is reliablily learnt that CMD has approved the date of
retention of all AO's promoted and transerferred to
Mumbai up to 31-07-2013. The order in this respect is
likely to be issued shortly.The efforts are being made
by association for their stay at Delhi only. The
vacancies arrise after promotion of CAO (regular) shall
be utilized for relief to these transferred AOs. |

financial up gradation of Hindi Officers as per

Leaders of United Forum Of Unions
and Associations of MTNL wrote a letter to CMD
regarding pending problems of 1) MTNL pension
issue for the DOT recruited employees absorbed in MTNL.
2) Inadequate and un satisfactory medical facilities in
MTNL 3) Implementation of fitment formula to benefit
merger of 50% DA effectively amounting to 78.2% as on
01-01-2007. 4) Payment of arrears of pension revision
w.e.f. 01-01-2007 to the eligible pensioners who
retired prior to 01-01-2007.

met with Dir. (Fin.) .He informed us regarding the
discussion held in the meeting of GOM. It was
highlighted in the meeting that for survival of MTNL
mainly two points are to be focused immediately 1)
Return of BWA license fee to MTNL 2) Off load the
pension liability from MTNL and this responsibility is
to be taken over by DOT as being done in case of BSNL.
The contribution may be taken from MTNL as per
provision of FR 116 only. Dir. (Fin.) further informed
us that this issue will be discussed in detail in next
meeting of GOM.
We are
also expecting a call from CMD to discuss and review
the pension issue shortly. |

per decision of CWC, TEAM has formulated a
comprehensive promotion policy for executives. After a
lengthy discussion on the subject and the suggestion
received from many executives we have prepared this
policy for better career growth of each executive of
all streams working in MTNL. Let us hope management

J.S.Yadav,CP Mumbai Sh. G. N. Harakbal met CMD MTNL
on 07-06-2013 and discussed the issues related to HR
and material shortage in the field. We have requested
to CMD to immediately fill up all the vacancies in SDEs/AOs
, DEs/CAOs/Ex. Engg. and DGM. CMD assured to take all
necessary steps to complete the DPC for every cadre. He
also assured that orders for DGM promotion will be
issued shortly. For shortage of materials CMD
assured that this issue will be revised shortly
and management will provide all necessary resources to
field officers for the maintenance of network. CMD
requested that field officers should make all out
efforts to provide fault free services to our esteemed
subscribers.
Thereafter we met Dir.(Finance). Both CMD as well as
Dir. (Finance) informed us about presentation made by
them to be presented before DOT about the revival plan
of MTNL. Secretary Telecom had appreciated the
presentation of MTNL management for the revival of MTNL.
Secy. (T) had responded positively. CMD and Dir. (F)
assured us that management will make all out efforts
with the help of Govt. of India for the revival of MTNL.
CMD and Dir. (F) made appeal to all the employees
forgiving their best so as to take out the MTNL from
the present crises. |

Anita Soni Ex. Dir. (F) and Sh. Kuldeep Singh Ex. Dir
(T) graced the occasion. Our veteran leader Sh.
M.K.Bagchi, Sh. S.S. Nanda GS RTOWA Delhi and Sh. Badri
Pathak GS RTOWA Mumbai were also present to witness
this beautiful evening of farewell.
The
Meeting was presided over by our CHQ President Sh.
N.L.Thangraj. Main Speakers from our side were Sh.A .K.
Kaushik GS, Sh. V. P. Bharadwaj JGS, Sh. R. R. Mishra

the cool and calm attitude of both Ex. Directors and
remembered mile stones of their tenure, GS in his
speech expressed deep gratitude from whole TEAM family
to both the Ex. directors for the excellent work
of Pay revision and pension revision.

their views with regard to the appraisable contribution
of both Ex. Directors during their respective tenures.
Thereafter from management side Smt. Rajni Taneja GM

sentiments for both Ex. Directors and
placed their respective visions for the betterment of
MTNL. CMD MTNL in his speech praised
both Ex. Directors for their excellent contribution and
a visionary attitude for betterment of MTNL. He
stressed for whole hearted contribution from each of
MTNL employees/executives for survival of MTNL. He
enlightened the recent developments with regards to
revival plans .
Next
agenda was to honor our guests of Honor. CHQ president
honored both Ex. Directors with shawls and GS presented
mementos to them. Smt. Anita Soni and Sh. Kuldeep Singh
then addressed the house and kept their views. They
remembered their dignified carrier but with due
humbleness they treated all of their achievements as
part of their duties. They remembered the
co-operation extended by TEAM leadership . Both of them
were honored by huge blow of clapping and standing
ovation by whole house.
Next
session was dedicated for our AGS Sh. Hiramath who was
also retired on 31st May-2013, Many speakers
appreciated the work done by him, his devotion to our
organization and his humbleness in spite of lot of
pressure of social work. GS specially expressed
gratitude for his excellent services rendered in our
organization. CP Delhi SH. K.R.Yadav presented him a
shawl and CS Delhi Sh. Ram Gopal presented him a

Delhi Circle organized a meeting of circle office
bearers and the CHQ office bearers posted in Delhi. All
the office bearers attended the meeting and deliberated
over many pending HR issues and for betterment of
quality of services provided by MTNL. After
a healthy deliberation it was unanimously decided that
the following points must be taken with MTNL management
on priority :
1) Merger of 78.2% IDA as suggested by Pay Commission.
2) Indoor Medical Policy
3)Pension issues at par with BSNL.
4) Shortage of Materials and Testing Equipment.
5) Poor Quality of Voice and accessibility of GSM
signal all around Delhi.

