years.

Meanwhile, the Telecom Commission, a highest telecom policy making body has extended the duration for spectrum payments from 10 to 16 years now, after an inter-ministerial group’s (IMG) recommendation. A new from ET Telecom…

 MTNL surges nearly 18% on buzz of Rs 30,600 cr financial aid by DoT to cut debt: Shares of government-owned telecom operator MTNL (Mahanagar Telephone Nigam) rose nearly 18 percent intraday on Thursday based on a report that informed about Rs 30,600-crore financial aid from Department of Telecommunications (DoT).  News agency NewsRise reported that the amount would be used to cut the firm’s debt and losses, quoting a DoT official.The telecom department’s panel also recommended to offer Rs 2,300 crore worth for VRS (voluntary retirement scheme) to its employees.  BSNL Reports Losses of Rs 4,785 Crore in FY18; Telecom Minister Rejects Merger With MTNL: Bharat Sanchar Nigam Limited (BSNL) has narrowed its losses to Rs 4,785 crore during FY18, even as its income declined to Rs 27,818 crore as against the previous fiscal. Telecom Minister, Manoj Sinha informed this news to Parliament today. BSNL posted a loss of Rs 4,859 crore in 2015-16, Rs 4,786 crore in 2016-17 and Rs 4,785 crore (provisional and unaudited) in 2017-18, Telecom Minister Manoj Sinha said in a written reply to the Lok Sabha.  Trai Lowers the Price of 700 Mhz Band by 43% to Attract Buyers: The Telecom Regulatory Authority of India (Trai), earlier today released its recommendations on the price of 4G and 5G spectrum. Trai recommended a pan-India base price of Rs 492 crore per megahertz for 5G radio waves and lowered the base price of frequencies that remained unsold in the 2016 auctions. The price suggested for 5G spectrum is about a third of the 1800 MHz band in 2012. Known as the 2G spectrum at that time, the government had fixed base price at around Rs 2,800 crore per Mhz on a pan-India basis for paired spectrum (an equal chunk of frequency for uplink and downlink) in the 1800 Mhz band. UF MEETS OSD OF MOS( C ) & DOT OFFICERS

 A delegation of seven of United Forum of MTNL Unions & Associations have met OSD of Minister of State ( C ), Independent Charge in a pre-scheduled meeting today.  We also have had detailed discussions with other officers of DOT including Advisor (Finance) etc.

The discussions are held on the issue of IDA neutralization w.e.f 01/01/2007, the prospect of pay/pension revision and fresh option for Pro-rata pensioners in MTNL etc. Our viewpoints in regard to IDA neutralization reportedly proposed by MTNL have been clarified with supporting   documents. Informed that the below board level executive cadres and their association were not consulted by MTNL before suggesting to DOT the preposterous proposal. MTNL has tried to mislead DOT and Ministry by way of suppressing the relevant facts. We hope, our views will be well taken. 

As regards the issue of Pay/Pension revision , there seems to be no change in DOT’s stand. DOT is expecting to secure waiving of affordability factor on pay /pension revision in BSNL and MTNL’s case will follow. We have pointed out the situation in Public Sector Banks. Min. of Finance (as per United Forum of Public Sector Banks) is not averse to  full pay revision despite dwindling Profit & Loss scenario.  That  IBA insists  for 2%.revision, is a different issue. 

As regards the issue of fresh option for Pro-rata pensioners, the status stand where it was earlier. MTNL is yet to provide the information’s sought for by DOT.

No proposal to merge BSNL and MTNL: Manoj Sinha..Telecom minister Manoj Sinhatoday said there is no proposal to merge state-run telecom companies Bharat Sanchar Nigam (BSNL) and Mahanagar Telephone Nigam (MTNL).
“There is no proposal to merge BSNL and MTNL. We had appointed a consultant to revive MTNL, who has given some recommendations. We are working on it,” the minister said on the sidelines of a conference here.
He, however, did not elaborate on the recommendations of the consultant but reiterated that no merger proposal for the state-run firms is on the cards.
The publicly-listed MTNL serves the national capital and financial capital alone, while the unlisted BSNL serves the rest of the country and also anchors several key projects for the government. A news from Economic Times..

1) Cabinet approves Rs 11,330 crore more for network for defence forces project :The government approved higher budget allocation for laying of alternate communication network for defence services in turn for release of spectrum held by the armed forces, as part of the decisions taken by the Cabinet Committee on Economic Affairs on Wednesday. 

