TEAM wrote letter to MTNL CMD Shri.R.S.P. Sinha on
12.5.2008 requesting him to postpone the last date for
exercising option for the pro-rata pension till such
time clarifications required to take an informed
decision in respect of the pro-rata pension is not made
available. There are gray areas like who will be the
paying authority in either case ? Whether interest on
Leave encashment is applicable ? Whether commutation
benefits are available for pro-rata optee ? whether the
compound interest will be applied on the Gratuity
arrears ? Whether the benefits of DA merger will be
made applicable as per the 6th pay Commission report ?
Whether RPF agrees to accept the pension contribution
wef 01.10.2000 ? and The fate of all those who already
retired ? These are of essence for taking informed
decisions. More over it is reliably learnt that the
Govt of India is actively considering appointing DOT as
pension paying authority for DOT absorbed officers in
MTNL/BSNL. In view of the above it is necessary that
the officers should be given an opportunity to take

of Maharashtra Circle AIBSNLEA held at Nashik on
21/06/2008. Shri. K.P. Kumar CGM (WTP) Mumbai was the
chief guest.Com.A.K. Kasushik emphasized the need for
immediate merger of BSNL and MTNL. Com. Prahlad Rai G.S.
AIBSNLEA mentioned that the issues of merger of BSNL
and MTNL, and Pension issue should be pursued jointly
by Associations of BSNL and MTNL. The Chief guest
Shri.K.P.Kumar CGM (WTP) mentioned in his speech that
everyone in the recently held meeting of Addl.Secretary
DOT were in favour of BSNL and MTNL merger.
GS elaborated on all the HR issues and their present
status. He indicated that the DA merger will take place
in a couple of months. TEAM decided to Pursue The BSNL
–MTNL merger and Pension issue. |

Pro-rata Pension issue " It is understood that
responses/comments from three Ministries including
Finance Ministry is pending to be received by the GOM
for further consideration. Hence TEAM CHQ requested
Dir(HR), MTNL on 11.07.08, when they met to discuss
various issues to extend the due date of 31.07.08. He
has agreed to consider the request. TEAM is giving a

Executives and Non-Executives of MTNL Mumbai formed Sangharsh
Sameeti and are agitating for two major
demands Merger of BSNL & MTNL and Secured Pension for
MTNL employees. Sangharsh Sameeti is organised by Six
Association of Executives and Nine Unions of
Non-Executives. Sangharsh Sameeti will hold massive
demonstration at closing hours (4.30 PM) today, 21st
Oct, 2008 at Telephone House, Prabhadevi, Dadar to draw
the attention of Hon'ble Misinster for Communication
and IT, DOT, BSNL and MTNL. All are requested to
assemble at Prabhadevi to demonstrate our Demand.

Sangharsh Sameeti Flagged off and started marching
forward to realize its goal of merging two entities
BSNL and MTNL so as to strengthen the PAN India
presence of Govt owned Public Sector Undertakings in
the Telecom Services and to ensure Secure Pension to
all MTNL employees by Govt. The Associations of
TEAM, MEA, S/C S/T Welfare Assn, Dr. Ambedkar Exec.
Forum, Personal Staff Assn, Karmachari Front, Sanchar
Union, BTEF, Workers Union, Republic Employees Union
and Canteen Employees Union will march ahead to
materialize the twin agenda in the coming days and see
to it that the PAN India Telecom Service by Govt's PSU
will be the realm. Forces that deny justified dues for
its employees and deny delivery of affordable services
to the citizens of India needs to take a back seat and
allow every citizen of India to enjoy the fruits
instead of allowing Public Wealth to slip in the hands
of mighty few. |

on 18.11.2008 regarding various long pending issues
such as Regular Promotion in STS scale in respect of
all wings. ie., Engg, Fin, Civil and Electrical etc
delay in issue of CAO(Ad-hoc) orders, clarification
regarding 1st promotion after 4 or 5 years in case of
any regular promotion order issued by DOT after
1.10.2000 to the absorbed executives. Fixation of AAO's
pay on absorption on point to point basis as per BSNL
pattern, Withdrawal of looking after orders from Oct,
2004 or Oct, 2005 as the case may be on financial
up-gradation from E-4 to E-5 in Delhi unit, Pension
issue etc. Director (HR) assured to expedite all the
issues on priority. |

CMD, MTNL today at Delhi and discussed issue of
Pay-Scale implementation for executives with 30%
fitment and Pension issue in length. After detailed
discussion, CMD had assured to consider our submission.
CMD was having positive attitude for the implementation
of Pay Scale for executives with 30 % fitment. CMD has
informed that the pension issue is being vigorously
pursued by MTNL Management with the concerned
authorities. We have also shared our association feed
back and efforts for settlement of Pension issue. |

of Cabinet Ministers. We are very much confident that

Congratulations !!! Group of Secretaries had prepared
the Cabinet note for Pension to MTNL Executives at par
with BSNL employees. This note will be placed before
the Cabinet Secretary who in turn will place it for the
approval of Cabinet. We are hopeful that relentless
efforts with which the matter is being pursued by TEAM
will pay off soon. Our leaders are confident that this