/Division Level meeting for better update of the

with Director Finance MTNL on 18-05-2013 and discussed
the following points:
1)
Regarding the progress of Pension Case at par with BSNL:
Dir. Fin. told
that the case is in positive direction. All the
suggestions as given by Untied Forum for
amendment in constitution of Pension Trust have been
incorporated in the note sent DOT .
2)
Posting of Promoted AOs to Mumbai: We expressed our
deep concern over the issue and demanded that an early
disposal of the issue.
She assured us that the
she is well aware of the problem and is doing her best
for earliest disposal of the issue.

of Cash less Treatment for the needy persons in case of
hospitalization. We received two such cases ; one of Sh.
Z.A. Sidiqui SA to DGM (EM) Central suffering from
severe intestine problem and other of Sh. U.D. Sharma
SDE (MM) at corporate office suffering from bad
condition of Leaver .

The DoT has initiated the move to merge BSNL and MTNL,
in a bid to streamline operations and improve
profitability.
It is observed from media news that
MTNL and BSNL are going to be merged after their
network infrastructure and land assets are spun off
into separate companies. The move, it seems that, we
will have one infrastructure company, one land company
and the third will be the merged telecom services
entity. The report says a Group of Ministers (GoM) will
consider the trifurcation proposal apart from two other
plans to infuse cash in the two companies. Infusing
cash means refunding the fees collected for the
broadband wireless access (BWA) spectrum given in 2008.
It is feared that the strategic move to hive off Land
from MTNL and BSNL, if not perceived in its true sense,
will only weaken the position of these PSUs.

Department of Telecom has reinitiated the move to merge
Bharat Sanchar Nigam Ltd and Mahanagar Telephone Nigam
Ltd, in a bid to streamline operations and improve
profitability.
“Merger of BSNL and MTNL into a national telecom
service company may be considered for strategic and
operational synergies,” stated the DoT note to the EGoM.
This is part of the telecom ministry’s plans to revive
the two telecom companies. The unaudited financial
results for 2012-13 indicates that BSNL would make a
loss of Rs 8,198 crore, while MTNL recorded a loss of
Rs 3,335 crore up to December 31,2012..

It appears that Govt/DoT had realized the Proposed Pension
Trust under Rule 37-A of CCS(Pension) Amendment Rule,
2012 for payment of pension and other pensionary
benefits including family pension to MTNL absorbed
retirees is not financially viable and may not survive
till the last retiree. Govt/DoT is considering
provision of sovereign guarantee for making it viable.

United Forum of MTNL Unions & Associations met Member
(Services), DoT today, 12.4.2013, at short notice at
4.30 pm. We discussed the MTNL Pension issue and appraised
him of our serious concern regarding stable and secured
pension and viability of MTNL and security of service
of employee working in MTNL. Member (Services) gave us
a patient and sympathetic hearing. He assured that he
stoutly stands in favour of 100% security of pension,
family pension and other pensionary benefits including
revision of pension for MTNL employees and also
security of service of MTNL employees and ofcourse the
viability of MTNL. |

following points :-
1) Financial Viability of MTNL:
We quoted many
cases wherein the services of MTNL are being effected
due to lingering on the administrative decisions. which
causes the dissatisfaction among the subscribers and
they are being forced to switch over to other
operators. The case of Laxmi Nagar Cable cut was raised
where more than 2500 subscriber left MTNL just due to
over delaying the restoration of services.
CMD
informed that he is not delaying the decisions as
and when the case will come to him , he will decide it.
2) Long
pending HR issues :
We raised
several points of dissatisfaction which cause
frustration amongst the executives and thereby
decreasing their efficiency.
CMD
informed that he is well aware of the issues . In some
cases work is already in progress and for remaining
cases he will instruct the concerned officers to
expedite the matter for early disposal of our
grievances.
3)
Progress of Pension Case:
We strongly
opposed the move of formation of pension trust and
asked for the current status of amendments
as suggested by United Forum on the issue. We further
informed him that if the case is not being solved to
the best satisfaction of the executives then we will be
forced to go on the path of protest action programme.
CMD
informed us that the we have sent the suggestions as
proposed by United Forum and DOT is examining them.
4)Implementation of merger of 78.2 %IDA :
We demanded that
while implementing 2nd PRC the IDA was not
neutralized fully . It was requested that our demand of
78.2 % IDA merger may be considered .
CMD
explained that financial condition of the company is
not good and hence to full fill this demand at this
time is not feasible. |