The committee approved enhancement of budget by Rs 11,330 crore for the Network for Spectrum (NFS) project, over and above Rs 13,334 crore already approved by the Cabinet Committee on infrastructure in July 2012. “The NFS project will boost the communication capabilities of the defence forces in major way leading to enhanced national operational preparedness,” the committee said after the approval. 2) Nationwide Deployment of 5G to Require Rs 50 Lakh Crore of Investment: CMD BSNL : There has been a lot of talks regarding the merger of state-run telcos Bharat Sanchar Nigam Limited and Mahanagar Telephone Nigam Limited, but today, Telecom Minister Manoj Sinha has confirmed that there’s no proposal to merge the companies. “There is no proposal to merge BSNL and MTNL. We had appointed a consultant to revive MTNL, who has given some recommendations. We are working on it,” the minister said. Also, after more than four years, MTNL has got a chairman and managing director. P K Purwar has been appointed as the Chairman of MTNL. The post was empty since May 30, 2014. Government to examine proposal to merge CPSEs in key sectors: 

In what could push consolidation of central public sector enterprises (CPSEs), the government will examine a proposal to merge NHPC with NTPC and combine Power Finance Corporation (PFC), Rural Electrification Corporation (REC) and Indian Renewable Energy Development Agency (IREDA) to create a huge power-financing entity.

In a recent presentation to Prime Minister Narendra Modi, the CPSEs have proposed creation of public sector behemoths by merging firms based on commonalities of functions to benefit from economy of scale, global competitiveness and access to cheaper capital.

Among others, the CPSEs have also proposed merger of telecom sector entities Bharat Sanchar Nigam (BSNL), Mahanagar Telephone Nigam (MTNL), Bharat Broadband Network (BBNL) and RailTel Corporation..

 ObituaryWe express deep mourn to the family of Mrs. Laxmi Kumar SDE , who expired yesterday i.e. on 07.05.2018 in the evening due to cardiac arrest. She was just of 57 years old. Delhi MTNL family has lost its 3 brilliant executives within short span of 1 month. We are speechless with teared eyes.

As per information gathered Mrs. Laxmi Kumar   was suffering  from  lung infection  disease for the  last 5  months. She was an expert of OCB S/R and posted as a SDE OCB in NP exchange for  the  last 10  years. Her husband is  retired  as DGM from  KRIBHCO. She  has left  behind a son and  a daughter ,both married  and  well settled.

TEAM stands firmly with the family of Mrs. Laxmi Kumar in this  hour of deep sorrow.  There are no right words; there’s nothing we could say that will make the pain go away. Even then we pray to almighty to provide place to departed soul in his feet and may provide courage to her family to bear this deep sorrow.

2)Govt unveils draft telecom policy: 5G, robotics, AI, 4 million jobs on agenda…The government on Tuesday came out with a new draft for telecom policy which aims to create a roadmap for emerging technologies such as 5G, artificial intelligence, robotics, internet of things, cloud computing and machine to machine communications. The draft which was released by the Department of Telecommunications or DoT has also laid out plans to create 4 million jobs, attract $100 billion foreign investment by 2022.

R.P.Singh working as SDE (Transmission) Rajpath New Delhi left us for his heavenly abode journey in the night of 25.04.2017. He was suffering from heart disease . He was  47 years old approximately.

The constituents of United Forum of MTNL Unions & Associations (Delhi Unit) meet on 24.04.2018 today in R/No. 756, Kidwai  Bhawan today. Shri Mange Ram Sharma presided over the meeting.There were thread bare discussions on the ongoing situation including the resolution of MTNL Board on the issues, e.g., DA neutralization, Prospect of Revision of Pay, Prospect Revision of Pension and other connected matters.

After discussions, it is unanimously *decided to implement the programme of Day Long Hunger Fast & Lunch Hour Demonstration before MTNL Corporate Office on  25/4/2018 with full strength.*

UF ( Mumbai Unit) also held the meeting of their constituents  in tandem at Mumbai.  The similar  decision has been taken there also.

Both UF (Delhi Unit) and UF (Mumbai Unit) have unanimously decided to extend *the Programmes of Trade Union Actions beyond 25/4/2018 in a suitable format if MTNL/DOT continues to ignore the genuine demands and the same is expected to be be notified soon  by the Apex Body of the United Forum (Delhi & Mumbai).*

United Forum is shocked to learn about the sad demise of Manish Kumar, AM in the unit of Area G.M (North), Delhi out of terrible accident of electrocution while laying O/H OF Cable. UF extends its full supports and solidarity  to the movement  launched by the agitating field officers almost spontaneously and their demands in this respect. UF has already addressed a letter to the CMD/MTNL in this respect.