General Secretary of TEAM Com. A.K.Kaushik and GS of
MEA Com. V.K. Tomar met Secretary (T) today regarding
pension issue. Secretary (T) informed that the pension
issue is not expected to be taken up in todays' cabinet
meeting and the same will most probably be taken up in
the next cabinet meeting.
In view of this, request for postponing the last date
for submission of pro-rata pension by 28.02.2009 was
made to Dir (HR), MTNL. Office Order extending the date
for submission of option form for Pro-rata Pension
extending up to 30.6.2009 is forwarded to Dir (HR).
File in respect of Revision of Pension for the Retired
employees was cleared by Department of Personal &
Training (DoPT) and Department of Expenditure (DoE) and
forwarded to the Law Ministry for further clearance.
Association is taking all efforts and pursuing the
cases vigorously. |

Amendments to CCS(Pension) Rules, 1972 issued by Govt
of India on the recommendations of 6th Central Pay
Commission shall be applicable to those absorbed
retirees who opted for combined pension. Orders to this
effect was issued by Corporate Office on 17th April,
2009. Payment of 50 % of arrears, allowances and perks
applicable is under consideration of the corporate
office. |

meeting of Joint forum was held on 25th July in Kidwai
Bhawan. Meeting was attended by all office bearers of
MEA & TEAM. Meeting was addressed by both General
Secretaries of MEA & TEAM along with other office
bearers including com S.S.Nanda, Gen Secy Retired
Officers Association & Com Virjesh Upadhyay, Gen Secy
MTNL MS. GS, MEA elaborately described the whole
pension issue and latest development on it. He said
that because of persistent pressure from Joint Forum
and United forum, meeting of committee of secretaries
headed by cabinet secretary on MTNL pension issue has
taken place on 23rd July. He also told that MTNL
management has made a very strong presentation before
the committee, but it is not still so easy to get the
issue settled with the continuous opposition from
Expenditure dept. He along with all speakers stressed
on making the 29th July rally a grand success so that
required pressure can be put on Govt. All officers are
appealed to reach in this rally in full strength along
with their sub ordinate staff. All area Secretaries/
Div Secretaries of both Associations are requested to
make proper arrangement to bring all Executives & Non
Executives to Jantar Mantar at 12 O’clock on 29th
July. |

issues.This shows the adamancy and vindication of the

join en-masse in demonstration
and rally during lunch hour on 05/09/2009 at Jantar
Mantar and memorandum to CMD MTNL Delhi and for
demonstration at Prabhadevi
Telephone House at Mumbai to protest against such
action of management and to protect the convener who is
unlawfully implicated and dragged in the case of a
minor dispute between some executives and the staff at
New Delhi. |

Meeting of joint group of Joint Front representatives
and Management representatives was held on 6/1/10. The
issue of implementation of new pay package with 30%
fitment was discussed. Joint Front maintained its stand
of 30% fitment. Management side representatives
informed that CMD is going to participate in a meeting
in PMO regarding expansion plans of MTNL/BSNL on 6/1/10
and he will also make a presentation regarding MTNL
pension issue in front of Prime Minister and there is a
review meeting on 7/1/10 in DoT. So the issue of
implementation of pay package will further be discussed
in next meeting which expected on 11/1/2010. |

Kaushik along with Com. Ram Gopal, Circle Secretary,
TEAM Delhi Addressed the gatherings at Prabhadevi and
City Telephone Exchanges today. All along we maintained
that 30 % fitment is our right and we will never
compromise even a single penny less than that. No one
can snatch away our rightful dues. He informed that
the file forwarded to Dot for implementation of the 2nd
pay with 30 % fitment will be received back as soon as
the Advisor resumes duty on 22nd Feb, 2010. He thanked
the houses and told that all this could be materialized
only because of your active involvements in the
organized movements. We decide and dedicate for the
causes and never rest until achieving the goals. He
added that we are not leaving any stone unturned and
not engage ourselves in propaganda mechanism. He
informed the house our struggle for Pension will also
be sorted out by March, 2010. He had requested members
to remain patient and watch out the website for any
development and not to rely on the rumor mill.