discuss the following points as part of the unanimous
resolutions of HR issues of CWC:-
1)
Re-fixation of Seniority :
The cases
of seniority for the affected SDEs in case of Rule-206
and Case of 1966 post (JTOs promoted to SDEs in year
1998) were raised by us. We demanded that the seniority
as per court cases may be re-fixed at earliest so that
the over due promotion can be given to senior SDEs.
It was
informed that the case of 1966 posts has been sent to
legal section for their opinion. Whereas regarding
Rule-206 case, it was informed that the case will be
discussed separately.
2)
Holding of DPC for regular promotions :
We demanded
that DPCs for regular promotions in all cadres
must be hold for the all vacant posts and if not
possible at this stage , review DPCs may be conducted
so that the benefit can be extended to all eligible
executives who are waiting for regular promotions since
long and retiring every month. We informed the around
1000 posts of SDE are lying vacant whereas the
DPC is scheduled for 100 posts only.
GM
informed that in review DPCs only the CNR ( CR not
received) cases will be considered and a review DPC for
AOs will be conducted on priority after finalization of
gradation list of JAOs.
We strongly
opposed to the plea of GM HR regarding review DPC and
suggested that the ruling position in this matter may
be implemented in its letter and spirit.
3)
Finalization of seniority in all cadres :
It was
pointed out that seniority lists of all the disciplines
are not being updated on regular basis , resulting
delay in holding DPC for regular promotion. It was
requested that the same may be updated and notified
regularly so that if any grievance is there that may be
rectified.
GM
informed that work is in progress for updating the
seniority lists. The updated seniority list of JAOs is
likely to be notified very soon.
4)
Increment to DEs/CAOs on their regular promotion
: We raised
this issue many times but the case is not still
finalized. we demanded that as per EPPR-2007 one
increment has to be given on regular promotion after
financial upgradation in the same scale.
GM HR
informed that the case is being examined and will be
finalised on merit.
5)
Restoration of one increment already given to Sr.
SDE/Sr. AO:
These
officers were given one increment in year of 2006 ,
Which was withdrawn later on and recovery was done from
these executives without any ruling position. We
demanded to restore the benefit which was extended to
them.
GM
informed that the case is being examined and shall be
decided as per ruling position.
6)
Providing
Trade Union Facilities:
We demanded
that the trade union facilities may be extended to us
as this is the forum wherein all recognized cadre base
Associations have been merged . The trade union
facilities should be extended to us as being
extended in case of BSNL.
GM asked
us to put up the demand in writing so that the case
shall be decided. |

Meeting was a grant success. Members expressed
confidence and solidarity with TEAM Leadership and
passed following resolutions.
1. Formed
committee to recommend changes in the promotional
policy brought out by management so as to evolve a
Consolidated promotional
policy paving way for an entrant in E2 Grade to reach
E9 Grade during the entire length of service he put
through.
2. Formed
committee to recommend CGHS medical health care scheme
as the Insurance scheme is costing too much expenditure
to MTNL, results in delay in settlement and limits
medical facilities to the needy.
3.
Matter
pertaining to implementation of 78.2 % IDA
neutralization was discussed in length and it was
resolved that this issue to be settled on top priority
as the same will have effect through out the service
period and even affect the pension. After deliberation
it was resolved that TEAM will discuss the same with
affiliated Unions and Association of the United Forum
and issue organizational programme of action.
4. Pursue
with MTNL Management to conduct DPC and fill up all
posts presently held on looking
after/officiating/ad-hoc basis as the absorption
process in Gr A cadre was declared completed.
5. Child
care leave should be implemented.
6.
Arrangement for Bank loans for housing and Car/Scooter
to be implemented as is being done in BSNL.
6.
Restoration of additional increment on regular
promotion in the same grade should be taken up with
management.
7.
Matters pertaining to Grant of NOC for applying outside
job, NOC for foreign tours below 29 days should be
delegated to ED instead of the present practice of
forwarding to Corporate office as the same is causing
inordinate delay.
8. Struck
off from service on Superannuation and vigilance
clearance process should be completed as in DoT regime.
9. All staff rulings along with codifications to be
made available on line.
10.
Clarity in rulings is of paramount importance. In the
absence of clarity executives at various unit take
different interpretation jeopardizing the interest of
members. Rulings and Procedures are to be clearly spelt
out.
10. There
were communications delay between Corporate office and
field units. Corporate office to upload all
instructions/rulings/procedures in the intranet and
make it available to the field units.
11. Case
of Personal Staff and Hindi Officers should be looked
in to and their career prospects to assured.
12. TEAM
Organizational matters:
a.
Meetings in the Branches are to be organized once in
three months.
b.
Branches should be allowed to keep back 20% of
subscription for running day to day activities.
b. 4 New
office bearers were inducted in CHQ for improving
organizational effectiveness. Com. M. Kukreti from
Delhi unit, Com. A.N.Upadyay and Com. N.Balasubramani
from Mumbai were inducted as AGS while Com. A.K.Kapoor
was nominated as Organizing Secretary.
c.
Decided to hold next CWC meeting in the second week of
November, 2013 at Mumbai. Host Circle has to make
necessary arrangements.