Furthermore it has been demanded that 1) Permanent job must be given to Mrs. Manish Kumar as per her education qualification,2) Financial help as demanded by both Associations must be provided,3) Accommodation of MTNL must be continued and 4) a fair and free inquiry must be conducted and accordingly the accused persons must be booked.

Com. A.K.Kahushik, GS TEAM, met Shri. Purwar, CMD, MTNL yesterday and conveyed our concern over  accidental death of our beloved member Late Shri. Manish Kumar and gave consent to MTNL Management for deduction of Rs.1000 from executives for extending financial assistance to the grieved family of Late Manish Kumar. All executives are requested to give their consent.

 Corporate Offices issued an appeal to all leaders of United Forum of MTNL Delhi and Mumbai for withdrawing the proposed protest action programme. Wherein Administration  stated about poor financial condition of MTNL and a referred that an agreement has already been made with some unions for extending the IDA neutrilization benefit to the tune of 5%. Further more MTNL management explained about decline condition of TELECOM sector overall and therefore the proposed protest action programme may be deferred now.

Thousands of working Employees/Executives and pensioners witnessed a solid protest against  a shameful surrender of so called majority unions and forums of MTNL in Delhi and Mumbai with the Management on 28.03.2018. The working employees and pensioners from all corners of Delhi and Mumbai gathered at Khurshid Lal Bhawan and Prabha Devi Tele. Exchange Building in Delhi and Mumbai respectively during lunch hours on 11.04.2018. 

The gathering of employees was lead by leaders of UFOM Sh. Mange ram Sharma (president UFOM), Sh, Manish Bagchi (convener UFOM), Sh. Suresh Kumar (Secretary UFOM) and Sh.A.K.Kaushik GS TEAM. Various leaders representing different unions and associations were also present to motivate the huge number of participant at K.L.Bhawan New Delhi.

 Whereas the Protest Action was led and addressed by Sh. Bhai Jagtap (Hon’ble MLC Maharashtra) and chairman of apex body of UFOM Delhi and Mumbai. Sh. J.S.Yadav , Sh. R.R.Mishra ,Sh. After a very successful demonstration and motivational speeches of all leaders a delegation led by Sh. We have met Shri Nitiswar Kumar, PS to Hon’ble MOS ( C ) in his office chamber at Sanchar Bhawan at about 7 PM. We handed over the copy of the Memorandum to him with a request to act upon this by way of bringing the issues to the notice of Hon’ble MOS ( C ). We have briefed him about our meeting with Shri Prabhu and Secretary  ( T ). He has assured us to inform Hon’ble MOS ( C ) about these issues and ensure from the side of his office that prompt attention is given to these issues  for solution. Yesterday ( 9/4/2018 ) a delegation of United Forum meets Shri Suresh Prabhu, Hon’ble Minister ( Civil Aviation) in his office at New Delhi, – thanks to the initiative taken by S/Shri Arjun Singh, Anwar Azmi and other Mumbai friends.

We have submitted a Memorandum to Hon’ble Minister  highlighting our issues, e.g., Merger of FULL 50% DA with basic pay effective from 1.1.2007, Waive “affordability “ clause for pay revision and thereby pension revision in MTNL, Providing fresh pension option to the MTNL employees/retires who earlier opted for “Pro-rata pension “ and for those who were not permitted to exercise pension option due to short of qualified length of service etc . and Implementation of  EFO’s order dated 23/03/2017 in letter and spirit for the members of Employees’ Pension Scheme etc. Hon’ble Minister receives the Memorandum, heard us patiently and discussed in brief but item wise.

Hon’ble Minister tried to contact MOS ( C ) over phone immediately but         MOS ( C ) could not be available immediately. So he was kind enough to speak to Secretary (T) and suggested her to meet our delegation and examine the issues. He also spoke to Shri Nitiswar Kumar, PS to MOS ( C ).and suggested him to meet our delegation. Shri Prabhu assured us that he will forward our Memorandum to MOS ( C ) with a DO letter from his side. We thank him for such kind gesture.

Dear Friends,  The so called majority unions and some associations  have sold out the interest of MTNL employees and retirees on the issue of 78.2% IDA neutralisation w.e.f. 1.1.2007.Now these so called majority unions and their associates are spreading the rumours along with management that United forum is going to stay the so called agreement for 73.2% IDA from 1.1.2018.   It is totally wrong and baseless.They  are doing so  to damage the movement of United forum to achieve the demand of 78.2%IDA from 1.1.2007.