Joint CEC of TEAM and MEA Mumbai: - Joint CEC of Mumbai
was held on 23-02-2010 at 7th Floor, Conference Hall,
Telephone House at Prabhadevi Mumbai. Joint CEC was
addressed by Com AK Kaushik, Com. Chandra Sekar, Com.
J.S. Yadav, Com VK Tomar, Com Sunil Kumar and Com. R.R.
Mishra. One after the other appraised the house about
the efforts of Joint Forum for getting 30% fitment
orders and how MTNL Management agreed to implement 30%
fitment and thanked all members for the active support
during the struggle. Com. AK Kaushik, GS TEAM apprised
about the pension issue in depth and informed that our
next priority is to get the pension issue resolved to
our satisfaction so that pension will not be a tension
after retirement. He informed the house that Mrs. Anita
Soni, Dir (Fin), MTNL is putting all out effort in
materializing the same. |

Joint Forum of MTNL Executive Association represented
by the GS TEAM and GS MEA alongwith Office Bearers of
both the Association met DOT top Officers -Member
Services, DDG (Establishment), DDG (Security) and DDG (TPF)
on 19th and 20th April 2010 for getting updates on
pay scale revision and pension Issues
and the persuance thereof. Joint Forum put forth
Associations views to Member Services and DDG(Estab)
regarding payment of pension at par with BSNL to the
MTNL retirees. We have also drawn the attention of DoT
Officers towards issues of revision of Pension on the
same lines as is being done by the Govt. for Central
Govt. retired Employees. We also persued vigorously the
issue of immediate approval of pay revision of
Executives with 30% fitment, which has been sent to DoT
by MTNL after due approval. It is being told that ,
this issue is going ahead with positive nod , the file
has been cleared by DDG (Security) & presently lying
with Finance wing of DOT. We met DDG (TPF) in this
regard & requested for early clearance of our case for
which he has assured for the same. |

TEAM Mumbai met Hon'ble Minister of State for
Communication and IT Shri Gurudas Kamat and submitted a
memorandum on Implementation of
Revised pay scales for Executives and Pension on par
with BSNL.

Hon'ble Minister gave a patient hearing and responded
favorably to our request for his intervention in DOT
for fitment approval and with Ministry of Finance for
pension.
Subsequent to the meeting, TEAM, Mumbai had meeting
with CMD and Dir HR and discussed the following
issues:-
1. Fitment and pay revision: - CMD informed us that
MTNL is pursuing vigorously with DOT at all levels for
its approval and its decision is expected early. It is
understood and gathered that the proposal is moving in
the positive direction so for.
2. Pension: - Management has included this item in
their presentation made to-day to the Hon'ble Minister
and highlighted its importance and urgency.

being replied by MTNL/DOT. |

Meeting with Secretary( telecom) shri. P.J.Thomas---
GS, TEAM & GS,MEA along with AGS, MEA & CS, TEAM met
with secretary (Telecom). The pay revision with 30%
fitment and pension issue were discussed in length.
Secretary (T) assured that DOT approval for pay
revision order for executives of MTNL will be issued at
the earliest. Secretary has also assured that pension
issue at par with BSNL will be persued expeditiously. |

Mrs. Anita Soni, Dir (Fin) who had completed her 5
years tenure 3 months back, has now been given
extension upto her retirement in May 2013. GS along
with AGS, OS and PS, Com Arun Dixit met her and
congratulated for her next tenure in MTNL as Dir (Fin).
The issue of pension at par with BSNL and financial
viability of MTNL was discussed in length. She said
that she was trying her level best to see that pension
in MTNL is decided at par with BSNL. She appreciated GS
for his letter to Hon’ble Prime Minister on the subject
of Pension and refund of Spectrum charges of 3G & BWA
and asked him to continue to pursue these two important
issues at all levels. |

CHQ President Shri N.Chandrasekaran had a meeting with
CMD and Dir HR on 24.9.10 at Mumbai after the board
meeting and discussed the issue of pension on par with
BSNL, extension of date for prorata option and
conducting DPCs for regular promotion in all cadres.
CMD and Dir HR informed us that the pension issue was
highlighted by the Management in the COPU (COMMITTEE ON
PUBLIC UNDERTAKINGS)review meeting in which DOT was
also present. Management has assured to extend the date
for prorata till Dec'2010 and to take further necessary
action on conducting DPCs for promotion in all cadres.
Comrades, the issue of pension is gaining momentum and
TEAM is continuously pursuing the issue through all
channels. We will again seek political intervention to
resolve the issue once the CWG are over. Our GS will
highlight this issue to the new Telecom Secretary when
he meet him next week. |