Meeting of TEAM from 4th to 6th April, 2013 was
inaugurated at 1530 pm today in Room No.756, Kidwai
Bhavan, New Delhi. Veteran leaders Com. M.K.Bagchi,
Com. R.A.Rajapure, Com. Nanda, Com. Mangeram Sharma,
President, MTNL Staff Union, Delhi attended the
inaugural session among others. Com. Bagchi while
delivering his inaugural address briefed about the
status of pension issue, issues surrounding pay
fixation with 78.2 % and importance of health care.
Com. Mange Ram briefed the status of court cases filed
by him regarding Medical Insurance. Com. N.L.Thangaraj,
President, TEAM high lighted various other HR issues on
the agenda which will be taken up for discussion one
after the other. Com. A.K. Kaushik, GS, TEAM during
deliberations emphasized the importance of these issues
and suggested that separate committees to be setup to
study issues pertaining to comprehensive promotion
policy and medical health care. After deliberations
committees were formed for recommending changes desired
in the promotional policies and provision of CGHS
health scheme for employees. Matter pertaining to
implementation of 78.2 % IDA neutralization was
discussed in length and it was resolved that this issue

petition 1803/2013 filed jointly praying for quashing
the order of DoT dated 11.3.2013 to deploy unabsorbed
ITS to BSNL came up for hearing today in the Hon'ble
Delhi HC. Hon'ble HC while mentioning the order of DoT
dated 11.3.2013 is a clear infringement of the judgment
of the Hon'ble HC in WP 22515/2005 and CM 16683/2013
(Application filed by AIBSNLEA, SNEA(I) and BSNLEU),
however advised the applicants to move applications
seeking similar relief at appropriate forum. Hon'ble
bench during the course of argument observed that
passing any order in the instant writ petition might
prejudice contempt proceedings already initiated by the
Hon Delhi High Court. |

Ram Gopal CS Delhi met with Executive Director on
18-03-2013 at 17.00 Hrs in his chamber to discuss
the following issues:-
1) The status of
faulty cables of TY area since long: The association
conveyed its anger over the undue delay in handling the
situation arisen by cutting of UG cables and thereafter
handling the issue with casual attitude. This has
resulted in direct huge revenue loss and surrender of
thousands of subscribers.
ED expressed his
deep concern over the issue and informed that decision
has already been taken to get repair the UG cables
on priority. He further informed that patrolling on the
routes are being done on regular basis and some
cable theft cases are being reported and booked
through our vigilant staff.
2) Shortage of
Material:- Association explained that inspite of
earlier assurances given by ED the material is not
being supplied as per demand. Which has resulted delay
in attending the pending faults and installation of new
OBs.
ED explained that
now situation has improved , Drop wire is likely to be
distributed very soon. Caller ID instruments are being
given in place of normal PBT and cable kits are also
being made available.
3) Vigilance
Clarence for regular DPC:- Association pointed out
about the despite the clear cut guidelines from CVC and
order issued by corporate office appropriate Vigilance
clearance are not being given by the vigilance section.
Some genuine cases are being punished and denied
promotions due to negative attitude of the
concerned officers.
ED immediately
contacted GM(Vig.) over phone and asked about the
subject. He instructed GM( Vig) that Keeping in
view of the guideline given by Corporate office the
clear Vig. clearance ( granted /not granted) may be
issued to avoid any frustration to executives in
future. Past cases if any can be taken up again
on the basis of representation of the individuals.
4) Holding of DPCs:-Association
demanded that pending regular DPCs may be speed
up and screening report may be sent to Corporate
office for DPCs of DGM(T) /DGM(F) , CAO/DE,SDE .
It was also demanded to promote on local arrangement
basis against the vacant posts in each cadre.
ED explained that
DPC are being initiated for regular posts. In some
cases for promotion order for LA already issued
have not been implemented . We have instructed
the areas to relieve the officers as per orders on
priority. Further promotion shall be considered on need
basis in all streams/ cadres.
5) Request transfer
cases: association demanded that some individual
request transfer cases are pending at HQ and the same
may be issued at earliest.
ED assured that all
such cases shall be viewed sympathetically and orders
will be issued. But the cases pertaining to WS unit
will be settled by WS unit only. |