Beware of the activities of these   betrayers who have CHEATED the working as well as retired employees of MTNL.

Dear comrades the so called majority Unions of MTNL, both Delhi and Mumbai have signed an agreement with MTNL Corporate Management in favour of implementation of IDA neutralization @ 73.8% as against our demand of 78.2%. They Have further agreed that this truncated IDA neutralization should be implemented w.e.f 1.1.2018 and not wef 01.01.2007. Thus they have compromised on both the accounts i.e, full neutralization as notified by DPE as well as date of effect forcing hues loss of legitimate remunerations and pensions. This loss of neutralization to the extent of 4.4% is a perpetual loss of salary and pension w.e.f 1.1.2007 till one will draw salary or pension during one’s lifetime. This scenario will not change even after implementation of 3rd PRC in MTNL. This is a mindless compromise without reading the minds of the employees and pensioners.

Therefore we are strongly opposed to this kind of agreement which is nothing but sale out of interest of employees and pensioners. We shall implement the agitational programme as already notified by UFOM of Delhi and Mumbai more vigorously and with strong determination. We call upon  all the  employees , executives and pensioners of MTNL of Delhi and Mumbai to come out openly and protest against this necked sale out. Government hopes to bring new telecom policy in next Parliament session :Telecom minister Manoj Sinha has said the new National Telecom Policy (NTP) is almost ready and will be brought in the next session of Parliament after a Cabinet nod and comments from the public. 

Speaking on the sidelines of an industry event Tuesday, Sinha added the recent approval to the telecom relief package — that entails giving more time to companies to pay for the spectrum they bought as well as liberalised spectrum holding caps — from the Cabinet, will ensure that sector continues to grow strongly. 

“The new telecom policy is almost ready, and, this month, we will place it on the Department’s website for public comments. We will bring it in the next session of Parliament,” Sinha said. A new from Economic Times…

Transport Department ties up with government-run MTNL to provide 10 MBPS speed at its facilities; all services to be offered online: 

After months of deliberation and on the brink of bringing all the public services being offered at Regional Transport Offices (RTOs) in Delhi completely online, the so far dismal Internet speed at such facilities will be bumped up to five times their current potential by next week.

The Transport Department, sources claim, has tied up with Mahanagar Telephone Nigam Limited (MTNL) to provide 10 MBPS speed at its offices over the 2 MBPS which they were used to for decades.

Slow Internet speed had emerged as the biggest hurdle for the department’s ambitions to offer all of its services online for the sake of citizens’ convenience and hitting local touts where it hurts the most. A news from The Hindu…

GS TEAM apprised the house with regards to various development taken during court proceedings for the matter of merger of 78.2 IDA w.e.f. 01.01.2007 . 

Thereafter  he explained that  Sh. Bhai Jagtap has been elected as chairman of apex body of UFOM Delhi and Mumbai during his recent visit to Mumbai. His guidance and leadership is very much needed in resolving the pending issues of employees and executives .

President and other leaders of UFOM also addressed the meeting and Bhai Jagtap was welcomed very warmly by presenting him flower bouquet and offering a shawl. Then Bhai Jagtap thanked every one for their affection towards him and accepted the chairmanship of the apex body of UFOM Delhi and Mumbai.

Give 4G spectrum to BSNL, MTNL at the earliest: Parliamentary panel: The Standing Committee of Information Technology has asked government to allocate 4G spectrum to state-run telecom firm BSNL and MTNL at the earliest to help them compete and survive in the market.

“The Committee is of the view that both BSNL and MTNL will lose the data market, if they are not given 4G services soon. To compete and survive in the telecom market, the Committee feels that 4G spectrum should be given to them at the earliest,” the committee, chaired by BJP MP Anurag Singh Thakur, said in its report tabled in Parliament today. DoT announces strategic plan for 7 telecom PSUs, including BSNL, MTNL: The department of telecommunications (DoT) on Thursday unveiled a strategic plan to create synergies among its seven public sector units (PSUs) which includes frameworks to facilitate manpower sharing, utilize vacant land and buildings, boost technology innovation and export promotion and, importantly, settle legal issues and financial claims.