United Forum writes to H'ble Prime Minister on Pension
issue and request for:
(1) Stop
discrimination against MTNL and MTNL’s absorbed
employees, executives and retirees.
(2) Stop
irregular practice of payment of pension and pensionary
benefits of the absorbed employees and executives
(since retired) from the wage and salary heads of MTNL.
Instead DOT should pay the pension and other pensionary
dues as it is done in the case of BSNL. DOT can not
and should not evade its responsibilities to its
employees and officers simply because they have been
pushed to the fold MTN in the name of half-baked
restructuring.
(3) Complete
the absorption process including all sections of
officers for honest and full implementation of Govt.
policy of restructuring scheme immediately or allow us
to get out of this scheme and revert back to DOT set up
so that we also can continue to work with the deemed
deputation status till end.

extent last date for exercising option for Pro-rata
Pension till the issue of payment of pension at
par with BSNL is resolved
by Govt/DOT. MTNL Management has assured that the
option date for the Pro-rata Pension will be further
extended up to 31.12.2010. Hence Association has
decided none of the executive will exercise option for
pro-rata pension. It is the stand of TEAM that no body
will give option for pro-rata pension under any
situation. |

protest action programme to achieve the issues related

Officers.
Protest action programme is as follows:
1. Lunch hour demonstration at Jantar Mantar, New Delhi
on 09-11-2010.

3. Non-co operation w.e.f 18-11-2010 till the
settlement of the issue.

issue---A meeting of UF was held with MTNL management
on 05-01-11 in committee room 12th floor Jeevan Bharti
building. All the affiliate Associations and unions of
UF attended the meeting. From management side, CMD, Dir
(Fin), Dir (HR), GM (HR), Jt GM (HR) & GM (A) Delhi
unit were present in the meeting. CMD briefed that MTNL
management is making all efforts for expediting the
pension issue. He told that MTNL management had many
discussions with concerned DOT officers and provided
all relevant information sought by DOT. He informed
that Hon’ble MOS, C&IT, Shri Sachin Pilot had come to
MTNL corporate office and assured management that he
will make all possible efforts to settle MTNL pension
issue and also asked MTNL management to tell
Unions/Associations not to resort any protest action
which affects the MTNL services. UF expressed its
satisfaction on the persuasion of MTNL management and
requested to further expedite the case with the
involvement of Secretary, DOT. CMD assured that all
efforts will be made to get the issue reached to

16.3.2011:
We, the convener of United Forum, Unions &
Associations, GS TEAM, GS MEA and other office bearers
met Hon'ble Shri Oscar Fernanendes, General Secretary,
AICC on 16.3.11 in New Delhi and appraised him of the
grievances of MTNL absorbed officers and employees in
respect of the discrimination made in MTNL Pension
issue. Shri. Oscar Fernanendes, was kind enough to give
us a Patient hearing of nearly half an hour. He appears
to be aware of the problem. He could also recall that
the formation of corporation was opposed initially by
section of employees out of fear. He also asserted “at
that time we pacified you to accept corporation.
Therefore now we will help in solving your problem”
He also assured of taking up our issue to the President
AICC, Smt Sonia Gandhi. We offered him bouquet of
flowers and our heartfelt thanks. |

Meeting with MOS(C&IT): - Delegation of United Forum
of MTNL Unions and Associations of Delhi and Mumbai
under the leadership of Shri. Bhai Y Jagtap, MLC and
Chairman of United Forum met Hon'ble Shri Gurudas Kamat,
Minister of State for Communication and IT today, the
11th April, 2011 in North block to discuss MTNL Pension
and Revision of Pension issue. Shri. R. Chandrasekar,
Secretary, DoT and Shri. Kuldeep Singh, CMD, MTNL were
also present in the meeting. Shri. Bhai Jagtap,
Chairman and Com. M.K. Bagchi, Convener of United Forum
strongly pleaded the issue and urged in favor of
pension issues and removing the discrimination made
against MTNL Pension issues Vis-a-Vis BSNL.
The issue of Pension and Revision of Pension of MTNL at
Par with BSNL were thoroughly discussed. H'ble Shri. Gurudas
Kamat, MOS(C&IT) effectively intervened and directed
Secretary, DOT to reopen the issue for placing it in
the meeting of Committee of Secretaries. H'ble MOS(C&IT)
ended that he would personally take this issue to H'ble
Ministry of Finance for settlement of the issue.
When the issue of Pension revision at Par with BSNL was
raised by the delegation, the Hon'ble MOS(C&IT) had
immediately intervened and asked Secretary, DOT and CMD
MTNL, why the rules pertaining to revision of pension
in MTNL were not revised along with BSNL. CMD, MTNL
replied that the case is under process.
The meeting last for more than one hour and was
concluded with vote of thanks. |

invitation to discuss pension issue. Mumbai unit was
linked to discussion on video conferencing . Discussion
started with the presentation made by MTNL. Taking a
cue from the conclusion of last meeting of MTNL and DOT
with MOC&T, discussion was centered around whether it
is justified to link the issue of MTNL pension to be
paid by DOT as in BSNL to the variance in the pay
scales in MTNL and BSNL. It is the united opinion of
United Forum, Delhi and United Forum, Mumbai that the
linking of pay scales to the pension will only confuse
the issue. MTNL management is therefore requested to
take up the issue on the basis of assurance of MOC&T