Our case in Hon'ble CAT Delhi to set aside new 'Senior
Manager Recruitment Rule-2008' came for hearing on
04-03-2013.DOT counsel as respondent no.1 could not
attend the court who was supposed to file the reply for
the reason that 'why MTNL has violated the terms &
condition circulated by DOT' .
Our advocate filed the rejoinder today
against the counter reply filed by MTNL as respondent
no.2. Our advocate also pleaded that many dates have
been provided to DOT for filing reply and requested
Hon'ble court for not to give any further date for the
purpose. Hon'ble court passed a remark that one last
opportunity is being given to DOT and thereafter the
opportunity shall be sized for filing their reply.
Hon'ble court has fixed 8rth April 2013 as next date of
hearing. Our advocate pleaded to extend the relief
given earlier in this matter and same was accepted by
Hon'ble court. |

ITS REPATRIATION ISSUE
Hon'ble High Court Delhi today dismissed DoT
review application on ITS repatriation case. DOT filed
review application to Hon'ble High Court Delhi praying
that DoT is implementing Hon'ble
High Court judgment dated 15.02.2013 for
repatriation of ITS officers from BSNL/MTNL immediately
& as per the decision of Union Cabinet ITS officers
will further be sent on deemed deputation to BSNL/MTNL
for the next 10 years and during these 10 years period,
BSNL/MTNL will create their Management at higher level.
PRAYER Of DOT :
a) The
Hon Court may take cognizance of the course of action
proposed in para 12 above pursuant to the decision of
the Cabinet and this Hon’ble Court’s orders dated
17.04.2012, 01.10.2012 and 18.12.2012 and pass orders
clarifying, if necessary, the order dated 15.02.2013.
b) Pass
any order or further orders it deems necessary ----.
Hon'ble High Court Delhi at first instance itself
dismissed the DOT review application & directed to
implement Court order in its true spirit. |

UFOM Mumbai wrote letter to CMD, MTNL and Secretary,
DoT to express
Protest against the move of DoT/MTNL to form Pension
Fund in the form of a single Trust for payment of
pensionary benefits including Pension/Family Pension to
all categories of MTNL absorbees by bringing suitable
amendment in Rule 37-A. It also expressed clearly, if
DoT/MTNL continues to go ahead with the formation of
pension trust during conciliation proceedings, the
United Forum of Unions and Associations in MTNL Mumbai
will resort to trade union action as deemed fit for
which the sole responsibility will lie solely on DoT/MTNL.
UFOM Mumbai states that in case MTNL/DoT goes further
with the formation of Pension Trust, this letter may be
treated as notice for the same.

Today a meeting of leaders of United Forum of
unions and associations of MTNL was held with Dy.CLC
at New Delhi. As per representatives of MTNL ,
the suggestion as submitted by United Front have been
sent to DOT for their consideration and any
response. They further explained that this procedure
may take two months times. The representatives of
United front requested that management for
making efforts for early action by DOT.
Next date will be fixed after hearing from parties.

TEAM Delhi has organized Divisional level meeting at
Okhla on 21-02-2013 and at Rajouri Garden on 22-02-2013
. The each meeting was attended by huge number of
executives. The CHQ leadership and circle Team are
making their whole hearted efforts for enlightening
all executives on pending issues. The matter of
trust formation , its viability , the financial
position of MTNL and the maintenance of network
of MTNL are the main points of agenda. Sh.
A.K.Kaushik GS is participating in all most all
meetings in spite of his illness just to make
understand the seriousness of the pension issue
to each of us. |

It is reliably learnt that Cabinet has approved note of
DOT on ITS absorption. The main points are as follows:
(a) The
absorption process of Group-'A' Officers in MTNL/BSNL
will end henceforth.
(b) The
Group-'A' & 'B' level Officers absorbed in MTNL/BSNL,
their seniority is de-linked with the Group-'A'
officers on deemed deputation to MTNL/BSNL.
(c) The
Group-'A' & 'B' level executives of MTNL/BSNL will get
promotion against STS/JAG/SAG/HAG level posts on
priority. The 941 ITS Officers in BSNL and 83 ITS
Officers in MTNL will be posted against remaining
vacant JAG/SAG/HAG level posts.
(d) The
deemed deputation of 941 ITS Officers in BSNL and 83
ITS Officers in MTNL is allowed to continue for the
next 10 years. About 40 ITS Officers from lower grade
(i.e. JAG) will be relieved every year progressively.
(Similarly 10-15 ITS officers in SAG/HAG grade will
retire every year). In this manner, in the next 10
years all the ITS Officers on deemed deputation in MTNL/BSNL
will be repatriated to DoT.
(e) The
ITS Officers cadre will be restructured in DoT shortly
and presently 463 ITS officers will be accommodated in
DoT and against these 463 posts of JAG/SAG/HAG, the ITS
officers will get their promotion till the time cadre
is restructured in DoT.
(f) During
the period of 10 years, MTNL/BSNL Managements have to
ensure to create their own top level Management so that
40 ITS Officers are relieved progressively on every
year basis. |

A.K.Kapoor Sr. member met with Jt. General
Manager HR on 20-02-2013 to discuss the following
points :-
1)
Actual Vacancy position
of various streams prior to holding of DPC for regular
promotion as notified by Corporate office:
We raised the issue of
actual vacancy position available in various
cadres /streams for conducting DPCs for regular promotion against the
vacancy position as notified by corporate office. We
explained that more number of vacancies are available
and demanded that all the eligible executives be
considered for regular promotions against the available
posts at the time of conducting DPCs instead of number
of posts notified by Corporate office.
Further more we demanded that if DPCs are not being
conducted for all the available posts then the review
DPCs may be conducted and date of effect of the
promotion shall be considered retrospectively for the
executives.