“The world over, telecom sector is moving towards massive consolidation… harnessing synergy is now an imperative not a luxury… our PSUs must come together. Turf issues often come to the fore at the lower level, but at a higher level, I hope (officials at PSUs) can rise above turf issues and leverage each other’s strengths,” telecom secretary Aruna Sundararajan said. • The draft of the letter addressed to the CMD,MTNL and copies to the Secretary (T) etc demanding immediate implementation of Merger of 50% DA as on 01/01/2007 effectively amount to 78.2% as MTNL has already exhausted all excuses to escape.

• Draft a fresh Notice for Protest Actions to press for the long pending demands as well as against the recent anti-employees postures of DOT/MTNL under the guise of reviving MTNL. • After thorough discussions United Forum, Delhi has agreed with the proposal put forward by United Forum, Mumbai for formation of an Apex Entity of the two for better coordinated actions in future.

The case against United Forum of MTNL came up for hearing in Delhi High Court on 19/2/2018. MTNL has now submitted its reply. Now next date of hearing is fixed as 3rd May, 2018.

It is learnt MTNL Board in its meeting on 13/02/2018  has decided to communicate DOT that MTNL is not in a position to extend the benefit of merger of 50% IDA to the MTNL employees from its resources due to severe financial constrains. This is in response to DOT letter dt-8-2-18.

The Suit filed by MTNL against United forum & Others was heard yesterday ie.on 12/2/2018. Sri. A.K. Kaushik GS TEAM appeared as counsel for United Forum. Principle CCA Mumbai attended the court proceeding on behalf of Secretary DoT. Sri. Pawan Gupta Director at o/o DoT was also present.

*During the proceeding DoT Counsel informed that payment of IDA neutralization is the responsibility of MTNL & not the Government. Therefore MTNL should pay 78.2% from  their resources.*

After hearing both sides the suit was disposed off  with orders passed by Honourable Court that if MTNL is not paying 78.2% IDA neutralization,  Unions & Associations can resort to Trade Union Actions.

Government ‘seriously looking’ at revival plan for MTNL: The government is seriously looking at a revival plan for state-owned MTNL, and various steps have been taken to improve the telecom operator’s customer base, Union minister Manoj Sinha said today.
Replying to supplementaries in the Lok Sabha, he said the government is also considering equipping MTNL and BSNL to start providing 4G services.MTNL has taken various steps to improve its network capabilities, quality of services and to increase the market share. 1. DPC for regular promotion to the cadre of SM and DGM as per the time schedule – Director (HR) informed that last year the DPC could not be conducted  due to non-availability of eligible candidates for promotion from SM to DGM.  Next hearing of 206 Court case is  on 14/02/2018.  MTNL is striving to settle the issue by the said date and DPC will be conducted thereafter.

2. Allotment of Quarters – The issue was discussed in detail.  Director(HR) informed that the Report of the Committee set up to study the case is expected soon and based on the report, the case will be settled in favour of MTNL employees/executives.

3. Merger with BSNL – Director(HR) categorically stated that there will not be any merger of BSNL and MTNL  and MTNL  has to survive on its own.
   

4. Revival of MTNL – Director(HR) stated that the Government is ready to allot 4G spectrum and take over the liability of MTNL.  Govt. is also ready to infuse necessary funds for revival of MTNL.  Representatives have been asked by the Director(HR) to work out a plan of action for revival of MTNL and seize the opportunity given by the Government.

5. Shortage of Staff – Director(HR) informed that a decision has been taken to recruit 200 TTAs (100 each for Mumbai and Delhi) and the process will start soon. To the query raised by the representatives, Director(HR) informed that since TTA is a circle cadre, the TTAs recruited in Mumbai will remain in Mumbai only.

6. Issues related to Stenographers – The representatives pointed out that DPC for promotion to the cadre of Stenographers has been conducted and the minutes were sent to Corporate office for approval. However, the approval is pending on the ground that Corporate Office and Delhi Unit is giving executive status to the Stenographers as and when they are promoted to the Grade of E-2 and the stenographers for whom the DPC was conducted are already in E-4.   Director(HR) informed that the case file is moving fast in the Corporate Office and a decision regarding granting executive status  will be taken shortly.
7. First promotion after 4-6 years instead of 5 years to Stenographers, Hindi Officers and AM(Legal) – Director(HR) informed that the case is under active consideration and a decision will be taken soon.

8. Issues relating to Hindi Officers – Director(HR) was convinced with the arguments raised by the representatives and promised to look into the matter favourably.