Pranab Mukerjee , FM today in a delegation led by Shri
Prakash Javadekar, MP(RS) to discuss about MTNL pension

arguably put forth the case and handed over the D.O.
letter personally to FM on this issue.
Hon'ble Finance Minister gave a patient hearing and he
was quite receptive . He collected from us other
related documents as the text of the presentation that
MTNL made to Hon,ble MOC&IT. Hon'ble FM assured to
examine this issue and let Shri Javadekar to know the
outcome within a few following days.

Meeting with Addl. Secy(T) and Jt. Secy(T), DoT :GS.
President AIBSNLEA, AGSs of SNEA(I) and CS TEAM (MTNL)
met Addl. Secy(T) & Jt. Secy(T) and expressed our
serious concern against phased repatriation of deputationists
from MTNL/BSNL and discussed the contingency Plan
submitted by United Forum wherein we explained thatMTNL/BSNL are
having sufficient absorbed Group-'A' level executives
i.e. DGMs/GMs/CGMs to man the services and their
growth.
We opposed back door
entry of ITS Officers in MTNL/BSNL and
requested that DoT should implement its repatriation
order in true sense and should not allow back door
entry to ITS in BSNL under different Pension Rule since
many Group-'A' officers have already taken absorption
in MTNL/BSNL with certain Pension Rule. MTNL/BSNL Managements
should entrust the responsibility to their own
executives rather than depending on those who don't
want to shoulder the responsibility by taking
absorption. We pleaded that MTNL/BSNLManagements should
immediately be directed first to fill up the vacant
HAG/SAG/JAG equivalent posts by conducting immediate
DPCs since eligible executives are available. AST/JST
appreciated our concern and assured to apprise Secy(T).
However, they mentioned that we should regularly meet
CMD/Director(HR), BSNL for immediate holding of DPCs |

about the present development arisen out of DOT’s

deteriorating financial condition of MTNL. He invited
suggestions to immediate improve of revenue.

Associations of MTNL (UFOM) was invited by CMD MTNL on
02-07-2012 at corporate office to discuss the various
issues raised . The representatives of all unions and
association participated in the meetings. The issues of
pension payment for MTNL employees by Govt. of India as
in case of BSNL, Pension revision of MTNL retirees
,retired prior to 01-01-2007 and immediate
neutralization of 78.2 % DA w.e.f.01-01-2007 were
discussed in length. During course of discussion the
MTNL management was not coming forward to bring any new
solution to resolve these issues . Therefore UFOM
rejected the submission of MTNL management.
United Forum has reiterated its
stand on all the issues and informed the MTNL
management that our protest action programme will
continue till the settlement of our all issues. The
meeting ended without any result.
It is once again requested to
all you to work hard, for resolving all burning issues
raised by UFOM and make the Protest Action Programme a
grand success. |

Today united Forum of Unions and
Associations of MTNL Mumbai has observed Day Long Mass
Dharna in front of Telephone House, Prabhadevi. The
Dharna was continued from 10 am to 5.30 pm. Thousands
of employees and executives of UFOM participated.
Leaders from all the participant Unions and Association
addressed the gathering. The members were briefed about
the issues and the Protest Action Programme and
requested all members to turn out in mass during
subsequent stages of the agitation. Pension From Govt
is the ultimate aim of this agitation and if we fail to
achieve this now, we will never be able to make it up.
All Members from UFOM, Mumbai reiterated that Pension
is our legitimate right and will continue Our struggle
till we achieve the same.

compromise on any of the issues and there is no
question of accepting BSNL Pay scale. Leaders pointed
out the BSNL pay scale is better that DoT and AAI Scale
is different than that of BSNL. When there is no
question for provision of Pension from Govt for
employees of these PSUs, Why this pay parity issue is
raised for MTNL alone ? We totally disagree with the
logic and will work for the Govt Pension with MTNL Pay
scale. There will not be any compromise on this and we
will fight for our legitimate right of pension from the
Govt on this Pay Scale. While speaking to the Gathering
Shri. Bhai Jagtap assured of his full support for the
cause and will be with us until all issues are settled.