GM HR appreciated the efforts of association for making
available the valuable data to administration and
assured that the point raised by association shall be
kept in view at the time of such DPCs.
2) Revision of Seniority
list of SDEs (case of 1966 posts): The matter was discussed
in detail by association. We expressed our
concern over the issue as the affected SDEs are waiting
for next promotion and due to un necessary delay
in this respect they may not get due justice in time.

GM explained the work done on this issue and told that
GM(HR) corporate office has raised two points , which
are to be answered form Mumbai and Delhi units . There
after the progress of work shall begin. He also
requested the association for pursuing the same at both
end so that the matter shall be expedite.

3. Promotion case of
Stenographers:
The matter was
explained in detail that this case is pending since
long and now executives are being retired regularly
without getting their promotion.

UFOM Mumbai members attended the Conciliation
proceedings held by CL(C ) on 21.2.2013. MTNL
management attended the meeting. No DoT representative
was present in the meeting. UFOM Members expressed
their anger on the move of MTNL/DoT in going ahead with
formation of pension trust and Rejoinder filed on
21.1.2013 is having all factors justifying pension
directly by Government and struck to the demand. MTNL
management acknowledged receipt of rejoinder and
requested three weeks time to reply on the same. Next

Another Black Day
Although it is always quit shame full and being condemn
by all working employees /Executives of MTNL, but there
is yet another incident of man handling by C& D Staff
of MTNL with an Executive of north area. As informed by
our Area Secy. Sh. A.K.S. Chauhan , More than 5
office bearers of MTNL Mazdoor Sangh came to office of
Sh. S.K.Bhalla DE O/D Sec-3 Rohini to
discuss some transfer problem of staff. During
conversation they abused and had hot talks . Then
suddenly they all started man handling with Sh. S.K.
Bhalla and injured him.
Sh.
A.K.S.Chauhan A/S immediately after getting this
information rushed to the site and took safe
guard to avoid further worsen of the matter. We
lodged the complaints with GM( North) and got
suspension of five alleged officials. Thereafter we
lodged police complaint at nearest police station too.
Be
rest assure the TEAM will not leave any case of
such kind and will make all efforts to get punish the
culprits and to restore the honor and prestige of the
executives. |

1. The grievance of the

per the decision dated April 17, 2012 would be
positively complied with.

Hon'ble High Court Delhi dismissed the application
of respondents i.e. DOT/BSNL/MTNL for extension of
time for repatriation of ITS Officers from MTNL &/BSNL.
High court further directed MTNL/BSNL to implement the
earlier judgment within 6 week of time. |

of TEAM Delhi held on 13-02-2013 in room no. of 756 of
Kidwai Bhawan ND.
The members from every corner of Delhi participated in
the meeting and discussed the agenda as already
notified. The Discussion was initially focused on
shortage of materials in areas. which was discussed
with ED Delhi just one day prior to this meeting. But
area representatives was not of satisfactory tone with
regards to availability of materials. Whereas the
version of ED Delhi was like that as if there is no
shortage of materials. Therefore leadership decided to
go to Div. Level body meetings and to get finalize
figure of short materials so that actual picture of
shortage of material may be brought to notice of top
level management.
Thereafter the matter of Pension at par with BSNL was
discussed in depth. Hon'ble Sh. M.K.Bagchi also
addressed the house and briefed about latest
development in this issue. Sh. Ram Gopal CS and Sh.
V.P.Bhardwaj JGS Addressed the house and briefed them
about latest meetings with ED and GM(HR). Sh.
A.K.Kaushik General Secy. Addressed the house and
explained each merits and consequences of this issue.
He asked members to be ready for final battle against
this injustice of DOT and advised to hold Div. Level
body meeting for explaining our commitments for
resolving this problem. Meeting was ended with vote of