9. 78.2 DA neutralization – Director(HR) categorically stated that the issue is not under consideration at present. When pointed out that the Board has already decided and forwarded the case to DoT, Director(HR) stated that the Government Directors have stated that if the Government  bears the financial part, 78.2 DA neutralization can be considered.  However, there is no positive indication from the Government.

10. Increment for the training period – Director (HR) informed that it is not possible to consider the period of training for granting increment. However, it has been decided that henceforth whenever new recruitment takes place, instead of granting stipend, they will be placed directly in the pay scales, so that this issue will not come up in future.

        TEAM representatives promised their fullest cooperation for the efforts being made by the Management for the revival of MTNL.

The Conciliation proceeding between MTNL and UFOM came up for hearing before Asst. labour commissioner on 30.01.2018. Sh. S.M.Sawant, Sh.B.R.Pathak, Sh. Mathias and others attended the meeting. MTNL has filed a written statement of ‘Present Status’. However the proceedings could not take place as ALC was no present. Next Proceedings will take place on 22/02/2018.

BSNL stops free Sunday calls on landlines, CalTel for new plan: State-owned telecom company Bharat Sanchar Nigam Ltd (BSNL) will withdraw its free voice calling benefits from landlines on Sundays from February 1. The decision comes soon after the company decided to curb free night calling benefits.”BSNL is going to withdraw the free Sunday calling benefit from February 1. This will happen nationally. Telecom operators oppose TRAI recommendations of new licensees for in-flight services:

The Cellular Operators Association of India has said that existing on ground spectrum licences are sufficient for providing in-flight connectivity.Indian telecom companies have opposed TRAI’s recommendation of creation of a separate licensee category for offering in-flight communication services, according to a report by The Economic Times.The Cellular Operators Association of India (COAI), which represents all major telecom operators in the country, said that existing mobile phone operators are best placed to provide them.The telecom operators’ body, however, welcomed the recommendation to allow internet and mobile services in flights.COAI director general Rajan Mathews said, “We do not support any separate category of in-flight connectivity (IFC) service provider”. During an hour long discussion, we advance our point of views in respect of each of these issues. It is needless to reiterate those things here as they are widely known to all. Rather we mention here under the responds of DOT in this respect so that everyone can understand the prospect of realizing our demands vis-à-vis mind set of MTNL/DOT.

• DOT is not inclined to go ahead straightway with the proposal of MTNL for financial assistance from DOT for implementation of IDA neutralization @ 78.2% w.e.f 1.1.2007. DOT looks towards the committee formed to deal with the demands of MTNL employees to evolve and recommend a suitable package to help revival of MTNL, linking a number of contentious HR issues, e.g., reduction of staff strength implementing VRS etc as well as linking the said IDA neutralization @ 78.2%. If that be the possibly done a case, DOT may consider it at some point. There is no time frame even for this. DOT is visibly uncomfortable with the way the court case in Mumbai High Court is developing. We have clarified that it is MTNL that has filed the case to stop agitation. We are the respondents. It is in its own wisedom  Hon’ble  High Court has dug into the root causes of agitation. None should challenge wisedom of Hon’ble Court.

• • As regards Pay Revision, the response of DOT is candid and clear i.e., pay revision violating of or deviating from the affordability clause is ruled out as for this, cabinet approval is needed. DOT does not see any prospect in such move as of now. Even “0”% revision of pay will increase the amount of pension contributions payable by MTNL considerably and MTNL is not in a position to  take that burden.
  • As regards pension revision, the respond of DOT is somewhat in affirmative but here again the establishment unit of DOT is somewhat confused about the way forward to a solution. Our proposal to find a solution within the frame work of the recommendations of 7^th.CPC  as accepted by the Government for CD pensioners does not appear to have found a favourable nod yet.

• As regards the much publicized issue of merger of MTNL and BSNL, DOT finds a number of road blocks in progressing this issue. DOT feels as follows :

1)BSNL is 100% owned by the Government whereas around 44% share of MTNL is not owned by the Government. SEBI does not permit merger of PSUs with such different status. So to give effect to merger proposal, Government needs to purchase all the shares which are presently out of hand.

2)MTNL’s market loan is around 17000 crores. MTNL’s claim of        having its own unutilized assets of 20000 crores is an “exaggerated” figure.  BSNL’s present liabilities are around 4000 crores. BSNL cannot and should not invite the additional liabilities

3)There exist the thorny differences and disparities in respect of HR issues on both sides, both in respect of DOT recruited employees absorbed and the employees recruited by the respective PSUs subsequently. There are fear of irreconcilable irritations in merging the comparable cadres.