at 8th Floor, Conference Hall, Bandra Telephone
Exchange, Mumbai. Com.J.S.Yadav, CS, TEAM, Mumbai and
Com. G.N. Haragaball, President, TEAM Mumbai also
addressed the house and discussed various arrangement
for the ensuing 3rd CHQ Conference. Com. A.K.Kaushik,
GS, TEAM addressed the members and briefed in details
all points relating to developments in the Pension
front, promotional issues, Viability of MTNL and other
issues. He also clarified Governments stand on the
pension issue and pension fund and clearly spelled out
that the Pension Fund is not a viable options. He
cautioned about the forces that were acting against
pension issues and told that TEAM has resolved to get
pension from Government in line with BSNL pension
scheme. He requested members to remain united and
explained unity is the need of the hour. He further
requested that all UFOM affiliated members are to be
briefed and kept in readiness. |

which is not at all acceptable to

Hon'ble Chief Minister and read out message from Shri.
Prithviraj Chavan, CM, MH Since could not attend the
Open Session due to his official engagements. Both
Shri. Rajendra Gawit and Shri. Mahadev Shelar endorsed
the view of TEAM and said what is happening is not at
all correct and assured us that the Maharashtra Govt
will stand with us and help us resolving the pension
issue in discussion with Centre. Shri. Bhai Jagtab
while delivering his speech assured that he and his
counterparts in Maharastra Government will take all
possible steps to get the issue of Pension from
Government to MTNL employees. Shri. Prahlad Rai, GS,
AIBSNLEA condemned discriminatory attitude of Govt and
assured that BSNL executives are with us in resolving
the pension issue and extended active support at all

towards erstwhile DoT employees retired from MTNL.

Kruparani Killi, Hon MOSC & IT at her residence on
24.11.2012 and held discussions on relieving of ITS
from BSNL & MTNL. Among MOS’s, she is holding the
charge of both PSUs. JF leaders explained in detail the
issue and impact of non resolution of this issue on the
viability of BSNL & MTNL. We explained that the
Managements proposal to continue with the non-optee ITS
on deputation for another 10 years is no way going to
help the revival of BSNL or MTNL and in that case BSNL
& MTNL will collapse within few years. So like the non-optees,
other employees of BSNL & MTNL also should be taken
back to Govt service for their job and pension
security. Hon MOSC&IT had a patient hearing for about
20 minutes and assured that the issue will be further
discussed with Hon MOC&IT, Shri. Kapil Sibbal. JF
leaders submitted a memorandum also. |

further clearance. It is understood that the case will
be sent to internal finance of DOT and thereafter to
the competent authority for the approval to issue
presidential directive. Director(Estt.) mentioned that
regarding pension fund in MTNL the matter is under
consideration of DOT.
We also met concern DOT officers
and enquired about the ITS absorption issue. It is
understood that third meeting of Committee of
Secretaries headed by the Cabinet Secretary and
comprising of Secy(T), Secy(Personnel),
Secy(Expenditure), Secy(Pension and Pensioners Welfare)
and Secy(Legal Affairs) was held in the last week to
clear the cabinet note on ITS absorption issue and the
minutes of the meeting are expected to be issued today
from Cabinet Secretary and thereafter the Committee
recommendations will sent to Cabinet for consideration
& the reply Affidavit will be submitted to Hon'ble High
Court Delhi. DOT is going to pray that Group-'A'
officers presently working on deemed deputation in BSNL/MTNL
may be permitted to continue to work in these
organisations on a temporary and diminishing basis of a
maximum period of 10 years in which they would be able
to build their own cadre of officers through the
process of recruitment and promotions.
We feel that as per Govt.
decision allowing 10 years deputation of ITS in BSNL/MTNL
will continue uncertainty which will adversely affected
the viability of both the PSUs. We strongly oppose such
decision of Govt. |

submitted rejoinder to the submission of MTNL, CO and
DoT during the Conciliation Proceedings held on
22.11.2012 requesting the Conciliation officer to
direct MTNL/DoT to maintain status quo during the
pendency of RLC proceedings. UFOM also mentioned
clearly that if MTNL/DoT continues to go ahead with the
formation of trust during conciliation proceedings, the
United Forum will resort to trade union action as
deemed fit for which the sole responsibility shall lie
with MTNL/DoT. Click

held on 29.1.2013, UFOM Mumbai had decided to hold Gate
meeting in front of Prabhadevi Telephone house on 5th
Feb, 2013 during Lunch hour opposing the move of MTNL/DoT

disregards to the Conciliation proceedings. Further
course of action will be decided in consultation with
United Forum of Delhi. The Gate meeting in front of
Prabhadevi as above should force MTNL/DoT to change its
decision. All members of affiliated Unions and
Associations of United Forum are requested to stand
together and show our solidarity to the struggle for
getting Pension from Govt./DoT and send the message
that MTNL
has no authority to sabotage our right for pension from

meeting in front of Telephone House at Dadar, Mumbai
opposing move of DoT to form Pension Trust for payment
of pension to MTNL retirees. More than 2500 members
attended the Gate meeting. Speakers condemned the move
of DoT in moving towards formation of Single Trust
for all MTNL retirees and decried the cowardice move of
MTNL authorities as against all assurances and
commitments given in and out of parliaments. Shri.
Shirish Parkar, MLA & veteran Leader of Karmachari
Union While addressing the gathering assured his full
support for the cause and said that nothing short of
Government pension is acceptable. United Forum declared
that the further agitational programmes will be