met with GM HR on 12-02-2013 to discuss the following
points
1)Finalaization of
Gradation lists of various cadres: It
was pointed out that Gradation list of JAOs has not
been updated since 2005 resulting in delay in holding
of DPC for regular AO. Similarly the gradation list of
other streams were also not updated since long .It was
requested to update the same on priority.
GM HR assured that the work is already in progress and
she will watch it personally to make the process fast.
2)Non Drawl of increment
on regular promotion of Sr. AO/Sr. SDE promoted in
2006: It
was pointed out that at the time of regular promotion
given to Sr. AOs/Sr. SDEs in 2006 one increment was
given to these officers and the same was withdrawn
while implementing EPP-2007 without any instructions
from Corporate office. whereas as per EPP2007 one
increment was to be given on regular promotion.
Therefore it was requested that the affected cases may
be reviewed and the increment may be restored as
earlier.
It was assured by GM HR that the cases will be seen and
the matter shall be decided on merit.
3)Non Drawl of increment
on regular promotion of CAO/ DE promoted in 2011: It
was pointed out that at the time of regular promotion
given to CAO/DE in 2011 one increment was to be given
to these officers . The Executives were promoted under
Sr. Manager Recruitment Rule ,2008 and they were denied
the benefit of this increment as per clause Sr.
Management Services Promotion Policy, 2010 .
It was assured by GM HR that the cases will be seen and
the matter shall be examined and will be decided.
4) Up gradation of 19
Posts of CAOs.: It
was pointed out that out of 24 posts of CAOs downgraded
in 2006 ,five post have been upgraded and the rest 19
posts are yet to be upgraded.
GM HR informed that the vacancy position circulated in
July 2012 shall be kept in view while upgrading these
posts.
5) Holding of DPC for
less number of posts: It
was pointed out that the letter circulated by corporate
office regarding holding of DPCs for regular promotion
in various cadres contains few number of posts whereas
the available number of vacant posts are more.
We demanded that
the number of posts for regular promotion may be
compiled prior to holding of DPCs in consultation with
our association.
GM HR instructed Joint GM HR for reconciling the
vacancy position with our association.
6)Refixation of
Seniority of TES Gr. B officers promoted in 1998 ( the
case of 1966 posts):It was
once again brought to her notice that the case is being
delayed and the senior officers getting frustrated as
ED office have no other guideline for further promotion
except the seniority list of 2009 which has many
discrepancies. The case has to be looked up on
priority basis.
GM HR told that some
work is going on the subject and she has further
instructed Jt GM (HR) to expedite the case.
7)Undue Delay in holding
of regular DPC of AOs.(2011): It
was pointed out that CRs were called in 2011but the DPC
is still pending.
GM HR told that screening report of Mumbai Unit is
still awaited along with CR up to 2012. She assured
that as soon as the screening report comes to corporate
office the process shall be completed .
8) Holding of DPC for
Hindi Officers: We
demanded that the DPC for Hindi officers must be done
on priority.
GM HR informed that letter will be issued for calling
of CR for holding DPC very soon.
9) Problem of Buffer
amount for Indoor Medical Treatment: we
pointed out that the payment of 1,60000/- only is being
done whereas many executives have already spent money
to the tune of 5 to 6 lacs on their treatment due to
lack of floater amount.
GM HR informed that now position of releasing buffer
amount has improved and if there is any case that may
be brought to the notice of management.

Gate meeting in front of Telephone House at Dadar,
Mumbai opposing move of DoT to form Pension Trust for
payment of pension to MTNL retirees. More than 2500
members attended the Gate meeting. Speakers condemned
the move of DoT in moving towards formation of Single
Trust |

for all MTNL
retirees and decried the cowardice
move of MTNL authorities as against all
assurances and commitments given in and out of
parliaments. Shri. Shirish Parkar, MLA & veteran Leader of
Karmachari Union While addressing the gathering assured
his full support for the cause and said that nothing
short of Government pension is acceptable. United Forum
declared that the further agitational programmes will
be communicated in consultation with our counterparts
at Delhi who are expected to meet shortly. |

submitted rejoinder to the submission of MTNL, CO and
DoT during the Conciliation Proceedings held on
22.11.2012 requesting the Conciliation officer to
direct MTNL/DoT to maintain status quo during the
pendency of RLC proceedings. UFOM also mentioned
clearly that if MTNL/DoT continues to go ahead with the
formation of trust during conciliation proceedings, the
United Forum will resort to trade union action as
deemed fit for which the sole responsibility shall lie
with MTNL/DoT.

During the meeting
of the UFOM held on 29.1.2013, UFOM Mumbai had decided
to hold Gate meeting in front of Prabhadevi Telephone
house on 5th Feb, 2013 during Lunch hour opposing the
move of MTNL/DoT to form the Pension Trust in utter
violation and disregards to the Conciliation
proceedings. Further course of action will be decided
in consultation with United Forum of Delhi. The Gate
meeting in front of Prabhadevi as above should force
MTNL/DoT to change its decision. All members of
affiliated Unions and Associations of United Forum are
requested to stand together and show our solidarity to
the struggle for getting Pension from Govt./DoT and
send the message that MTNL has no authority to sabotage
our right for pension from Government.

Today a meeting of leaders of Joint Forum of
unions and associations of MTNL &BSNL was held with CLC
at New Delhi. The issue of pension for MTNL employees
and executives at par with BSNL was discussed
exclusively. MTNL could not come with full preparation
and hence seeked some more time for the discussion.
However this issue
was elaborated by representatives of Joint forum in
detail and a brief note was delivered to CLC for kind
reference. Next date of meeting is 28-02-2013.

with GM ( Admn.) on 24-01-2013 and discussed the
following points.
1)DPC
calendar:
This point was raised
once again
for issuing a
DPC calendar for each cadre in each year. We stressed
upon the administration to take initiative for the
same.
After a successful deliberation on this issue GM(A)
aggreed to the point and assured to issue the
DPC calendar

very soon.