Pension issue and appraised him of our serious concern
regarding stable and secured pension and viability of
MTNL and security of service of employee working in
MTNL. Member (Services) gave us a patient and
sympathetic hearing. He assured that he stoutly stands
in favour of 100% security of pension, family pension
and other pensionary benefits including revision of
pension for MTNL employees and also security of service
of MTNL employees and ofcourse the viability of MTNL. |

realized the Proposed Pension
Trust under Rule 37-A of CCS(Pension) Amendment Rule,
2012 for payment of pension and other pensionary

retirees is not financially viable and may not survive

provision of sovereign guarantee for making it viable.

MTNL 2) Off load the pension liability from MTNL and
this responsibility is to be taken over by DOT as being
done in case of BSNL. The contribution may be taken
from MTNL as per provision of FR 116 only. Dir. (Fin.)
further informed us that this issue will be discussed
in detail in next meeting of GOM.
We are also expecting a call from
CMD to discuss and review the pension issue shortly. |

of GOM constituted for the revival of MTNL/BSNL . We

have communicated to him that for the survival of MTNL
it is immediately required that DOT/Govt. of India has
to immediately take over the responsibility of payment
of pension to the retired DOT employees absorbed in
MTNL and
it must be on the same pattern as in BSNL. The
deputation to Hon'ble MOS was led by Sh.S.K.Kharventhan
(Ex. MP) and member of National Backward commission
along with representatives of United Forum (Sh.
M.K.Bagchi, Sh. A.K.Kaushik, Sh. Mange Ram Sharma & Sh.
Rajeeb kumar). Hon'ble Minister accepted the memorandum

him. The CM assured that he is well aware of the issue
as on an earlier occasion, he was instrumental in
getting the issue reopened after it was dropped. We
requested him to forward our Memorandum to Shri
Narayanaswami, MoS in PMO and also a member of GoM for
MTNL and BSNL Revival. He assured to do the needful. On
this occasion, a cheque for Rs.25,000 from TEAM for

MTNL Pension Issue as discussed and decided in the
meeting of Group of Ministers (GOM) on 01-08-2013
{On the basis of available reports}
The MTNL Pension issue is
reportedly discussed in the meeting of GOM held on
01/08/2013. under the chairmanship of Sh. P.Chidambaram
Hon'ble minister (Finance). The decisions taken in the
meeting are reportedly as follows:
"a) The Pay scale parity between
MTNL employees and BSNL employees will be made in the
next wage commission expected to be in session in 2017
subject to the condition that MTNL employees agree to
such provision.
b) During the intervening period
i.e. till pay scale parity done in 2017 ,the pension of
the absorbed employees in MTNL will be paid by DOT and
the expenditure will be borne both by DOT and MTNL on
the basis of (X+I) formula."
'X= Pension liability of MTNL
employees as if their pay scale is equal to BSNL
employees. This will be borne by DOT.
I= Pension liability accrued on
the basis of present difference of pay between MTNL and
BSNL employees. It will be borne by MTNL.' |

Jagtap is an MLC/ Maharastra State and an eminent trade
union leader in his own right. He is well known in MTNL,
Delhi and Mumbai as a Patron of Team and Chairman of
United Forum of MTNL Unions and Associations, Delhi and
Mumbai. Bhai Jagtap took keen interest in the matter of
MTNL pension issue and played very active leading role
in this struggle of MTNL employees and executives. He
struck a first significant success in pension issue by
way of settling the issue of revision of pension in
MTNL on the pattern of BSNL. He steadfastly took up
this issue with Shri V Kamath, the then Hon’ble
Minister of State (C & IT) in the presence of the then
Secretary/DOT and CMD/MTNL and paves the way clear for
subsequent issue of the necessary orders.
The
struggle of MTNL employees to realize their demand of
pension payable by DOT as in BSNL gets considerable
impetus when Bhai Jagtap took up this matter and led
from the front. Bhai Jagtap contributed significantly
to achieve the present break through that came in the
form of the reported decision of the Group of
Ministers(GoM) under the chairmanship of Shri
P.Chidambaram, Hon’ble Minister(F) that MTNL’s pension
will be paid by DOT. So as to reciprocate, and to
convey gratitude, and our modest way of thankful
acknowledgement, TEAM organized a meeting to felicitate
Bhai Jagtap. The meeting was held on 07/08/2013 in New
Delhi.
Bhai Jagtap
was offered flower bouquet, garlanded in a traditional
manner. A memento of small but beautiful metal statue
of Lord Ganapati was offered to him on behalf of T E A
M. Speakers after speakers spoke profusely in the
praise of this dynamic trade union leader underlining
his contributions in the trade union movements in MTNL
and outside. Among the speakers, the prominent were S/
Shri Mange Ram, President United Forum, Delhi,
M.K.Bagchi, Convener, United Forum Delhi, A.K.Kaushik,
General Secretary, TEAM, V P Bhardwaj, Joint GS/ TEAM,
Ram Gopal, Circle Secretary/TEAM, Delhi Circle and
S.S.Nanda, General Secretary, RTOWA, Delhi etc.
Shri Bhai
Jagtap, in his address, thanked TEAM in particular and
MTNL employees in general to honour him in such way. He
asserted that he came forward to help because he found
the demand of pension as justified and long pending. He
feels happy that he could connect himself with the MTNL
employees and join their successful struggle. Bhai
Jagtap is very candid in his observation about certain
prevalent maladies in MTNL trade union arena. He called
upon all to launch relentless fight against such
maladies. He reiterates his assurance to continue to
help MTNL and its employees.
The meeting ended with

TEAM/Delhi Circle.

Com. A.K.Kaushik, GS, TEAM spoke
to CMD, MTNL and enquired about the Minutes of GoM
meeting held recently on 1st August, 2013. CMD, MTNL
Confirmed receipt of GoM minutes and told that
Corporate Management will call for discussion on the
issue shortly. |

In continuation to yesterdays'
discussion of GS with CMD, MTNL, MTNL Corporate Office
contacted our GS on Telephone for discussion on GoM
Minutes relating to payment of Pension by Govt. of
India/DoT to absorbed DoT employees in MTNL and
signing of agreement thereof. The GS informed Dir(HR)
and Jt.GM(HR) that he is in Mumbai presently. The
Management has requested the GS to be remained in
Mumbai along with the President so that the said issue
could be discussed and agreement can be signed with
Asociation on 26.8.2013 as they are coming to Mumbai on
26.8.2013 for this purpose. |

Today, Dir HR Shri. Sunil Kumar
visited Mumbai to obtain the consent letters, agreeing
to pay scale parity with BSNL from next pay revision
due from 01-01-2017, as per the directives of GoM.
Separate letters from TEAM CHQ and TEAM Mumbai were
handed over to Dir HR. GS, who is on tour to Mumbai and
HQ President signed the consent letter of TEAM CHQ and
CS and CP signed on behalf of TEAM, Mumbai.
Before handing over the consent letter in the format
prepared by the GoM, we raised our apprehensions on the
clause which starts with '”...... In case MTNL decides
to pay pensionery benefits on the basis of pay scales
in MTNL.........”. Shri. Bhai Jagtap, MLC, President of
MTNL Workers Union and Chairman of United Forum of MTNL
Unions and Associations, Delhi led the discussion on
this apprehension.
It was pointed out that MTNL management has chosen to
give letter of appeal only to TEAM, MEA and Majority
Unions of Delhi and Mumbai, even while asking the
letters of consent from all the Unions and
Associations. Dir HR admitted the lapse and after
discussion, it was agreed that the MTNL management will
issue the individual letters of appeal to all the
Associations and Unions by Tomorrow, i.e., 27-08-2013
and this will be coordinated by Com. A.K. Kaushik, GS,
TEAM. Moreover, Dir (HR) informed that any modification
or deviation in the wordings in Consent letter or
conditional acceptance may lead to non acceptance by
GoM. He also informed that MTNL management will honour
the decision of GoM on its liability for the
differential part of pension due to higher pay scales
of MTNL, vis-a-vis BSNL. Thereafter, Dir HR was
requested to brief the members of the United Forum of
Unions and Associations of Mumbai. He agreed and
clarified the queries raised by the members of all the
constituents of United Forum.
After all the issues raised were clarified, Com. A.K.
Kaushik appealed to all the Unions and Associations to
sign and hand over the Consent letter as per the appeal
of MTNL management. Accordingly, the consent letters by
all the constituents were signed and handed over to Dir
HR. Shri. Shirish Parkar, MLA and President of Sanchar
Union of Non Executives was also present at the time
of signing the consent letters. We were successful in
giving the message of unity of the United Forum to the
MTNL management in loud and clear manner.
Subsequently, a brief meeting of United Forum was held,
wherein Com. A.K. Kaushik thanked all the constituents
of United Forum of Mumbai for their contribution in the
struggle for Pension at par with BSNL. He also

After the letter of Consent was given to Dir(HR), TEAM
CEC was held and members were briefed about the facts
concerning the Letter of Consent. GS also thanked TEAM