Completion of pending CR: It
was
pointed
out that CR folders of number of executives in various
units have not been completed by those ITS officers who
were repatriated to DOT. GM (A) asked to provide
the detailed name of executives, name of unit concerned
and the name of the repatriated ITS officers.

assured that matter will be taken up seriously with DOT
administration
.

3)Look
after arrangements by area GMs: It was
pointed out that area GMs are providing look after
arrangements in technical disciplines by completely
avoiding seniority. This makes frustration among senior
executive and discomfort to junior executive as well.

this regard.

of AO regular: Association pointed out that few
numbers of posts of AO regular will remain vacant when
AO regular will be promoted to CAO.

5)Affidavit
in case of OPD treatment: It
was brought to his
kind notice that at the time of preparing OPD card

medical treatment. This has to be abolished.

clarified
that provisions of Affidavit is only for newly
recruited employees whose family detailed is not
complete with the administration at this stage.
However to avoid any confusion clear
cut instruction in this matter will be issued very soon.

6)Canteen:
Last month rates of various items including tea as well
have been revised by the canteen at KL Bhawan building.
But the quality of item has been deteriorated.

09.01.2013 The
Leaders of Joint forum of BSNL & MTNL Union and
Associations met with Additional Secy. DOT to discuss
the issues pending for both PSUs. The discussion was
focused on the following issues
(a)
Delay in implementation of DPE OM dated 2nd April,2009
on 78.2% IDA pay fixation case: We
expressed our serious concern against delay in issuance
of Presidential Directives from DOT on 78.2% IDA pay
fixation for BSNL employees as recommended by BSNL
Board. AST mentioned that matter is in progress and
assured an early decision.
(b) Refund of
BWA Spectrum charges to BSNL/MTNL: AST
informed that matter is in active consideration of
Govt. However, Rs. 1500 Crores payment in lieu of Rural
Service being provided by BSNL has been ordered.
(c) 4.4%
Additional 2G Spectrum charges from BSNL/MTNL: We
requested that 4.4% additional charges of 2G Spectrum
from BSNL/MTNL should be exempted as incumbent service
providers and their present poor financial condition.
AST mentioned that Ministry is preparing a Cabinet Note
on this issue to provide relief to BSNL/MTNL shortly.
(d) Payment of
Pension to MTNL employees from Govt. fund as the case
of BSNL: We
requested that MTNL employees should also be paid
pension under Rule-37A from Govt. fund as being paid to
BSNL employees. AST mentioned that Govt. has taken a
decision to form a Pension Trust in MTNL shortly. Jt.
Forum opposed against formation of Trust as such it
will not be viable. AST noted the feelings of MTNL

Non-filling up of the vacant DGMs/DEs/SDEs posts in
BSNL: We
expressed our serious concern against non-filling up of
vacant 600 DGM posts, 3000 DEs posts and about 3000
SDEs posts in BSNL on the pretext of Court cases,
whereas there is no stay order pending against holding
of CPCs. AST mentioned that DOT has already asked BSNL
Management to put up the matter in the next BSNLBoard
Meeting.
(f) Posting of
absorbed Grp-'A' executives in BSNL's / MTNL's HR
functions: We
requested for posting of absorbed Group -'A' level
executives in BSNL's/MTNL's HR functional posts to
safeguard the interest of their employees etc. |

BSNL and MTNL unions and Associations met the
Additional Secretary, DoT and discussed issues
connected with the viability of BSNL and MTNL, as well
as important issues connected with the employees of
BSNL and MTNL. It included immediate payment of Rs.1500
crore compensation to BSNL from USO fund, exemption of
BSNL and MTNL from the one time payment for the
additional 2G spectrum, enhancement of minimum pension
from Rs.3500 to Rs.3880, settlement of pension anomaly,
payment of Govt. pension to MTNL employees, etc. |

Condolence: Veteran
Trade Union leader Shri. O.P. Gupta passed away
on 6.1.2013. His body was cremated today.
TEAM deeply bereaved
over demise of Com. O.P. Gupta,
former Secretary General of NFTE and leader of the P&T
Trade Union movement, who passed away on 6th
January,2013.
On behalf of TEAM, Com. Bagchi, Founder General
Secretary and Com. V.P. Bhardwaj, Joint General
Secretary attended the Funeral
at 12.00 Noon on 07-01-2013.

efforts of TEAM demanding regular promotions to DGM's,
MTNL management called CR Screening Report and
Vigilance Clearance for promotion to the Grade of
DGM(Telecom/Finance/Civil /Electrical) on adhoc basis
with relaxed service conditions.
This is due to the result of various meetings TEAM had
with MTNL Management and follow up through letters written in this regard on
various dates which are available in this website. Click here for the official

Similar is the case
